>> gunfire overnight in south philadelphia leaves a man injured. not the only shooting police are investigating in that area. just yesterday, a child was hit. we're live with the latest on the search for the shooters. >> good morning, it is tuesday, december 23rd, i'm erika von tiehl. >> i'm diana rocco. ukee washington is off today. let's get things start wad check of traffic and weather together. katie and jessica keeping an eye on things for us, good morning, ladies? hey, good morning, katie, i always wear my uggs whenever dow my traffic reports. i didn't need them today. not that cold. >> nice mild start to the day, at least for late december standards. we can expect to see the temperatures stay well above average today, tomorrow, christmas, as well as that

point. if you have been dreaming after white christmas, cannot deliver. at least brightening up in time for the holiday itself here, but storm scan, as we take the tri-state sweep, certainly showing signs of life. you have some showers, coming through scat nerd nature. see how they sort of bubble up over the last few hours, casino of what you will find here. may be little break along the way, then fresh round picks up regardless whether it is actually raining or not, though. this play be the casino of sky you see here today. very dreary, gray sky for us. but, here is your trade off. look at that temperature reading. 50 degrees currently at middle township high school n philadelphia, we normally don't even break out of the lower mid 40's at this point of the year for daytime highs. so, the fact that we're already at 48 degrees, that's a good sign. it will keep things above average here, and we don't have to worry about any icing or any casino of snow potential out of the next storm that's coming along, which is going to drag its warmfront through as we go through today and specially tomorrow. so, that said, you want to keep some wet weather gear at the ready, you will be needing it here, especially, tomorrow.

jess, over to you. >> a ponytail, i won't even bother with it. going outside on the schuylkill expressway starting to see backups on montgomery eastbound lanes headed toward center city area. westbound moving just fine. over on the blue route, looking at northbound delay around the baltimore pike. everything moving along just okay. if you are headed southbound, now, there is utility pole that actually caught on fire, so there is fire police activity on the scene out in pottstown, 724 closed, everyone hundred, alternate to get around therefore the time being, is just to take route 422 couple dents, so urge ooh guys to use some caution when hank g out the door. give yourself extra time, north 42, and turnpike eastbound, just around delaware valley. another accident over on the boulevard, southbound, at harbison avenue, taking out the outer drive. erika, back over to you. >> thank you, jess. >> new this morning, police are investigating two shootings in two days just within a mile of each other.

the latest happened overnight in the south philadelphia. investigators tell us 33 year old man walking home from store at moore streets when shot in the back. the victim is now in the hospital in stable condition. >> the victim has no idea why he was shot, he and his cousin coming home have the store, heard the gunshot, felt he was shot. he was not robbed, he does not know why he was shot. >> officers found eight shell casings at the corner of 25th and moore. police are reviewing security cameras in the area to help in the search for suspects. the second shooting happened yesterday in nearby grays ferry, in broad daylight. >> two people were shot and one of the victims, heart breaking, just toddler shot in his home. >> "eyewitness news" reporter jan carabeo joins us at children's hospital where the little boy is recovering. jan? >> reporter: erika, diane, a we are really lucky we're not talking about a three year old boy who was shot and killed if grays ferry yesterday.

he is here at chop in stable condition. and he is expected to make a full recovery. meantime investigators continue to look into the shooting and continue to search for the suspects. a mid sparkling lights and christmas tree, yellow police tape outline this grays ferry neighborhood on monday after a three year old was shot and rushed to the hospital. an act never acceptable, but specially shocking, councilman johnson says around the holidays. >> this makes no sense. this is the holiday season. we definitely shouldn't have a family going to the hospital with the three year old shot in the leg. >> shooting unfolded 1300 block of south newkirk street in broad daylight. police say an unknown suspect approached a man here on his porch. the two got into argument, and at some point the gunman opened fire, striking the man in his leg. now police say there is may have been a case every mistaken identity, because of what happened next. >> 1335, and he opens the door and fires right now, looks

county. hundreds gathered at souderton area high school to remember ninth grader nina flick and pray for her brother, anthony's recovery. police say bradley stone murdered nina and her five relatives on december 15th. seventeen year old anthony, survived the attack. >> i can even begin to imagine what it must be like, but i know he is strong, and i know he will pull through this. >> all here for each other. and that we're going to stay strong. >> go fun me campaign raised more than $25,000 toward anthony's medical costs and other needs. >> new york city mayor has called for a temporary halt in demonstrations against police, until after two officers killed in a ambush are laid to rest. >> don champion live in new york this morning, where more protests over perceived boys bra it will at this expected to continue today. good morning, dawn.

