the u u. the case was thrown out on a technicality. attorney who fileded said he still is deciding whether to appeal. and a ruling from a court here in new york says a fraud lawsuit against donald trump can continue. the suit alleges that trump's former school for real estate investors called trump university was unlicensed. and defrauded students by having them enroll in increasingly expensive seminars. it seeks $40 million in restitution and damages for thousands of students. trump asked that the suit be dismissed. the court rejected the request. >> the showdown between apple and the head of the fbi. at issue whether the computer giant should comply with a judgdgs order to unlock an iphone owned by one of the san bernardino shooters. we get more now from abc's elizabeth hur. >> reporter: from the courthouse to capitol hill. >> if you're expecting somebody to obey an order to do something they don't want to do and you haven't figured out whether you could do ityourself.

fully investigate terrorist attacks. kendisiand reena? >> thank but.another sex abuse scandal involving the catholic church is erupting in pennsylvania. it rivals the scope of scandals in boston and philadelphia. two bishops in altoona are accused of covering up hundreds of abuse cases by more than 50 priests an religious leaders. that's over a period of 40 years. the state's attorney general says no charges have been filed as the statute of limitations has expired in most cases. >> the sexual assault case against bill cosby in pennsylvania has been put on hold pending an appeal. cosby was expected to appear for a preliminary hearing next w wk bug that will now have to wait while judges decide whetherer to have the case thrown out as cosby has requested. turning now to another developing story this morning. at leaea one confirmed and two other potential tornadoes in alabama. at least four people were injured by a twister southwest of birmingham. packing sustained winds you have 75 miles per ur.

serious damage. trees were uprooted and power lines were downed. >> it wasn't a tornado but an out-of-contrtl suv that all but destroyed a restaurant in newtown outside of boston. killing at least two people and injuring at least seven others. the restaurant was packed with diners at the time of this accident. and several people were also on the sidewalk. the suv's driver and passenger are believed to have suffered only minor injuries. no word though on what caused that crash. and that suv slammed right into a home right there in omaha, nebraska on the other side of the wall was a 12-year-old boy's bedroom. jeffrey moore wasn't injured. possibly because had he moved his bed to the other side of the room before going to bed. just hours before the crash. the driverer 56-year-old man was arrested on dui charges. of in south dakota, a victory for activists supporting transgender rights. the governor has retoed bill

returning to our top story, donald trump and hillary clinton relishing their super tuesday success stories. trump trounced his fellow rivals claing all but a few victories. ted cruz won a couple of res including his home state of texas. marco rubio picked up minnesota, his first victory and bernie sanders is still in theunning holding off clinton for the win in several states. hillary clinton follows up her big super tuesday win with a rally and concert in new york. among those performing katy perry and elton john. >> clinton's team still sounding notes despite her victories last night. >> good morning, reena and kendis. a big win for hillary clinton. she celebrated in miami, florida not in a super tuesday state.

her speech to a fired up crowd made little mention of bernie sanders. she focused on the gop, namely donald trump and took a knock at his campaign slogan saying we shouldn't make america great again, we should make america whole. >> this country belongs to all of us, not just those at the top. not just to people who look one way, worship one way or even think one way. we have to make america whole. we have to fill in. fill in what's been hollowed out. >> reporter: despite her lead, sources inside the campaign tell me they're not ready to say the primary is over. they're confident where they stand and they think come mid-march she'll be too far ahead for bernie sanders to have any realistic chance of winning the nomination.

>> let's get more insight on this incredible night at the polls from the key state of texas. >> our own abc's marci gonzalez is live for us at this early morning hour in austin, texas. marci, a big night, no doubt, as we mentioned for hillary clinton in texas as well as other southern states. but this really wasn't a complete slam-dunk. >> reporter: no, it really wasn't. it was a fairly good night for bernie sanders. he won as expected in his home state of vermont but he also is projected to pick up three more wins in oklahoma, colorado, also one other state, sanders points out though these are not winner take all contests. so even in the states where he didn't win, he is still going to pick up some delegates. he's moving forward with momentum and also doing really well with fund-raising. in february, he raised about $42 million. that's twice as much as the clinton campaign in january. kendis and reena. >> incredible. he has been raising a lot of money.
