>> ♪ >> from the cbs broadcast center in philadelphia, this is cbs3 "eyewitness news". >> now at 10 o'clock a chase and a deadly crash in delaware county. tonight there's new information about the collision that followed an attempted traffic stop. good evening i'm chris may. jessica is off tonight. police say the driver who took you have ended up losing his life in that crash and left another person in critical condition. todd quinones is live in glenolden with this developing story now. todd. >> reporter: chris, police say this driver had a callus disregard for everyone else as he sped down this section of chester pike at a high rate of speed. police scanner traffic indicates the suspect fled when an officer tried to pull him over. the devastating head-on collision that occurred later could be heard throughout the neighborhood. >> horrific scene. >> reporter: this picture taken moments after the crash showed smoke coming out of the white nissan altima police were chasing. that driver was pronounced dead at the scene. officials had had to cut away a mangled car. barbara davis said her daughter saw the crash. >> she saw the police officer get out of his car and like point the gun to the white car to tell the person there to stop and freeze or whatever but i guess he realized he was already deceased and he put the gun down. >> reporter: the driver in altima was heading southbound on chester pike at a high rate of speed after folcroft police tried to pull him over for a motor vehicle violation around 4:00 monday afternoon.

folcroft police say the officer pulled back from the chase when the driver sped up. moments later he collided head on with the driver of a red pontiac grand am. the crash happened right in front of the glenolden fire company. >> i heard the whistles going off. i was in my office upstairs and heard a large bang and came down immediately and just saw the scene at the corner there, cars everywhere, police came out with guns drawn. >> reporter: folcroft police attempted to pull the driver over near folcroft avenue in chester pike. the crash occurred less than a mile away in glenolden. and the driver that of other car is in critical condition tonight. right now none of the names of those involved have been released but police here are also investigating to see if that white altima was stolen or if it had stolen items inside. reporting live tonight in glenolden, todd quinones for "eyewitness news" at 10:00 on the cw philly. >> todd thank you. a terrible scene there. now to philadelphia's kensington neighborhood. an eight-year-old boy was shot in the shoulder there today. chopper three over the 2600 block of pale thorpe street. the boy's condition is listed as state. he's at saint christopher's hospital right now. he was taken there by a person who was at the soon. -- at the scene. police are investigate wag led to that violence. we turn to the weather and the return of the cold. "eyewitness news" on independence mall where folks were out and about today but dressed anticipating a return of winter. >> uh-huh. >> kathy orr is here now with that return which is imminent kathy. >> it certainly is, chris. temperatures are falling

pretty quickly around here. on storm scan3 we're in and out of the clouds. this precipitation is not quite making it to the ground. we have a frontal boundary that's stalled that's going to keep a few clouds around during the overnight hours but then skies brighten tomorrow. temperatures mainly in the 30's. we do have 40 degrees in dover. look at the poconos 24 degrees. it is 28 in allentown where we see the clear skies. future weather shows the clouds tonight the clouds early tomorrow morning but then they move on out and then we're clear. we are clear right through new year's eve and new year's day. then means some cold temperatures as we look ahead as well. so we will be seeing more sunshine. that is the good news. also some colder air with below average temperatures coming up we'll talk about the next chance of rain not snow in the seven day. chris. >> all right, kathy, thank you. we'll see you then. well tonight the family of a 10-year-old boy who was hit and killed by a police cruiser continues to struggle to understand what happened. "eyewitness news" reporter david spunt is live in franklin township, new jersey, and david, you talked to a friend of the victim tonight. >> reporter: chris i its another emotional night for folks here in franklin township. 10-year-old matthew mccloskey hit and killed not far from where i'm standing. several memorials behind me for people to try to remember and reflect and think good thoughts about the little boy many say left us too soon. aftermath that was mccloskey was hit and killed friends and family members met at two memorials across delsea drive to grieve. >> he was a very polite boy very good loving boy. he was my grandson's best

