" local 5 news at 10 in hd starts now. we are iowa" jack: good evening, i'm jack miller. stephanie has the night off. the iowa lottery is back in the spotlight tonight after another problem with a winning ticket. after former lottery association employee eddie tipton was convicted of fraud over manipulating ticket numbers, a des moines man is facing criminal charges , accused of being too young to buy a ticket, and then lying about it. local 5's jacob peklo has the latest on the investigation from des moines. jacob peklo, reporting: "a $100,000 prize was sold here at the super quick food in des moines. a 20 year old claimed the prize, but lotto officials say the problem is that he also bought it here." mary neubauer, iowa lottery spokesperson:

it, from that situation, so long as the facts back up what occurred. in this case, in fact, the facts didn't back up the story that we were presented with so penalties would apply." in late july, jobie boals-watters claimed his prize check, saying a co-worker bought him the winning ticket. mary neubauer, iowa lottery spokesperson: "we got a tip that in fact, people didn't think that was the case, and determined through our investigation, that he purchased the ticket which made it an illegal purchase." while his picture is still on the website, his money may not be his for much longer. he's facing misdemeanor charges for underaged gambling. you have to be 21 to buy a lottery ticket. mary neubauer, iowa lottery spokesperson: "i think he might look like he's older than 21, but for retail locations if they ever have a question like that, they do need to ask for id." local 5 spoke with the owner of super quick, cj singh, off camera. he tells us that he's had the shop for 16 years, and recognized boals-watters, who usually comes in every day. the time he got the winning ticket, boals- watters came in with another woman, who he thought was his

showed a fake id. mary neubauer, iowa lottery spokesperson: "it's a violation of iowa's criminal statute." and now, the lotto is taking steps so that the convenience store owner can't sell those tickets for a week. mary neubauer, iowa lottery spokesperson: "the law is in place for a reason. we need to make sure that the law is enforced. and the good news is that this doesn't happen very often." jacob peklo, reporting: "singh tells me he will appeal the decision, saying he needs the money generated by the lottery. reporting in des moines, jacob peklo, local 5 news. we are iowa." jack: the prize money was paid out already, and the iowa lottery is working to get the money back through the legal process. lottery officials say they get a case like this about once a year. we tried reaching out to jobie boals- watters, but have not heard back. jack: a wild scene near the drake campus today -- cops say a drunk driver was out of control and ramming into cars. the guy left a fast food restaurant and started weaving through traffic along carpenter and forest avenues,

take a look at this. this is the moment when the guy's minivan finally hits a power pole and the whole things comes to an end. but look at some of the cars he hit along the way -- at least eight. police took away the man on a gurney after he crashed his car into a pole. they say the man was giggling as they took him away. witnesses say several people chased the driver down the street after hitting their vehicles. no one was hurt. jack: after two recent devastating cases of vandalism -- investigators in fort dodge say they've caught someone. daniel swick is charged tonight with two counts of first degree criminal mischief and two counts of third degree burglary. in this surveillance video from december 15th, police say you see swick trying to steal a motorcycle, then setting off a fire extinguisher inside little joe's computer store. investigators say swick did the same thing inside the webster

"mostly a big hassle, we had to hire service master to clean literally everything from top to bottom, 2 days with 24 people, that bill is an estimate of 52,000 to clean the building"" jack: the courthouse has reopened while little joe's computer is hoping to reopen by late january. daniel swick is being held in webster county jail. jack: tonight, the family of des moines teenager sam kemp continues its search for answers. they want to know how the 17 year old ended up dead in a pond between granger and grimes last week. kemp was at a party there and ran off when police came. it took searchers 5 days to find his body. one autopsy has been done, but the family is asking for another and more answers from police. tonight, mothers against violence joined the family outside the polk county courthouse to

"we want answers we don't know why he ended up in that pond we have not gotten answers on why he's in there what even could lead to the reason he was in there no answers the dept has not even called us to give us updates " jack: a toxicology test was done on sam kemp, but the results have yet to come back. stay with local 5 for the latest in kemp's death. jack: in spencer, the high school wrestling team there is still dealing with a teammate who tragically passed away last weekend. austin roberts collapsed during a wrestling tournament and died at a hospital. some of austin's teammates took time to share their memories and to celebrate a young man who they describe as their brother. coaches say it hasn't been easy for the boys emotionally, but they're depending on one another to help get through it. ""they're together in this and nobody else knows what they're going through other than each other. and it's created a little bit of a bond in our already tight family." jack:

