is cbs3 "eyewitness news". >> we approached the car. he looked -- he was totally shocked, surprised to see these atf agents coming at him. >> accused of kidnapping a philadelphia woman who is now safe. tonight we are learning more about delvin barnes and how agents were able to track him down. good evening, i'm jessica been. >> i'm can chris may. "eyewitness news" broke the story that carlesha has been found alive. sources tell us delvin barnes has confessed to abducting her off a germantown street. matt rivers is live with brand new details on what led those agents to barnes. matt. >> reporter: chris and jessica, this is a copy of the criminal complaint filed by the fbi against delvin barnes detailing, as you mentioned, how they were able to track him down. this after for the first time not long ago we heard from several members of the philadelphia police department including the detective who promised her family he'd bring

carlesha home. when detective james sloane first saw the woman he desperated searched for his words were simple. >> i just told her i been looking for you and she started crying, her mom hugged her and her father embraced her. touching moment. >> reporter: the happy ending came after a frantic search for the 22-year-old across several states. a federal criminal complaint obtained by "eyewitness news" details that investigation. it describes how a woman in maryland found a receipt from a philadelphia grocery store in her drive way tuesday evening. she thought that odd and called police. that led officers to an acme in northeast philly where they obtained this surveillance video shared almost immediately with other departments. >> once they saw that video, of course things started coming together and once it started coming together it did happen pretty quickly. >> reporter: officers in the charles city county virginia sheriff's office saw that video and recognized barnes. he was wanted for kidnapping and rape in virginia and they knew he had a gray ford taurus registered in his name.

another surveillance video of barnes using an atm after the kidnapping showed that car. that car was then spotted in jessup, maryland, where bans was ultimately arrested by federal agents and carlesha was saved. >> it was a tremendous amount of relief last night for everybody involved and particularly the family. >> reporter: we also learned thursday how hard carlesha fought to escape. after being forced into the car sources tell "eyewitness news" she found a hammer on the floor and swung it at barnes shattering a window in the process. it was that strength that her family prayed would get her through the ordeal. their hopes pinned to a pledge police made to carlesha's mom sunday night. >> i promised i was going to get her daughter back. she didn't look me in the eye so i said it again and she said okay. >> reporter: a promise kept. and we know that carlesha is out of the hospital now resting at an undisclosed location here in philadelphia. she has asked for her privacy as she begins her recovery. we're live outside of

northwest detectives, matt rivers, "eyewitness news" at 10:00 on the cw philly matt, thank you very much. we do know that barnes was denied bail in towson, maryland, today. he waived extradition back to charles city county, virginia, where he faces that attempted murder charge. "eyewitness news" reporter diana rocco is in towson and talked with the federal agent who arrested barnes. >> reporter: delvin barnes is being held at the baltimore county correctional facility after his appearance in court today, he is awaiting extradition to virginia on other violent crimes. tonight we are hearing a firsthand account of how the atf took him down. delvin barnes went before a federal judge in maryland thursday on video conference from a baltimore jail. the 37-year-old is being held on a slew of rape and kidnapping charges in two states. wednesday federal agents in virginia got a gps hit on a car he had recently purchased there and tracked him to maryland. >> as we approached the car, he looked -- he was totally

shocked, surprised to see these atf agents coming after him. >> reporter: special agent jeffrey matthews got the call, the ford taurus was parked in a jessup shopping plaza. agents saw a man an woman in the back seat. >> we noticed there was movement in the car that indicated that he would possibly be pulling out. there was plastic bag had been placed over the rear passenger side window which we knew fit the description of the vehicle from the philadelphia abduction. >> reporter: agents block in the car and ordered barnes to the ground. carlesha was in the back seat visibly distraught. >> at that time we announced we're safe you're the police. who are you. we couldn't understand what she said. when we asked where are you from and she said philadelphia. >> reporter: is that the moment you knew. >> it was an incredible moment for all of us and we knew that we had her, we had the right guy. >> reporter: the state police now have five days to move barnes to virginia where he'll face charges there. no word when he'll be back in pennsylvania.