>> calm came as he and the police commissioner, the grieving families. two officers who were killed. meantime investigators now have new clues, on what the gunman was doing, before saturday's deadly encounter. >> this is difficult time for both of our families. >> as the families of wenjian liu and rafael ramos prepare to lay their loved ones to rest, new york city mayor bill de blasio called for moment of reflection. >> until these funerals are passed let's focus just on the families and when they've lost. >> but, protesters, like this group, that staged a sit-in at grand central terminal monday, void to keep up the fight. >> if anything, this is a time of protest even more. >> they don't want isringhausen may i'll brinsley's act to detract. >> it is just sort of seems like it is planned, you know, to try to attach this one guy with the hundreds of thousands of protesters who have been

protesting against police brutal any general. >> along with posting threat against police, investigators say brinsley watched and recorded a protest in the city earlier this month, but did not participate. his sister maintains, he was not targeting police. >> he was emotionally trouble t hadding to do with police re al tal agents. >> released last known video, caring small white bag, possibly with the gun he used to kill the officers inside. they're now trying to piece together where he was in the hours before the shooting. >> now, the mayor does say he plans on attending the funerals of both officers who were killed, officer ramos' funeral is scheduled for this weekend, and we're told officer wenjian liu will be laid to rest once his family arrives in new york from china. >> don, what can you tell us about the long simmering tensions between the mayor and the police union? >> yes, there is definitely a lot of tension between the

police union and the mayor even before saturday's tragedy, in the weeks before when we saw all of those huge protest he is here in new york sit and around the area, we did hear from several union members, complaining, and criticizing the mayor, saying he was not showing enough support for offers earls. then saturday after the death of the two officers we literally saw several union members turn their backs on the mayor, as he was leaving the hospital. so there is definitely been a loft bad blood by yesterday we did see the new york governor and due cuomo come out urging calm on both sides, saying that now is not the time to rhetoric, instead, insisting it is time for rational conversation. >> don champion for just new york, thank you. right now, it is 7:09. north korea is back on line this morning, after the country experienced a widespread internet outage for more than nine and a half hours. >> officials declined to say if the united states was responsible for the temporary service disruption. the black out followed uv have i to respond to the rippling

this storm is huge. i mean, look at this it, extends all the way from the eastern seaboard, back to the rockies. you're talking what, two dozen states involved in this. so, especially if you plan to fly over the next two days, you could be dealing with some different variety of travel trouble out there. but, as far as we're concerned, if you are keeping it to the delaware valley, just rain, folks. little winds, that starts to kick in, right now the immediate concern, some of the low-lying cloud cover, poor visibility there is camera view, and you could be finding this as you're taking, you know, your travels out and about the region as whole here this morning. temperatures are at 45 degrees here outside whitfield elementary school. so not bad. combine it with very light winds and the visibilities have been less than idea, not horrible in most responsibility mount pocono the one spot where it has been pretty bad. actually down to below half mile visibility earlier this morning, but it is starting to get at least little bit better. a lot of the kids are still in school here today. so we gave you today, not the best grade, either, cloudy with some showers, c-plus, it is exactly the grade that

comador barry bridge. accidents and incidents starting to pop up, as well. we have ooh fill at this pole caught on fire out in pottstown, route 724 closed because that far at route 100, your alternate to get around therefore the time being is to take 422. and again, a lot of accident, one out in new jersey route 42 northbound lower landing road over into the right hand shoulder, roosevelt boulevard southbound harbison avenue taking out the outer drive. erika, back over to you. >> jessica, thank you. divers have come up empty in their ongoing search for shane montgomery. yesterday dive teams searched the water around manayunk, after finding montgomery's keys along the river bank over the weekends. montgomery disappeared early thanksgiving morning, after a night out with friends. >> former head master of school in delaware faces to up 50 years in prison this morning for child pornography. christopher wheeler was found guilty at all 25 towns. he was the head master at tower hills school in wilmington, before police fawn more than 2,000 child pornography pictures on his

computer. a judge will sentence wheeler in march. a delaware day care worker is facing charges this morning, police say, tonya robinson left two children and in a suv while she went shopping friday in newark. while she was shopping, a tow truck driver repossessed the suv, with the kids inside. the tow truck driver discovered the children ages one and five when he got back to the tow yard. he says the suv was full of stuff, so he couldn't see the children inside when he towed it. robinson is free on bail. former sport cast or don tollefson is looking for a lawyer to represent him against fraud charges. he is charged with cheating people out of more than $300,000 by failing to deliver on sports charity packages. last week, tollefson was withdrew his guilty plea saying he has new information that proves his innocence. now, he needs a lawyer to take his case, pro bono, since his request for public defender has been denied. >> i believe that i'm innocent, i believe as i said in open court there is should

have remained in civil court, because i believe i did not have any criminal intent. >> tollefson is living under house arrest in north philadelphia. he plans to make restitution by selling sports and civil rights memorabilia. his trial is set to begin on january 5th. a grandfather is getting a gift from santa that he will not likely forget. >> this is a great story. coming up next, he is getting a day off from his work and wait until you hear how he has his grandson to thank for that. >> i knew i should have sent a letter to santa this year. but first, here is a look at what's coming up tonight on the on the "cw philly".

