the windows on cars in delaware. but the big story is police investigating the drowning of a 15-month-old boy in a backyard gold fish pond, it happened at sunshine day care on shar lane. sara bloomquist is live at the day care center tonight. who do investigators think happened here? >> this is where roxanne lacey lives and she was caring for six small children, yesterday that 15-month-old boy got into the backyard and fell into a fish pond, about a foot deep. police say he did drown and the death appears to be an accident but tonight an investigation is underway. neighbors tell us that roxanne lacey cared for children in her home called sunshine day care for years and they called her

thoughtful and attentive for the handful of kids with her each day. >> she was a mother hen and very protective and friendly. nice woman all around woman. >> police say that lacey had six children at her home here on tuesday, she was inside tending to one of them when at 10:58 a.m., she lost track of a 15-month-old boy and found the toddler in a small fish pond in the backyard unresponsive. >> i heard her screaming she was devastated and in total shock. >> paramedics were called and the child was unresponsive. the preliminary cause of death is drowning, nobody answered when we knocked on the door of the home. later family members arrived but declined to comment. now, millville police and the cumberland county prosecutors

office are investigating and the state's child welfare agency is looking into the death, those agencies are also trying to determine if lacey was properly licensed to be operating a day care at her own home. i'm sara bloomquist, channel 6 "action news." >> thank you sara. a chester woman is the first person sentenced under pennsylvania's new brad fox law, a judge ordered stacey dawson to spend 6 to 12 years in prison, prosecutors say she bought two guns for her boyfriend. the law was named for officer brad fox who was shot to death in the line of duty by a suspect who obtained his gun through an illegal straw purchase. 37-year-old delvin barnes has made his first court

appearance in philadelphia, the man who allegedly kidnapped carlesha freeland-gaither was arraigned in federal court but did not enter a plea. david henry is live now. >> reporter: the last time we saw delvin barnes he was cursing at reporters outside of a jail in virginia, today he appears in federal court and uttered just two words during a very short proceeding. >> delvin barnes walked quietly wearing shackles and a green prison jump suit. the judge told him he qualified for a court appointed lawyer and asked if he preferred that or his own. he replied court appointed. with that the arraignment was over. last week barnes was the target of a nationwide manhunt. he was seen abducting carlesha

freeland-gaither in this video. and hours later he used her debit card in maryland and police used a gps tracker to fine the car in virginia on wednesday, that is where they arrested him and rescued carlesha. before the abduction he was wanted for a crime in virginia involving a 16-year-old girl and he was able to escape while allegedly digging her grave. authorities there have agreed to try him after he faces the federal charges in philadelphia. he was picked up by fbi agents at a jail near richmond. tomorrow starts the long journey through the legal system. >> today the federal attorney was appointed to represent mr. barnes and continued for friday for a detention hearing as well as a probable cause hearing, we expect additional charges will be filed at some point.

the federal prosecutor said only this is an ongoing investigation. live in federal court, david henry, channel 6 "action news." >> thank you david. a house fire this morning claimed the lives of a woman and her young son in egg harbor city, and authorities say that the blaze has raised suspicions of foul play. chad pradelli is live on the 200 block of washington avenue, chad what is the latest there? >> jim, investigators wrapped up the crime scene here a half hour ago and one police vehicle sits outside of the home that caught fire where the mother and young son perished and neighbors are shocked and saddened by their deaths and there are many questions to be answered and one at the forefront is who intentionally at the time this fire? the sight was smoke and fire billowing from this home and after it cleared a mother and
