" local 5 news at 10 in hd starts now. we are iowa" stephanie/2shot iowa heavy metal band slipknot is back in the spotlight tonight. good evening. i'm stephanie angleson. jack/2shot and i'm jack miller. the fatal overdose of a famous musican could change the rules on wrongful death suits. paul gray was found dead in des moines from an overdose in 2010. his wife was six months pregnant at the time, and now wants money for her child growing up without one of their parents. she blames her husbands doctor -- daniel baldi for continuing to prescribe him pain pills despite evidence of drug addiction. jack: local 5's nikki davidson was in the courtroom tonight and is here with the latest in tonight's big story. nikki? nikki: right... now that doctor has been cleared

grays death... it wasn't until four years after gray died that a lawsuit was filed seeking damages on behalf of his wife and daughter who wasn't born until after his death. its the timing thats an issue here... because the statute of limitations says these types of wrongful death suits must be filed within two years. tonight his wife's legal team tried to convince the iowa supreme court that those rules should be changed... musician paul grays wife says even though the couples daughter wasn't born before her dad died... his loss will always be with her. 2:57:52 this child has life, born and lives everyday without her father, theres no father to be with her for birthdays and christmas. his wifes legal team is fighting for damages on behalf of both of them... but because that wrongful death suit was filed two years too late... it was dimissed in district court. thats what's brought the case here to the iowa supreme court... where the justices will be deciding if the rulebook needs to be rewritten on the stautue of limitations for wrongful deaths invovling a doctor. 3:26:01 it's been on the books for 20 years, to change it now, is that

for more than two years now. alexander fazzino is charged with his wife's 2012 death in boone. his trial has been put off many times, the new date is set for monday. prosecutors say fazzino hit and killed emily fazzino in the family's bath tub... the trial was put off after one of fazznio's daughters underwent tratement for cancer. stephanie: the oklahoma man accused of crashing into and killing these two iowans, nine year old eric fuller and his grandmother karla hand, says he's not guilty. last august, richard hutton r-v's ran a stop sign at the intersection of g-76 and highway 69 in warren county. he's been charged with failure to obey a stop sign, failure to maintain control and driving on the wrong side of the road. his attorney entered his plea today. dates for his trial have not been set. jack: looking to tighten the rules for texting while driving is a statehouse matter tonight. jack: right now texting while driving is considered a secondary offense... meaning officers can't pull you over for

they see you breaking another law. a new bill would make texting while driving a primary offense. the sponsor of the legislation, senator tod bowman, says it's a way to toughen up iowa's distracted driving laws. "bowman 5:32:18 there's people that think it would provide police another reason to pull you over, it does! when you're doing soething harmful, it does give them another reason to pull you over but a legitimate reason to pull them over." jack: this bill passed in the senate and will survive funnel week. but bowman says the speaker of the house hasn't expressed any interest yet in taking it up for debate. jack: governor branstad is intent on privatizing medicaid by march first. several lawmakers continue to raise concerns. they're worried that the 16 items the federal government ordered to be fixed before the program rolls out are still a problem. here in des moines, central iowa shelter and services received a fedex envelope with a blank letter inside. behold a check for one hundred thousand dollars -- even though it was written to "the mulberry street veterans outreach program" the shelter knew it was for them. following the death of a supreme court justice antonin scalia over the weekend, an iowa senator is facing harsh criticism. jack/2ramvo: there's a scathing editorial out tonight by the des moines register that's titled -- "grassley's supreme court stance is all about politics." stephanie: it refers to senator chuck grassley's claim that we should wait for a new president to appoint justice scalia's replacement. jack: as chairman of the senate judiciary committee, grassley would have an important role in this process. the editorial says quote: "this could have been a "profile in courage" moment for senator grassley. this was an opportunity for our senior senator to be less of a politician and more of a statesman. but he chose instead to disregard his constitutional duty by rejecting a nominee who hasn't even been named." stephanie/2ram: grassley says the reason he's opposed to obama picking a replacement is based on precedent. saying quote, "the fact of the matter is that it's been standard practice over the last nearly 80 years that supreme court nominees

during a presidential election year." jack: grassley was during a series meetings in today, where he said he'd take the nomination process , quote, "one step at a time." stephanie: senator grassley was followed in these meetings activist group matter." they say he's playing this issue two different ways. jack: they say back in 2008 grassley argued this issue the exact opposite way as now. this is when one of president george bush's judicial nominees was being held up by a then- democratic majority. here's what he said then. "the reality is that the senate has never stopped confirming judicial nominees during the last few months of a president's term," jack/2ram: so if senator grassley has his way and the