friend. >> reporter: diane hires two grandsons were with mccloskey when one of their own hit and killed 10-year-old. police say the officer was answering a 911 call. >> best kid in the world. just wonder why things like this happen. he was a baby, 10 years old. >> reporter: one of diane's grandsons brendan was with her at the memorial. he said he was his best friends and he's devastate bowed what happened. he was too upset to finish the interview. police spent hours on scene trying to piece together evidence. authorities are investigating how the officer didn't see the 10-year-old crossing the street specifically if the officer was using his lights and siren. >> we'll release more details as we receive them and we would like to offer our deepest condolences to the family that of child. >> reporter: officials say the school will be opened at 9 o'clock on wednesday for grief counseling. until then friends and family are helping each other cope with the devastating loss. >> his mom, my heart breaks. his sister's, his brother the grandmom, the whole family. >> reporter: the county prosecutor says it's just too earl to decide if there will be any charges. meanwhile, friends and family of matthew mccloskey they have set up a you caring page online to help fund some of the funeral expenses. reporting live tonight from franklin township, new jersey, david spunt, "eyewitness news" at 10:00 on the cw philly david a devastating loss for that family. well, now to an amazing scene in montgomery county. a truck carrying trash hit a barrier, went down an embankment flipped over then caught fire today.

it all happened in the middle of the evening rush on route 422 in lower pottsgrove. traffic had to be detoured while crews cleared that scene. in the end one person was taken to the hospital. that person's condition is not being released tonight. new at 10 o'clock tonight a serial robber has been targeting hotels in two counties at gun point. this man has struck seven times in west and southwest philadelphia and in tinicum township delaware county. surveillance cameras shows the man doesn't just rob the register. he also takes cash and valuables from workers and customers. he does cover his face but he has been spotted more than once wearing this bright yellow vest with the letters pwd. well today bishop david o'connell from the diocese of trenton underwent surgery on his left leg, a partial amputation to address serious infections brought about by diabetes. the diocese tells us tonight the surgery was successful and bishop o'connell is resting. he'll begin rehab after he is released from the hospital. well a-flight returns to philadelphia international airport for an emergency landing just moments after takeoff today. one of the passengers shared this video with "eyewitness news." it shows flames shooting from one of that plane's engines. this is a u.s. airways express flight. it was on its way to manchester boston regional airport in new hampshire. the pilot did turn around and landed safely here in philadelphia. tonight we are hearing from the man who took this cell phone video. >> there was like a large -- a loud bang, just bang and flames shot by my window and about five seconds later same

thing, boom, flames shot by my window and at this point like people on the plane thought that we were going to die. >> pretty remarkable. none of the 75 passengers on board was hurt. well, parents and teachers are left scrambling when a charter school in northern liberties announces they are not reopening following the holiday. walter d. palmer leadership partners charter school mailed out letters this weekend saying that the school would close because it can't afford to pay its bills. among those bills a $1.5 million judgment to the school district of philadelphia. the district blames the charter school for financial mismanagement and for maintaining poor academic standards. >> to have a charter school that is in financial chaos even after the millions and millions of dollars that have been provide. >> they really hit us at the core and they knew that because they want that money back. they want those kids back. they want that $17 million back. >> the district is setting up enrollment sessions to help parents find a new place for their kids. meantime the charter school says its teachers will be paid for their work. the search for the missing air asia flight 8501 is expanding after three days with no sign of a plane that had 162 lives on board. so far at least 30 ships, 15 aircraft and seven helicopters have been looking any other just in the water but also on land near the western part of borneo island. this plane disappeared from radar less than an hour into the flight from indonesia to singapore on sunday. the pilot did report bad weather but was denied permission to change altitude because there was too much traffic.

>> there can be a serious factor but it is never the single cause of what ultimately created the accident. accidents are always a chain of events. >> well, the u.s.s. samson is being deployed to aid search teams from indonesia singapore, malaysia, australia and thailand. well, there are new health concerns tonight here in the keystone state. up next here at 10 o'clock some new details about growing number of flu cases in pennsylvania. also, are you sick of paying for smartphone apps? well, we'll show you some companies who are willing to put apps in your pocket that can make you money. kathy. >> cold and getting colder. we are seeing some of the coldest air of the season moving toward the delaware valley. i'll show you what the numbers read as we ring in the new year as "eyewitness >> ♪ >> on the health watch tonight, cases of the flu are on the rise in pennsylvania. the state department of health says at least 11 people have died from the flu in pa so far this year. now, the number of flu illnesses spiked to more than 2500 last week. that is more than double the week before. and five times the number we recorded in the first week of december. montgomery county has the second most cases in the commonwealth while philadelphia has the fewest. also on the health watch tonight the way that we react