in towson, maryland, i'm diana rocco for "eyewitness news" on the cw philly. >> i'm not going say like everyone else he's a good person 'cause he's my nephew. he's not a good person. >> reporter: that is devlin barnes' uncle. he told us today he wasn't surprised to learn his nephew is accused of kidnapping carlesha. in 2005 barnes was arrest in philadelphia for aggravated assault criminal trespass false imprisonment burglary and reckless endangerment. when he was released less than a year ago he headed back to virginia where his parents still live. that's where police say last month abducted and raped a 16-year-old. that teenager was found bleeding, burned and smelled of gasoline. she remains hospitalized. >> we're a small tight knit community and something of this caliber almost never happens here. it's a shock to the community, i'm sure it's a shock to me and but i'm sure the community is glad that this guy is off the street. >> reporter: police in virginia say they're investigating to see if there are any more of barnes'

victims. we're hearing from delvin barnes friend who maintains that barnes is a good person. ronald davis says he worked with barnes at a supermarket near richmond virginia. the pair would stock shelves and bag groceries and the store owner described barnes as a hard worker. davis says barnes was living in a hotel and struggling to make ends meet. >> didn't have money for gas. his baby momma just lost his car so it's like he has to commute to work and then back and forth for her dealing with the kids. he's always looking to help somebody, always looking to bend over backwards. he'll give the shirt off his back if he could. >> the store owner says barnes did not show up for work last week. that's when police arrived with a warrant for his arrest. >> the big break in this case no doubt came when investigators got an image ofs car with a used car dealer's name on it. that dealer was able to tell them that barnes' car had a gps track erin stalled which is a tool that some dealers use to keep track of buyers

who have bad credit. so, they used that gps device to track his car down at a strip mall in the 7200 block of waterloo street in jessup maryland which is here just outside of baltimore. police swarmed that area, they found the car. this was the scene from a helicopter last night inside this very car was delvin barnes who was taken into custody and carlesha freeland-gaither who was rescued. stay with "eyewitness news." we'll keep you up to date on the rescue of carlesha and the investigation that's followed. you'll find the very latest on cbsphilly.com and while you're there, make sure you sign up for "eyewitness news" breaking news text alerts. >> and it is a lot of rain moving through the area right now, kathy. is it going to dry out any time soon? >> it is. i think we have one more batch of rain moving through delaware and south jersey, a broad circulation continues over the northeast and the

midwest with a upper level low pressure system and the rain will not totally end until that low is over new england and that's going to take until tomorrow evening. so, we have one batch of rain moving up that i-95 corridor, mainly to the south and east and that will head towards south jersey but just some showers and then more showers wrapping around the systematically that will hold off though until tomorrow afternoon. visibility is down with areas of fog and drizzle. in lancaster .3 of a mile visibility, reading a mile and a half and through allentown and millville only 3-mile visibility. as the skies begin to clear overnight tonight that visibility, of course, will improve. we'll get rid of some of that moisture. to the north and west of the city cooling, already in the 50's, to the south and east still a little bit milder with very moist air. for your morning commute this is what we expect. temperatures only in the 40's. winds out of the northwest 15 to 20 miles an hour with this system and winds gusting to 25. now, those showers will be lingering into the day tomorrow. we'll talk about the best time to see the rain.

gusty winds will kick in and that will bring a weekend chill to remember. we're on that coming up later in the seven day. >> thank you very much. the chester county d.a. will seek the death penalty in the case of a mother and her boyfriend accused of murdering her little boy. 31-year-old jillian tait and her boyfriend 23 year old gary fellenbaum are accused of killing little scotty mcmillan inside of a trailer in west caln township. the other son who is six was badly beaten but survived. scotty had been punched in the face and the stomach but the d.a. says that was the start of the abuse. >> he was scourged with a homemade whip. he was lashed with a metal rod. he was tied to a chair and beaten. he was tied upside down by his feet and beaten. >> fellenbaum's wife, who also lived in this trailer with

their baby, is facing child endangerment charges tonight. she reportedly found that little boy's body and called 911 and police say that she could have intervened and stopped what happened. >> flames shoot from the ground after construction worker hits a gas line in olde city. there were evacuations and road closures as a result. two dozen residents were forced from their homes. the worker hit that line with a circular saw. pgw was quickly on the scene. nobody was hurt. a major local grocery chain will shut its doors for good. >> three on your side's jim donovan will tell us what's in store for the thousands of men and women who will be unemployed as a result. plus, a murder suspect carjacks a news truck and goes on a wild ride. we've got there story when "eyewitness news" continues on the cw

>> bad news today for families looking to save on their grocery bills. bottom dollar food is shutting down. >> the discount grocery aldi is buying 66 locations. here's jim donovan with what it means imtoday's announcement that bottom dollar food will be shutting down its 66 locations including the 46 stores in the philadelphia region had shoppers surprised. >> their prices are great. their produce is great.

