papa don't preach welcome back to "good morning america." madonna's "papa don't preach" was one of her all-time hits. but right now, she's begging her son to come home, battling her ex for custody after 15-year-old rocco said he wants to stay with dad. abc's kanya whitworth has the latest. >> reporter: over the weekend, madonna cherishing time with h her mily. the queen of pop taking to social media expressing her love for her four kids. posting this pictu with rocco, writing, merry xmas to the son-shine of my life.

embroiled in a custody battle with her ex-husband guy ritchie over 15-year-old rocco, he's apparently living with his father in england and reportedly doesn't want to return to live with his mother in new york. but last wednesday, madonna asked a new york city judge to order his return from london. >> it's a little unclear what is going on. but it may be a case of a teenager growing up and having some rebellious spirit. recently, madonna said he really embodies the rebel heart. he's growing up. it's hard to raise a teenager. 's hard under the microscope. >> reporter: madonna photographed leaving court last week. after the judge ordered the teen to return to the u.s. the teen will reportedly get his own court-appointed attorney, which might allow him to make a request to live with his father if he still wants to. >> since september, madonnnna has been super busy on her tour. but he's joined her on tour. he's been helping out backstage.

8:05 am
he'll list the reasons. then, inll likelihood, if they agree these are good reasons, they would then recommend to the court, this is whahat my opion is as representative of the child is in this case. when you're talking about someone who's 15, getting close to 16, that could have a lot of sway on the court. remember, this kid is in school. there are a loof issues here. >> and you say likely this will take place in new york, any chance that guy ritchie could have this heard britain, over in the uk? >> he could try but, because the child is still csidered a new york resident, i think almost certainly the british courts would say, they're dealiling with this in new york. this is unlike kelly rutherford's case, they sent the kids to monaco and sort of invited the monaco court to take that here. certainly, you would have a new york court resolving it.
