it has been one of the warmest starts to november we have on records for iowa, and it will continue for one more day! we had a lot of clouds around today in central iowa which kept us in the 60s, but some areas in western and eastern iowa did reach the 70s. everyone will be mild tonight thanks to some clouds and fairly strong southerly winds of 10-20 mph. temps will only fall into the mid and upper 50s by thursday morning. it will be another mostly cloudy day thursday with a few showers possible, but many areas will stay dry. highs will reach the mid to upper 60s with south winds of 15-30 mph and gusting higher. a cold front will spark some thunderstorms for central iowa between 5 and 9 pm thursday evening and will also usher in some much cooler air. we will be back to seasonal averages on friday with highs only the mid 50s. the weekend will be cool, but sunny and dry- good leaf raking weather! next week is also looking closer to average but mainly dry until the end of the week. jack: local five's kattey ortiz is here with the latest in tonight's big story, kattey? kattey: police released this dashcam video of the june 9th shooting last month. despite its release and the officer's clearance of any wrongdoing by a grand jury and the police chief ... his family says it was a wrongful death. "we're pursuing constitutional rights that were violated." a lawsuit filed wednesday alleges des moines senior police officer vanessa miller was negligent when she shot and killed ryan bolinger after a bizarre low-speed chase in june. "the major issue that the jury is going to have to determine was whether ryan's right to live and be arrested by lesser means was outweighed by the officer's right to fire her weapon under those circumstances." dashcam footage shows bolinger pulling up next to an officer conducting a traffic stop. after bolinger gets out of his car and acts erratically in the middle of the road, he takes off. officer miller joins the chase. later ... bollinger pulls a u-turn and is blocked in by both squad cars. he gets out and runs

(nats) she pulls the trigger. the attorney for bolinger's family says there are a number of different things officer miller could've done instead "in the amount of time it took her to withdraw her gun, point it aim it and shoot it, one would think you could easily put the car in reverse and back away." an internal review within the police department found miller's actions were justified and she did what any reasonable person would do. beattie alleges the department hasn't been transparent throughout the investigation, especially now that the internal review process is over. "we wanted witness statements, we wanted investiagtion reports, we still don't have the police report. i soon came to the conclusion that filing the lawsuit was the quickest way to get that evidence." kattey: beattie adds it wasn't a surprise officer miller was cleared. and while no amount of money can bring bolinger back ... he says justice needs to be served in the interest of all iowans. in the studio, kattey ortiz, local 5 news, we are iowa.

jack: officer miller remains on personal leave from the department tonight. stephanie: a campus stabbing--not a shooting--tops national headlines tonight. stephanie: two students, one staff member and a vendor were attacked... at a rural university campus in central california , they are all expected to be ok. campus officials said the attacker was a student but have not confirmed his identity or provided a motive for the attack. he was shot and killed by police. stephanie: and shocking news from illinois, as we learn an officer was not shot by suspects on the run, but by himself in a "carefully staged" suicide. the incident happened two months ago in fox lake--the shooting led to an extensive manhunt. investigators found the lieutenant had been stealing and laundering money from the department over the past seven years. jack: on the presidential campaign trail tonight, new poll numbers show just how close the race is at the top. jack: donald trump and ben carson are within one point of each

among republicans nationally. as for the democrats, hillary clinton is pulling a strong lead ahead of vermont senator bernie sanders. jack: with our "first in the nation" status, iowans can expect a little fun poked at us every four years. last night the target was the iowa republican party chairman, jeff kaufmann. "trevor noah 5:31 you and me iowa, we're cool. but republican party chair, jeff kaufmannn, you newman - george kastanza hybrid, this isn't over." jack: that was just one of the jabs at kaufmann on last night's daily show on comedy central. it comes on the heels of a gop event last weekend in des moines where kaufmann denied the daily show's request to attend the event because he was afraid they would make fun of iowa. but kaufmann tells us he's taking it all in stride.