to those constant social media updates could be harmful. tech experts say that many of us hold our breath when we check e-mail, tweet and post on facebook. that combined with poor posture could lead to what many call e-mail apnea. what's going on physiologically does cause a stress response reaction. >> there could be consequences, subtle consequences with respect to blood pressure, cardiovascular disease and things that are associated with that. >> well, being aware of your breathing at all times certainly helps as does taking five minute breaks for every hour you're on the computer. however, there are those who say that there simply isn't enough science to prove that e-mail apnea actually exists. you are saving money on gas and you could be making money by downloading apps. cbs correspondent allison harmelin shows us what apps will put cash in your pockets. augusta mattias is snapping photos of this sunscreen display and sending them to a manufacturer. it's a one time job he got through an employment app. it sends users small jobs like this one. companies find out what their products looks like in the store end makes a few bucks with his wife when he's at the mall. >> while she's spending money i'm earning money. >> reporter: victoria jones uses her phone to make a couple bucks. her favorite app is called surveys on the go. >> you get paid to do different surveys. could be about radio entertainment, movies, products. i did a movie one where they ask you how many movies you've been to in the last year. >> reporter: there are dozens of pay apps available. users can make everything from

being a mystery shopper to watching certain videos. surveys on the go ceo chris saint al layer says more companies are willing to pay for this research. >> we average between one and two new down loads a day. >> reporter: jones and other users aren't getting rich with these apps i think i average five dollars a week. >> reporter: she says making that extra cash only takes a few minute of her time. allison harmelin for cbs news new york. >> many of these apps will pay you a little extra if you're willing to share your location. others will ask you specific questions when you're in certain restaurants or stores. time to check out the fork. kathy is here at the big board now. kathy, what's going on? >> we're talking about some colder temperatures moving our way but nothing like they are experiencing out west, chris. wait until you see some of these now. our weather watchers are saying, oh yeah, we're in the 30's butter it's been really nice the past several days and it's a pretty nice evening out there. john is reporting 35 degrees in philadelphia. if we go on the jersey side it is 33 degrees in vincentown. doug is saying no wind out there and the pressure is rising rising because high pressure is building in. a very cold area of high pressure. in pennsylvania some temperatures already down to the lower 30's. 30 degrees in norristown and not much wind out there at all. here's a look at some of our high temperatures today. in newark delaware 49. ocean city 48. clayton, delaware, 48 and wildwood 46. pretty nice. wish it could stay that way: if you would like to be an eyewitness weather watch go to cbsphilly.com/watchers to join. want to take you outside where

we're seeing some temperatures falling with a partly cloudy sky in philadelphia. down the shore a little bit on the cloudy sky but we'll see that sun return big time tomorrow. on storm scan3 we have a front to the south dying out moving southward. you can see some clearing skies to the north and west and that's where we have some of our colder temperatures. case in point in allentown a mainly clear sky 28. the poconos 24. some cold temperatures in the mountains. great snow making weather. when you're around 2degrees you can make that packed powder so it should be a really good end of the week and weekend coming up for skiers. philadelphia 37. millville 39. and in dover we have a mostly cloudy sky an temperature of 40. nothing like we're seeing out west. take a look at these numbers. these are temperatures right now. if you have any friends that are skiing out west, rapid city two bismarck four below cheyenne just 2 degrees so we're talking about very cold temperatures and as we look ahead these temperatures go below zero. rapid city tomorrow morning 10 blow, bismarck 13 blow, minneapolis six employee. you'll be hearing more about this on the national news. temperatures tomorrow afternoon only in the single numbers so it will get cold around here but nothing like that. during the day on tuesday highs mainly in the 30's. philadelphia will just make it to 40 degrees. we have a northerly wind associated with his high pressure system. the high brings sunshine but chilly temperatures new year's eve and new year's day we stay in the 30's. we see even more sunshine. so at least we'll start the new year off with more sunshine than we had in the month of december. overnight mostly cloudy 31 degrees. morning clouds giving way to

it is so good all the time. >> well, here's something you don't see every day. it comes from the nba d league. that's right, that is a bat flying around the fort wayne coliseum. the team's mascot is an ant and he started chasing the bat around. they thought they at one point got the bat with that net but it got loose again. eventually they gave up and had to start the game about five minutes late. i would think a bat would want to swoop down and eat an ander maybe among other things but if i'm that ander i'm looking for cover. >> yes, if i'm those people. >> we thank you for watching "eyewitness news" here on the cw philly,. for kathy beasley and all of us here, i'm chris may. have a good night. we'll see you at 11 o'clock over on cbs3. >> ♪