and i do save money when i come here. >> just going in and out of stores, certain products you get really cheap here e. >> reporter: the first bottom dollar store opened up in 2010 in king of prussia. the chain offered up to 8500 items. less than the average 38,000 items carried by most supermarkets. but while the selection was smaller, the chain attracted shoppers by offering low prices. in three on your side's supermarket pricing surveys bottom dollar food routinely had the lowest prices in the region. the company anticipates that stores will remain opened until the end of the year when aldi takes over the leases. >> we have until the end of the year to get used to it but i wish they would stay open because i like the produce. >> reporter: bottom dollar employs 2200 people. the company says the employees will receive severance pay and career transition assistance. i always liked going in there. they didn't have like 25 types

of ketchup but prices were always the lowest when we did comparison shopping. >> you hate it for the workers and the consumers. congressional leaders from both sides the aisle head to the white house tomorrow where they'll begin talks about next year's agenda following the midterm elections republican control both houses of congress. today the speaker, john boehner and the soon to be majority leader mitch mcconnell outlined some of their goals if the wall street journal. two big points the approval of the 2000-mile keystone excel pipeline the repeal of obamacare. both sides were talking today. >> mcconnell didn't suggest he's going to fold on those principles. the president is not going do that either. >> the president continues to act on his only he is going to poison the well. when you play with matches, you take the risk of burning yourself. >> we will see what happens. certainly both sides, the white house and the congress, need to work together to address big issues that are facing the can country.

>> the dangers of the job on display in australia when a news photographer comes face to face with a man wanted for attempted murder. that photographer ended up losing his car to the suspect but it was all caught on camera. cbs news correspondent chris van cleaver has more. >> reporter: with his hands covered in blood this man suspected of attacking a woman in australia approved a news cameraman. it appeared he was going to surrender. photographer peter steer called police twice. but in the 30 minutes it took them to respond the suspect added to his crime spree pulling a gun and carjacking steers' news car. pulling a gun and carjacking first to go quietly but i suppose something clicked in his mind and said no i'll do >> reporter: police picked up the cameraman and chased after the stolen vehicle. a camera mounted in the news car captured the crash that ended this chase. the suv slammed into a gas

tank as police moved in on the suspect. >> i don't think he had a weapon at the time but he moved pretty much straight onto the gas pedals and anything could have happened. you can you could hear gas leaking. he walked up to me purchase fully looked me in the eyes and asked me for a cigarette lighter. >> reporter: officers took the suspect into custody and steer got a story unlike anything he had covered in his 34 years on the job. >> for a cameraman i guess it's the sort of stuff that you sort of dream about i guess. you know, so, you know, i'm fine, i'm fine. i just need a big drink. >> reporter: and that armed man might have been better off just surrendering to the news. he's now facing a host of charges including attempted murder and armed robbery. in new york, chris van cleve for "eyewitness news" on the cw philly. >> areas of drizzle and fog plague a good part of the delaware valley during this evening and our eyewitness weather watchers are reporting in mainly the same conditions. right now it is 49 degrees in

places like cape may. so, some light rain moving your way. a big break in the action from the philadelphia area into the west but a few more showers are possible during the day tomorrow. temperatures really a big line in between temperatures in the 40's and the 50's along the i-95 corridor and the south and east. that cool air, though, will be invading and you can see what's coming. to the west 40's in cleveland and the midwest but chicago westward temperatures in the 30's and we will be seeing that moving our way. the cold air is on the backside of this area of low pressure. tonight it guns to pull away but we have a lot of rotation on the backside of this. it will produce some lake effect snow through the great lakes in new york and also even ohio and pennsylvania but for us it just means a few more clouds tomorrow afternoon and a few showers, lake enhanced showers for the afternoon. conditions will be improving on saturday with plenty of sunshine and then we'll be seeing must schooler air moving in as well. very active jet stream as it

takes another dip over the weekend but a lamper dip will be coming next week by about thursday, little piece of that polar vortex could be invading the continental u.s. overnight the rain will end, skies will clear, the low 44. highs tomorrow some 10 degrees warmer at 54 and as we look ahead on the exclusive eyewitness weather seven-day forecast, here you go, a cool weekend. it will be breezy and then next week a slow warmup before we're in the 40's by thursday. that's a look at your seven-day. we'll be back with beasley and sports right after this.

complex getting new reps with their new starting quarterback. a lot of talk about his past in new york and how he will fit in philadelphia's offense. >> sometimes, you know, a new -- a change is what people need and i think that it has done mark pretty good and i think one thing he has going for himself he's won a lot of football games. i think we're very can confident in him going forward. >> we don't look at mark as just a backup. mark has experience in this league, he's won tons of games, you know, playoffs and regular season games, so we see him in the the preseason games, he played well. he's always made plays. >> also today the head coach chip kelly was asked about nick foles and what he -- what role he'll play from the sidelines. >> one thing about nick i think i've always admired sarah palin what his mind-set is like. i think he's talking about what his rehabilitation schedule is going to be and what he has to do to put himself in the situation and how he can be a good teammate