jack: "i had a good laugh at the clip last night....while we can enjoy a laugh at ourselves from time to time, we always take our role as first in the nation very seriously," now on a more serious note, the daily show's host, trevor noah, had to undergo an emergency appendectomy this morning. so he missed tonight's show. but he's expected to be back to work tomorrow. stephanie: in the wake of a student debt crisis, there's a new approach to paying for a college education....cro wdfunding. a senior at coe college in cedar rapids needs around 17 hundred dollars to enroll in his last semester of college, and he's hoping the kindness of strangers will help him reach his goal. currently, a coe college student pays more than 47 thousand dollars for one year's tuition. the private college offers financial aid and scholarships, but this year, spanish major erie french has to pay for college on his own. "i talked to my mom about it. i told her mom, we're going to have to come up with some money for the first time. she just urged god's brought you this far, he's not going to abandon you now." french attended high

school in southern california. he says he didn't consider coe, until he was offered a diversity leadership scholarship for four years. when french needed a fifth year, his scholarship ran out. "just trying to find a way do what i have to do to make sure i finished what i started five years ago." at the start of this semester, french enrolled in a work study program, and found another job working for cedar rapids day school. he says during the job search he fell behind on tuition payments. french says he won't be able to sign up for his final semester, if he can't pay off tuition by november 17th. so he decided to start a gofundme page. within five days he's already half way toward his goal of 17 hundred dollars. "i was on the verge of tears, it was really exciting for me. i don't know if i could really quantify how grateful i am." coe college said in a statement that it does offer tuition

jack: folks hoping to share their concerns about the dakota access or bakkan pipeline later this month -- this is for you. we've learned the iowa utilities board is limiting the number of speakers and how long they have to talk. the pipeline would cut through the state. iowans for and against the project were encouraged to go to the board's meeting next thrusday in boone to voice their concerns. but a recent ruling from the board says only 210 people, 105 from each side will be allowed to speak. each speaker will have 2 minutes. we'll be in boone next week with full coverage on the hearing right here on local 5. stephanie: some city government shake-ups from last night's election results. stephanie: a shake up in knoxville after last night's election. council members april verwers and carolyn formanek failed to win back their seats in the election. both councilors voted monday night to remove the controversial soldier's memorial from city property, and it's believed that decision may have cost them.

stephanie: and in colfax, a council seat may have been won by just one vote. a few absentee ballots could change the decision though. right now, curtis small is the new city councilman at- large with 161 votes, while dennis williams got 160 votes. final results will be announced next tuesday. jack: and tonight, we finally know what caused nearly all the roosevelt high school teachers to call in sick two weeks ago. it was bacteria in the walking taco meat served to the teachers. it's not clear where the meat was from, but teachers were all served the food during a lunch on october 22nd. stephanie: jon joins us now and the cyclones look good with joel lanning running that offense jon: that's right stephanie and they'll keep riding the lanning train until season's end or it just derails. coming up on local 5 sports we'll hear what improvements rhoads wants to see in lanning's next start against oklahoma.

oklahoma. the cyclones have outscored their opponents 54 to 10 since lanning took the reigns. it's a smashmouth mentality that's completely foreign in the big 12. lanning isn't afraid to run the ball-- and run over a defender at that. even with his success rhoads says there is still room for improvement. "ou is going to be a tough game no matter what they're a great program so we're going to have to prepare ourselves and just play with confidence like you said. defense is playing great right now and we need to build as a team together and just carry it over. i think leadership and competitiveness are one thing that we saw out of him certainly he made plays both running and throwing but there were a number of under thrown balls fixable things. he was on his front foot too soon or he was on his back foot too long tried to muscle it things of that nature. " jon: iowa state and oklahoma meet saturday night at 6 on espnu. the sooners lone loss is to texas. since that game the sooners have

score 55 points or more in each game. hopefully isu can slow them down this weekend. jon: the iowa hawkeyes are starting to get more and more attention on the national stage. it's at a point where it's possible iowa could shock the big ten and the rest of the country and make it into the college football playoff. there are still a lot of-- if-- situations... alex giaimo has more on how the hawkeyes are handling the hype. "the unbeaten hawkeyes have finally caught everybody's attention. a bigger spotlight shined on iowa with every win but the team says they still aren't bothered by it. (tevaun smith) i'd say before the season their was negative noise now its positive, it's no different, so we are definitely doing whatever we do as a team and just worrying about us. i mean all that hype doesn't do anything for us. (greg mabin) you know it's definitely a little bit of extra motivation because okay now people are finally starting to notice us. you know the hard part is being recognized nationally but you know all that's just extra noise we don't really concern ourselves with that too much.
