it's shaping up to be a monumental fight. jon karl is at the white house with that side of the story. >> reporter: good morning, george, this is a battle that's likely extend throughout ts presidential campaign and into the first months of the next presidency. the battle over replacing justice antonin scalia came fast and furious. less than an hour after the suprpre court announced his death on saturday, senate majority leaderr mitch mcconnell declared the vacancy should not be filled until we have a new president. senator marco rubio told george, the senate shouldn't start the process no matter who president obama nominate. >> reporter: within the last few months of the president's term we shouldn't be appointing supreme court justices. >> reporter: president obama called scalia a brilliant legal mind made clearar he would move

>> nominate a successor in due time. >> reporter: they're vowing to run out the clock until obama leaves the whihi house. that has democrats up in arms. >> the kind of obstructionism that mitch mcconnell's talking about. he says no, we're not having hearings. >> reporter: supreme court vacancies during an election year are extremely rare. while it's still early, the short list of presidential obama nominees. it includes merrick garland, a moderate who's won praise from republicans. circuit c crt judge jane kelly has won praise from senator grassley. and sri srinavavan confirmed as a circuit judge 97-0 just t tree years ago. he would be the first justice of asian descent. no word from the white house when the president would make
