when those two cruisers slammed into each or. one officer suffered a concussion, all three are expected to recover. and new this morning a man is pistol whipped and shot during a robbery in fernrock. the 44 year-old victim was held up by three men in the courtyard of the regency apartments at olney and ogontz just after 1:00 a.m. they took a hundred dollars in cash from him and then shot him once in the abdomen a. we are told that victim is in stable condition. police are reviewing surveillance camera in hopes of getting a better look at the that suspect. our breaking news this morning comes from berkley, missouri where police say an officer shot and killed a man who pointed a gun at him at a gas station. now demonstrators have gathered there, there was some vandalism and looting. berkley is 2 miles from ferguson where august shooting of the black teen by a white the police officer triggered nationwide protest. we are expect to go hear from berkley authorities in the next few minutes as they have released surveillance video of the circumstances surrounding

this is a family that right any regardless of the decisions with this individual made are without a family member at this christmas season. this is also a tragedy for the police officer, you know, you will carry the weight of this for the rest of his life, certainly the rest of his career. there are in winners here. there are nothing but losers. and i think this is really underscores the task that our police officers a across the nation to have deal with day in and day out as they answer those calls for our community at 11:15 yesterday evening a berkley officer, who is a a six-year veteran of the berkley police department, in a mark car and full uniform responded for a call for a larceny, a stealing, in the 6800 block offhandly road in the city of berkley. the officer encountered two individuals at the time on the south side of the mobil run in the 6800 block. one of those individuals, is,

we're going to determine later was armed with a pistol but at the time the officer didn't know that. he had a flashlight in his left hand. he called one of the individuals over, who toward the grill of the officer police car. the other individual came over toward the driver side of the police car. the officer was talking to both of them. the individual that will have the firearm, he backed away, and to the east, just for a few steps, and turned bark around and officer started engaging him in conversation again and then the individual produced a pistol, and with his arms straight out, pointed at the officer from across the hood of the police car. at that point the the officer, produced his service weapon and fired what we think at this point is three shots. he did this, if you watched video and you will get a chance to see this. the officer when encountered with the pistol he begins to

very, very quickly wrappedly move backwards. he loses his balance and falls backwards, throws his flashlight, loses that and then does get three round off. we feel like and i don't know everything yet, you need to understand that, medical examiner is still conducting their investigation but we feel like one shot struck the suspect, one suspect struck the tire of the police car and we cannot account for the third round. it appears that the three round were fired from the officer's weapon, but it could turnout to be more than three shots that were shot but that is what we think at the time. we do not believe that there was any shots fired from the suspect . the suspect was armed with a 9-millimeter high point, with a defaced serial number, five round in the chamber and one round in the magazine. the officer retreated to the west, behind some gas pull president. he waited for an assist car to arrive before he approached

the suspect again. berkley e ms respondedded to the scene, and they were able to examine the suspect, and the 18 year-old male was in fact pronounced by the e ms crew there. chief mccall i'm being apprised of the situation made a notification to st. louis county communications, crimes begins persons to investigate this. they got the call at about 11:45 last night. they arrived about approximately 12:15 in the morning and they began to conduct their investigation. we were able to partition this young man's body off so nobody would see it while we were working the the scene and we were able to transport him 1:30, 1:40 hours this morning. it should be noted we did seized video from the mobile on the run station.

drugs. now an "eyewitness news" iteam investigation, an exclusive into the killing spree investigative reporter charlotte huffman has been digging through court record and she reveals lack of oversight by the the county may have stopped last weeks killing. >> reporter: years before bradley stone went on a shooting rampage killing his ex-wife and five of her family members, he legally purchased two hand guns like these. a 9-millimeter and 40 caliber, one used in last weeks killing spree. >> but stone should not have had any guns in his possession according to court records he was on probation following a dui last year. as part of his court ordered probation he signed this agreement saying he will not own, use or possess, anytime of look alike firearm, lethal weapon, explosives or ammunition. the the question become why wasn't stone stripped of his guns and as required by his probation, county law enforcement could have check to see if any handguns were
