killer eric frein. u.s. marshals took frein into custody yesterday evening near a vacant airplane hangar in monroe county. 45 miles southwest of blooming grove where frein is accused of killing one trooper and wounding another on september 12. chad perdelli has more live from the capture scene in monroe county. >> reporter: we're down the road from where frein was captured at 6:30. right now they are conducting a search warrant looking for more evidence against him. according to state police he was outside in a field from that hangar. he was unarmed, but had weapons nearby. he was tired and weary from a an unrelenting pursuit by law enforcement. state police say it was a quiet take down, but ended a 48 day had an hunt for fbi's most

wanted. >> the marshall's service had a team out at an abandoned airport. when they approached they saw an individual that they thought was eric frein and they ordered him to surrender and get down on his knees and raise his hands. once they approached him. he admitted his identity and taken into custody. >> he placed in bryon dickson state police cruiser and handcuffed with the murder trooper's cuffs. >> based on on the facts in evidence, we already have, mr. frein has been charged with murder in the first degree, homicide of a law enforcement officer, attempted murder in the first degree, possession of weapons of mass destruction, discharging a firearm into an occupied structure and reckless

endangerment. >> reporter: frein's capture ended weeks of tension and turmoil as authorities closed schools and canceled halloween and left this quiet poconos area on edge and frustrated. >> back to normal. i'm grateful for it, but it's nerve recording at work. >> i'm glad that they got him. and no other disprls were hurt in the interim. >> reporter: and frein's arrangement is scheduled for 9:00 a.m. today in pike county. the district attorney said he'll seek the death penalty. state police say the families of corporal dickson expressed relief. >> officials warned parents who live in the search area to not let their children go trick or

treating tonight, but now that frein has been caught, halloween for them is back on stay with us with "action news" and 6abc.com for the latest on the capture of eric frein. we'll have more on the long and exhaustive search to track him down coming up at 5:30. >> fire force 60 people from a west philadelphia apartment building overnight, one a firefighter. katherine scott is live at the scene on south 62nd street. good morning, katherine. >> reporter: good morning, tam, we do have updated numbers from the red cross. 69 people have checked into the red cross shelter. two people were injured in all of this, one residents and one firefighter both in stable condition. firefighters have wrapped up after a long night. they just opened the roads, police remain on the scene and the building is taped off. firefighters blasted water at this west philadelphia apartment

building overnight around 50 units evacuated at the chestnut park apartments on the 100 block of south 62nd street after a fire broke out just before 11:45 p.m. >> within three minutes companies were on location they immediately struck the second alarm. we encounter fire on the third floor, heavy fire. >> reporter: one man who was asleep in a third floor apartment said the fire alarm goes off so frequently, they didn't realize this was the real deal. >> we didn't pay no mind until it kept going off and going off and we heard people excavating the building. we went to the front door and smoke was everywhere. we had to go out the back wood down the fire escape. >> reporter: it took an hour and 20 minutes to place the fire under control. 60 people have been relocated by septa bus to a red cross

shelter. >> we have cots and blankets and pillows, we'll work with the salvation army to make sure these folks have hot meals in the morning. >> reporter: if you haven't checked in at the red cross shelter, red cross is urging residents to do so. the cause of the fire is under investigation. katherine scott channel 6 "action news." >> in other big news, the clock is ticking on a potential septa strike. union boss willie brown will make a decision whether the 4700 members of the transit worker union will walk off the job. talks broke off yesterday in center city. they will go again today. the union pledges to provide 24 hour notice before it goes on strike. >> philadelphia city council proved a bill that charges penalty for hate crimes against gays. the bill closes a gap left by

frontal boundary. and we have clouds coming up the coast along with a coastal low. increasing clouds in allentown, 57 degrees in the lehigh valley. after a start in the 30s. down the shore we're going for 59. clouds increasing at the shore, as well. chilly conditions once again today. in philadelphia, a high this afternoon of just 58. clouds on the march as we go through the day, wind will be light, 4 to 8 miles per hour. 41 degrees by 8:00. might be seeing a fair amount of sunshine there. 11:48 with the clouds marching in. 55 degrees by 2:00. of a by 5:00. high of 58 around 3:30 or 4:00. for trick or treating, most of us will not have any big problems other than the fact it will be cool. mostly cloudy, winds not all that strong. 56 degrees by 5:00 p.m., 50 degrees by 9:00 p.m.
