live in northwest miami-dade. i'm andrew perez, local 10 news. >> if you saw something, say something. >> developing tonight police forced to fire on the 71 year old man who was waving a gun and firing off rounds. >> and local 10 news carlos suarez with the latest. carlos? >> neighbors paint the man of the picture who loves his wife and his family. in fact we're told loved ones were behind me when that 911 call was made. tonight that man that lives in the house was recovering in the hospital and facing some serious charges. detectives worked into the night tryingngo figure out what would lead the man to the 3-hour standoff that ended in gunfire and the 71year-old man shot. >> there's 3 shots fired and actually came out when we look down tht street and seen that swat had suspects going to the

the man and woman in the semi survived. that's how his life came to an end but only begins to tell the story. >> still have trouble dbreathing. >> reporter: rabbi mark philippe said for a year he's tried to help the man who battled depression and tried to take his life in the past. the days leading up to his death filled with warning signs. on friday he wrote about a possible suicide attempt on facebook eerily similar to monday's crash. quote, i started drive north on i-95 with plans to get on the florida turnpike, drive the wrong way and crash head on into a truck and kill myself. then he wrote pulled over in tears. >> i am devastated. i am still shaking. i am still crying. >> then on saturday temple security called police after he caused a disturbances and congregation members had complained about him. another facebook post. saying "a jew should always be welcomed to pray."

permently banned. earlier today into the night, the family gathering at his miami beach home coping with the loss. and they're aware of the facebook posts and his history. again, the funeral set for tomorrow. on miami beach tonight, victor, local 10 news. >> victor, thank you. let's have the follow up file because the judge is upholding a life sentence om michael hernandez who is kikted for fatally stabbing his friend in middle school. hernandez now 26 first received a mandatory life sentence without parole for the 2004 stabbing death in the bathroom at southwood middle school. after the dge upheld hernandez's sentence, the family called it a relief. 4> i had asked myself how is someone not sickened by a song about cutting someone's throat and watching them die. >> it@took us like 2 years back

apartment, cops say he lashed out slashing her and beating her so badly valentine's day she went into a coma. >> i can't -- i can't comprehend how it's possible that somebody can be so cruel and do such a thing to somebody and try to kill them. >> reporter: while jones is still at jackson memorial hospital, we're learning more about 35-year-old mitchell. >> he said was in the health care industry. >> reporter: this realtor says he met him at a miami networking event, pictured here ys before the alleged attack and mitchell said he sold supplements. >> he wawa't all there and the way he would look at you was a little -- a little creepy. >> but mitchell s no record of a violent past. local 10 checked court records from jackson county mississippi, his last known address. no criminal history. in south florida no criminal record either. the military confirms he served in the air force. >> yes, sir. >> reporter: mitchell tells police he acted in self-defense, but what actually

detectives are still working to find out. there are still so many questions abouthis case. mitchell now faces a charge of attempted murder. we're in miami tonight. i'm janine stanwood, local 10 news. >> we hope she pulls through. janine, thank you. police now know the type of car they're searching for after a teenager was struck in the street this morning in northwest miami-dade. miami-dade police have released surveillance video of the car actually striking that teenager. the video o shows a figure running across the street when he's struck by a silver mercedes sending him flying into the air. 15-year-d javier valdez was on his way to school with his younger brother when he was hit. witnesses say the driver had the green light but left that scene before police arrived. >> if they would have remained on the scene theywould not have been at fault for the crash.they had the green light and the right of way but unfortunately once they leave the scene it becomes more difficult for them as far as the punishment that could be handed to them. >> reporter: police say valdez sat for head injuries in the crash.

memorial hospital in critical but stabab condition. >> calvin: the uber driver accused of going h a killing spree in kalmazoo, michigan, made his first court appearance earlier today. jason dalton was arraigned on several charges including 6 counts of murder. police say dalton picked up passengers in between his killings. one passenger recounted being picked up by dalton while the president offered the victim's families his condolences. >> i said you're not shooter are you? he said no. i said are you sure? and he -- he kind of just said no. i'm just tired. i've been riding for 7 hours. >> you have familis who are attered today. >> they arrested him after they say he killed 6 6 people over 7 hours at 3 locations. those 6 victims killed in the shooting were dorothy judy brown, barbara hah thorn, mary

will develop along this frontal system and the second one will give us enough of a kick here as the jet stream digs on the eastern seaboard to bring us an increased chance of showers and thunderstorms and a pretty big change. for tomorrow our winds come more out of the south so we're looking at tuesday. warm, humid. about a 30-40% chance of some isolated showers around and mainly in the afternoon on the southerly wind. here's that seco area of low pressure trailing cold front starting to move through our area and bringing us a better chance of showers and thunderstorms. right now the timing looks to be between about 5 and 8:00 on wednesday. and then eventually clearing out as we go through thursday morning and evening so we're going to watch this timing because if it gets here in the afternoon hours, the atmosphere is a little more primed and unstable. and behind it, that's the big change. we'll sethe winds come back out of the north as it's really going to cool us off as we go later on in the week. 2 days here with the increased rain chance. wednesday we'll have more widespread impacts here with

was injured d the pilot was able to walk away unhurt well. and a miracle in missouri after a tour bus is torn apart after a crash. all 10 people survived. one person had critical injuries. it happeped outside of kansas city. the bus had pulled over to fix a flat tire when sideswiped. 9 papsengers and the driver were on board at the time. >> reporter: it's deposition day in massachusetts as the wife of bill cosby answered questions related to the defamation case and it wasn't the last time. camille cosby's attorneys fought e deposition arguing she had no information to contribute to the case. this deposition is taking place in a civil case against bill cisby. several alleged assault victims sued cosby for defamation after accusing him of lying. they'll be deposed again march 14th.
