torturing and killing the girlfriend's 3 qulld son, behind bars gary fellenbaum and jillian tait. it happened inside of a trailer hom in west keilyn township. they explained that the beating began when little scott mcmillen wouldn't eat his breakfast. live at the scene of the crime is vernon odom. >> reporter: jim, an unspeakable tragedy has unfolded in this trailer, the d.a. here is in a rage. >> though the heavens may fall justice will be done to these defendants. >> the defendants are gary fellenbaum and his girlfriend jillian tait. they are charged with first degree murder. the d.a. says they tortured her 3-year-old son scotty mcmillan until he died. they used a whip and aluminum

siding. you can see holes in the wall where his head was repeatedly slammed. his brother ryan was abused the same way but managed to survive. all of this in the name of discipline. >> gary fellenbaum and jillian tait tied the to boys up over a door by their feet, and while they were doing that they laughed at these children. >> they shared this trailer with fellenbaum's wife, all three worked at a local wal-mart, there is no signs that any of these people were on drugs, fellenbaum's wife amber lived in the trailer is charged with endangering children by not calling police. the d.a. says that fellenbaum went car shopping and took a nap while the child lay dying after weeks of relentless torture.

>> they killed a child, we will seek the death penalty in this case. >> they only moved into this park last month, reaction from neighbors for the alligations. >> you don't do that to kids. you know. >> the prosecutor is going for the death penalty, do you buy that? >> yes, i buy that. yes. >> reporter: james we have covered some awful cases but this is one of the ugliest. the couple is due in court in a couple of days. live in chester county, vernon odom, channel 6 "action news." >> thank you vernon there is word tonight that 22-year-old carlesha freeland-gaither is huddled with her family at an undisclosed location. her alleged kidnapper, 37-year-old delvin barnes is in custody after his arrest last night in jessup, maryland.

david ryis live now where he learned more how the police cracked the case. >> reporter: we learn that carlesha is alive tonight in part because she kept her witts about her. that and a group effort that stretched from here to virginia and most important one man that got the ball rolling immediately. >> the gentlemen by the name of dwayne fletcher, he is the man seen on the abduction video after the car left and picks up the victim's phone and calls police. >> he witnessed it and watched and called the police twice, he called the police and waited for me. if it wasn't for him, we wouldn't have the same outcome i don't think. this man is a hero. >> if fletcher had not done what he did it could have been a missing persons case that wouldn't have been reported until todays later. the police say that carlesha

dropped the phone deliberately, so someone would find it. police thought that carlesha kicked out the rear windows of the car, but she found a hammer on the backseat and use that to break the windows and used it on the suspect. sources say she deliberately gave him the debit card and pin number hoping to leave a trail. detectives got two other big breaks and they recognize the men in the surveillance video, as delvin barnes, the man they were seekering for a similar crime. they saw a dealership name on the car and they contacted the dealership and had them activate a gps they installed in case he defaulted on a car loan. that is where they got the jump on barnes and got carlesha. detective sloan made good on the promise he made to his mother

victims that may have been abducted by delvin barnes. he has a history of a crime spree over three states and more than ten years. this comes on the heels of a strikingly similar abduction, of a 16-year-old virginia girl one month ago. his criminal history police fear has the making of a sexual deviant. spanning back as far as 2005, only "action news" was there when he was arrested in philadelphia in 2005, he was accused of having forceable sexual intercourse with his estranged wife who he allegedly beat and choked in their home. and simple assault after hitting her father with a bowl and punching her mother in the face. barnes served eight years and was just released one year ago. the pennsylvania patrol board denied his early release four

times because of his lack of remorse. and last month he is accused of abducting a 16-year-old virginia girl and he allegedly threw her in the back of his car and dug a grave and asked the victim how she wanted to die and she ran for her life covered in bleach and gas. >> she was completely flaked when she took off from the location. >> he was wanted on six warrants for capital attempted murder and abduction and the rape of the 16-year-old and then he abducted carlesha freeland-gaither. >> and he showed the 16-year-old the picture of another girl that he claimed to have abducted. anybody with information is asked to call the police here in philadelphia and that case is handed over the fbi. we are updating the developments of the abduction on air and online.