jack/ots time for "one classroom at time." bankers trust and local 5 are excited to give this thousand dollar grant to a teacher who's trying to help his students learn a lesson that many adults struggle with... diversity and acceptance. he hopes to do that with the help of real people instead of just books. stephanie angleson has the story. around tells you this isn't your average school.. there are snakes....and other animals...even a dog...all here to help these students work through some of life's challenges. try to teach critical thinking skills...diverse thinking, and trying to just think outside the box. accepting people. i try to do a lot with diversity and that kind of thing..tolerance. tolerance...it's not an easy thing to teach. but chris had the idea that a local non-profit called cultureall could help. they're well known for educating iowans about different cultures. with cultureall ... we have students working on various different things...soif someone's learning about the holocaust, we could have a holocaust surivor come in and talk about it, or a native americans, anything just like that, and just have them come in and kind of give them first hand knowledge about that. at metro west, it's a student centered program. that means they get to pick out

"your watching local 5 news in hd. home of weareiowa.com " jack: if you've ever been on the recieving end of a random act of kindness...you know how good it feels. our partner tv station in sioux city was approached by a secret santa this week. he handed over three thousand dollars and wanted them to help give it to strangers. they pulled in the woodbury county sheriff's office to help. and what happened next is pretty cool. jenna ranstorm reports. woman says, "holy buckets!" woman cries... says, "thank you so much!" woman shouts excitedly, "thank you!" last thursday, armed with envelopes filled with $200 cash, each, we got to fufill an anonymous donor's

goodwill, to 15 unsuspecting siouxlanders. deputies from the woodbury county sheriff's office drove us around and helped spot some folks they could tell needed a little holiday cheer. deputy jim mccrystal says, "we're just looking for people that we want to approach, talk with them, and again, maybe things just arean't going their way at this point and time, financially, and we just want to help them out as much as we can, so it's great that our secret santa is in a position to donate this money." one man invited us into his home where he's caring for four children. he says it's been a tough year paying the bills, and the money, is a bit of a relief.

because this has been a slow year as far was work goes; you know, ready, willing, and able to work, but the ground was soft and, you know, so work just wasn't there this year, so this is awesome. jerry cruz, woodbury county transport officer, says, "it's a lot of fun. it makes me feel good to be able to share the holiday spirit with people that [you can] make it a little bit easier for them. it's a good feeling." everyone we met needed this money, especially this time of year... woman says, "i'm so overwhelmed, i can't believe it. it could've have come at a better time for me an my kids." but, even more than that, maybe, they needed hope - someone to care about them - someone who understands that the holidays aren't easy for everybody. womans says, "you kind of lose faith a little bit at christmas time,

" now, local 5 sports with jon schaeffer. we are iowa sports" jon: it was an upset loss on saturday night to northern iowa that dropped the cyclones to number 11 in the ap poll. well things didn't get any easier tonight-- as iowa state hit the road for number 22 cincinnati. i-s-u-- is in much need of a win tonight to get their minds right after that tough loss to the panthers. we open with a monte morris triple part of a 7-0 run for the cyclones to start this game. now up 9--

iowa wins85 to 63 let's head over to the knapp center as drake hosts abilene christian. first half-- kale abrahamson driving base line gets the lefty lay in to fall-- drake up early in this one. but abilene christian sticking with the bulldogs-- jaren lewis comes up with the loose ball and the put back. wildcats up one. bulldogs though finding their range graham woodward for three from the corner-- knocks it down drake now up 5. more drake-- woodward driving can't get the lay in to go but dominik olejniczak tips it in drake stetches that lead. acu sticking around down low to jaylen franklin who kisses it off the window for two. jovan crnic follows it up with an nba range three pointer for the wildcats who are now only down two points. abrahamson with a rebutle the fall away jumper finds the bottom of the bucket... drake goes on to win... 87 to 70 over abilene christian in front of their home crowd. to women's

today... the hawkeyes controlling this one most of the night chase coley underneath gets the bucket and one... then off the steal tania davis takes it all the way to the hole-- lays it in. hawkeyes led by 16 at half. ally disterhoft hitting the three here she had 20 points. drake though put up a fight tonight. sammie bachrodt with the three from the wing here she finished with 6 points. but the star for drake-- lizzy wendell the bucket inside... then she hit a three next-- she had a game high 35 points but it wasn't enough.. drake falls to iowa 89 to 76 in iowa city. and in other women's basketball action-- iowa state tops northern arizona by 16. and northern iowa falls to creighton tonight 69 to 61. jon: we'll be right back... you're watching local five news at 10.
