year-old man apparently an innocent bystander, is a septa bus driver. >> wednesday night and the big story on "action news" tonight is a double shooting on the streets of south philadelphia. "action news" reporter kenneth moton is live at the scene, kenneth, what do we know about this. >> reporter: well, jim that septa bus driver is fighting for his life tonight and he is in chris will california condition at thomas jefferson university hospital after the shooting on this street. right now, police are trying to find more than one gunman and a motive. >> in the middle of the south philadelphia neighborhood, nearly 30 shots were fired from this intersection by at least two gunman. >> this was senseless, all of these shell casings, i mean my mother lives on this block. >> she said eric, it sound like a war zone out here. >> reporter: philadelphia police say around 82:00 men were shot on the six hup block of winton street, a 35 year-old man, intended target was hit in the head and killed but it was a 56 user old off-duty septa bus driver whom investigators say was

truck in the chest by a stray bullet, an innocent bystander. >> he is an outstanding citizen, a pillar of the community, ever since i was a kid, he has always been a nice individual. >> reporter: neighbors told us that the 56 year-old victim was on the block checking on the vacant property of his elderly mother who suffers from dementia. at this point police don't know a motive for the shooting. >> witnesses observed the shooting, witnesses gave us a description of the shooter but we don't have any motive a this is time. >> reporter: we're not identifying this family friend of the septa bus driver but she told us he underwent surgery for his injuries. man has work for septa for decades. he is a deacon at church and last week he buried his girlfriend who suddenly passed away. >> he taste care of his family. >> his mother always calls his name, crack, crack. she know, make you forget everything. >> reporter: and as another live look at this active scene

here tonight, right now homicide detective are questioning several witnesses, we're told there is also a number of city and residential cameras in this area police are pulling surveillance video. right now the the names of the victims have not been officially released, jim. reporting live from south philadelphia tonight, kenneth moton for channel six "action news". >> thanks, kenneth. a tense situation ended peacefully in upper darby tonight. man held police at bay inside a house in the 700 block of east providence road. officials said that he fired at least eight shots at officers who surrounded the house. fortunately, nobody was hurt. police were able to enter the house and subdue the man. they came out tonight by the hundreds, to leave no doubt in anybody's mind. they do not want a new casino built at ninth and packer. they say too much crime, too much traffic. so will there be another casino in philadelphia and, if so, where. we should know by next week. investigators hope somebody recognizes them to help track down the mother. an autopsy on the infant was conducted today but the cause of death has yet to be released. in millville, new jersey it was a devastating accident that has police and state officials launching an investigation. a 15 month-old boy drowned in the backyard fish pond at sunshine day care. a woman by the name of roxanne laci was caring for six children when she apparently lost track of one of them. coatsville community came out tonight to pray for little scottie mcmilan, the three-year old boy allegedly tortured and beaten to death at the hand of his mother and her boyfriend. prosecutors charged gary fellenbaum and jillian tait with first degree murder today. they are pursuing the death penalty. man accusedded of kidnapping carlesha freeland gaither faced a a judge in philadelphia today but did not enter a plea. thirty-seven year-old delvin barnes uttered two word during his short arraignment in

no, of course not. it is heart breaking. >> reporter: judge turned to a new jersey legal precedent known as newber says divorced parents may be required to contribute to their children's education no matter of the child's age. judge ruled in caitlin's case her parent to have pay about $16,000 this year. >> the law in new jersey is so clear, it is cut and dry. law says parents are supposed to contribute to their children's educational expenses. >> reporter: laura and michael said they were willing to pay for their education in state in new jersey and if she followed the rules and lived at home. >> it is just unbelievable. i don't think there is any person, not one adult or parent that i have spoken to and told this to who can imagine that this can happen to them. >> reporter: caitlin whom they say won't reply to their message's replied to temple university out of state and only time that they say they have seen her in the last two years is in a courtroom. >> i spend a lot of time looking at her, looking over at her to get eye contact with
