big story on "action news" is delvin barnes's first court appearance in front of a federal judge in philadelphia. "action news" was inside of the courtroom and david henry has more on what happened today. >> reporter: it was a very brief hearing and the first step in what would be a long journey through the federal legal system for accused kidnapper, delvin barnes, he was led in shackled and wearing a green prison jump suit, to be arraigned for kidnapping. judge jacob hart told him that based on his income he was entitled to a court appointed attorney. barnes responded court pointed and that was it. barnes was returned to philadelphia yesterday and fbi agents picked him up from a prison in virginia and drove him here.

he is facing one count of kidnapping but there are likely to be other charges. he abducted carlesha freeland-gaither a week and a half ago and federal agents arrested him and rescued carlesha a week ago from a supermarket in virginia. barnes is facing rape and attempted murder charges in virginia for allegedly abducting a 16-year-old girl. she was able to escape while he was digging her grave. he will be tried thereafter the federal charges in philadelphia. his court appointed lawyer had a few words to say. >> it was continued to friday for detention hearing as well as a probable cause hearing. >> now the federal prosecutors had no comment after the hearing other than to say this is an ongoing investigation. and we expect more charges to be

filed against barnes but probably not before the next court appearance. live at the federal courthouse, channel 6 "action news." >> a mother and her young son were killed in a fire at the jersey shore and police say it was suspicious, the victims were trapped by flames in the rear of this home on washington avenue in egg harbor city, another man survived the flames and he said there was a break-in at the home at the time of the blaze and it started around 8:00 this morning. chad pradelli is working the story all day long and he'll have a live report at 6:00, the murder of a philadelphia father remains a history tonight, the shooting is gaining national attention because the victim's son played for the lakers. eva pilgram is live now with the details. >> reporter: a lot of questions still tonight as detectives continue the search for the person that shot and killed a basketball star's father in

german town. >> my next game my dad is not going to text me because someone decided to take his life. >> he remembers the last text, he said get this win tonight. >> ellington jr. came off the court to found out his father, his biggest fan had been killed. ellington sr. was found just after 58 on the 5200 block of marion street with a bullet to the head, he was rushed to einstein in critical condition and just before 11:00 he died. >> he was funny and smart and loved his family a lot. that is all his focus was on, his family. >> he was my breast friend, the person that gave me a basketball and put me in the league at 5 years old. ellington jr. was a standout ballplayer at episcopal academy

meteorologist, cecily tynan, already has the heavy coat it looks like. >> about an hour ago i really didn't need a jacket, it was mild but the mild stretch of weather is going to end, the party is over. taking a look at highs on monday, 63 degrees and yesterday 70 and today also 70 degrees, that is well above the average high of 58 degrees, that is 12 degrees above average. we woke up with the fog but satellite 6 along with action radar showing all of that fog cleared out by mid morning and now we have clear skies. if you look to western pennsylvania you see the veil of clouds, that is the leading edge of cold air moving in in the overnight hours, ahead of it it's still not all that cool, 61 in philadelphia and 65 in richmond, and pittsburgh it's 37 degrees, and there is much colder air out to the west. dallas currently 38 degrees, it's a lot colder in dallas than it is here.

photos and videos. an emergency situation in new york city today, two window washers were trapped high above the city and needed to be rescued. take a look at this dramatic video, the scaffold was dangling from one world trade center causing quite a commotion, the scaffolding went from horizontal to vertical. for some unknown reason there was too much slack and caused it to tilt. it was hanging from the 69th floor and 100 firefighters were called in to figure out the best way to get them out. they cut through thick layers of glass to pull them to safety. >> squads on the roof were able to lower a long length of rope, to secure them, and then they were able to lower a radio to
