powell joins us live outside the courthouse with happened inside the courtroom on the first day claire? claire: fazzino was found dead inside the family's home. alexander fazzino-who claims he was with his children at the time of his wife's death, was arrested on first degree murder charges april in 2013. literally been years in the making. since mid-2013 the trial has been moved from boone to winnishiek county due to emily's familieis prominence in the boone area. it's also been delayed five times for legal matters and once last year so fazzino could be with his daughter during her bone marrow transplant. but this morning the final jury was selected. each side began with opening statements state proseuction painting emily on the roadto recovery, saying the week following her file for divorce, emily told her friends and family she was afraid alex would kill her. on the other sied, alex fazzino's defense attorneys say

withdrawal led to emily's drowning death. not murder. juddge michael moon kept things moving along- bringing up three witnesses to the stand following opening. attorney's using numerous exhibits including emergency units body camera footage, photos, chilling 911 call from alex fazzino when he found emily dead that night in january 2012. extra deputies on duty. we'll be bringing you the latest coverage as witness testimonies continue. live from winnishiek county claire powell local 5 news we are iowa. jack: new at 6 tonight, a clive man accused of taking in a trophy deer with bait won't be going to jail. jack: joseph franz from clive was found not guilty. he was charged by the department of natural resources with the use of bait hunting and taking deer in marion county in october 2014. the court found that even though franz was hunting within 57 yards of land that had materials that attract deer, he didn't place the bait for deer hunting. the court also pointed out that franz may have hunted on the land because of this advantage, but being on that particular piece of land is not illegal. stephanie: an iowa democrat running for for u-s senate is shedding light on orascom's iowa fertilizer plant project in lee county. bob krause at

today says thousands of workers don't know if they'll be working onthe plant project next month, and krause says that's a problem. "the thing is coming to a head because one of the large contractors has stated if they dont get paid a hundred million dollars, by march 1st, they're off the site, theyre shutting down. and they are a key contractor that the other subcontractors cannot do their work without. " stephanie: krause says that he's heard rumors of a complete shutdown of the construction project at the end of this month. he's asking for state and federal government officials to confirm the timeline of the project as soon as possible. jack: should little kids be allowed to handle a gun in iowa? it was a hot issue on the house floor today. jack: a bill that would allow children 14 years or younger to handle a gun was passed by the house earlier today, but not without a contested debate. some argued that the law simply adds to an already-existing law that allows kids

younger to carry a shotgun, and that parents would still be responsible for their child's actions. but some house democrats argued that the bill is too broad and that kids that age are not mature enough to make responsible decisions. jack: privatized medicaid in iowa is a go. the state finally has federal approval to go forward on its privatized medicaid system. the federal centers for medicare and medicaid this afternoon gave approval to governor branstad's plan to change the state-run program to be managed by private out of state companies. but the federal government says the program can't be rolled out until april 1st. it was supposed to happen march 1st. the deadline has been pushed back several times. we'll have more on this new medicaid development coming up at 10. stephanie: at the nation's capitol, iowa's own senator chuck grassley is at the center of attention as the senate held a series of meetings to decide what to do about a possible supreme court justice nominee. grassley is chairman of the senate judiciary

would hear from a potential nominee. he and his fellow senate gop colleagues decided earlier today not to host any hearings on a potential nominee. grassley spoke on the senate floor yesterday to defend his position that the senate should not vote on a replacement during an election year. he used vice president joe biden's remarks as senate judiciary chairman back in 1992 when faced with the same problem.