slip by without requesting one more thing. he finished a letter off by saying ps, if you have time, and think i earned it, i would also love a xbox 360. thanks, santa. saw the note. >> had to do something. john matters, and in response, he drafted this memo which said, quote, santa was concerned that you were planning to work on christmas day. your grandchildren are quite upset about this. i think it would be best if you planned to take the day off and spend it with your family. work can wait until after christmas. >> this is the first time i've been -- had a direct intervention from santa claus himself. >> hotel manager even tried to help julian out by asking him do you know that julian wanted xbox # 06. santa is not sure he is ready for such a fancy toy. >> he deserves it, though.

>> diana rocco, 7:26, let's get right to katie for a look at the wet weather today. >> diana exactly right. we had wet weather today. also have it tomorrow. but tomorrow ends up being the wettest day we do have activity here on storm scan, you can tell it is pretty scat nerds nature right now, so damn, dreary look at the temperatures, you're in at 40 degrees, but just like they do on the camera lens, those raindrops will limit your visibility, on your winds she will, too. so watch for. that will meanwhile, as the day progresses, we expect the temperatures to stay somewhat steady, low 50's at best, but that's well above average

one of the victims just three year old boy, police still searching for the gunman this morning, "eyewitness news" reporter jan carabeo picks up this story, live at the children's hospital, where that little boy is recovering

this morning, good morning, jan. >> three year old toddler shot and wounds in the grays ferry to stable condition at last check. expected to make a foul recovery, and in the meantime, investigators are still looking into the shooting, and they're still on the hunt for the shooting suspect this morning. take a look at the video, you can see the scene as it unfolded, monday morning, when all of this happened, this happened just before noon, on the 1300 block of south newkirk street, in the city's grays ferry section, police say a gunman approached a man who was sitting on his porch, the two then got into some sort of argument, and then at some point the unknown gunman opened fire striking the man once in the leg shah shooting may have been a case every mistaken identity, because police say the shooter then went next-door, and opened fire nash that home, and that's when the three year old was shot in the leg. we're told the child's father may have been the intended target and he refused to speak to reporters yesterday outside of his home. meanwhile, "eyewitness news" did speak with the adult victims' mother-in-law who is

day. >> absolutely warmer than average anyway. isn't it funny how this time of year you are looking ahead to temperatures into the 50's, and, you know it, comes up on july, and you're like ooh degrees, freezing outside. talk about what perception can do. yes, today will absolutely and milder than average day. already above where our normal daytime high should be at this point of the morning. and we will continue that trend here at least for few additional degrees on the thermometer. now storm scan obviously not devoid of activity. we've got wet weather out there. and the moisture continues to just basically pile up for us here as our latest warmfront begins to advance. so, what it will do is keep some fog in place for some of you, we've seen that already this morning, 48 degrees, at the airport, 54 in wildwood. down toward the shore point, where you will end up with the mildest air today from the moderating influence off the open waters, so easily expect mid to up ear's in a couple of choice spots here down the shore today. but everybody is stuck with just sort of damp, dreary day. i would suck some rain gear, even though it is not a soaking rain. it will come through at any

starting to slam up heavily 95 southbound from woodhaven into the vine street expressway. that will take but 27 minutes. twenty-two minutes on the schuylkill expressway, eastbound, from the blue route, into the vine street expressway. currently no problems for septa, new jersey transit and dart as they're all running on time with no reported delays. err dismay. >> how low can gas prices go? in ocean county new jersey we found prices falling below $2 a gallon. how about that? nice little gift in time for the holidays. we haven't seen price this is low just to give you perspective in five years. so, here's where you spec to fill up this morning, what it will cost you, south jersey has the cheapest prices in our area, about 2.36 a gallon. delaware drivers are paying on average, 2.53. and, about 15 sent more expensive in pennsylvania, 2.68. >> 7:35, time for check on business. >> jill wagner joins us from the new york torque stock exchange, investors still in buying mood watch do you think they're buying today?

>> invest are watching slew of economic data. there is new numbers the gdp, also home sales, and spending. now, the s&p and the dow opened today at record highs, facebook stock is also at new hi, it soared yesterday after citigroup said that the photo sharing service is worth, excuse me, instagram, now worth $35 billion, facebook bought instagram, for just billion dollars. back in 2012. that's certainly a good investment there. >> hard to believe voice mail becoming a thing of the past, one big company is letting employees opt out, tell us about that. >> coca-cola disconnecting. now the company's the largest yet, to give employees the option of turning off their voice mail. no surprise. almost everybody accepted for about 6% of the work force took them up on the offer. coca-cola tells cbs money watch this move will change
