you all, a wave of protests overnight following another grand jury's decision not to indict a police officer in a deadly confrontation. >> the choke hold led to eric garner's death back in july. >> sparking late night dm demonstrations in new york city. and a die in during rush hour. >> and one protester holding a sign saying, quote, afraid of those who swore to protect per. carolyn costello is live. >> reporter: good morning. this is where that deadly encounter took place. you can see a makeshift memorial set up out here. the deadly takedown maneuver was caught on tape. now people here and across the country outraged at a grand jury's decision that that officer did nothing wrong. in new york city, protesters blocked part of a major highway, facing off with police in protective gear. some marched through the streets

of midtown. others lay on the floor at grand central station. caught on tape, a white new york city police officer putting garner, an african-american, in an apparent choke hold as he y tried to take him into custody. the unarmed father of six who suffered from asthma, he was confronted for allegedly selling cigarettes. the medical examiner ruled his death a homicide caused by compression of his throat and chest. but the grand jury decided the officer did nothing illegal. >> don't you see? the video didn't mean anything. it didn't mean anything. >> reporter: less than two weeks after the decision in ferguson, protests erupting across the country. president obama addressing widespread anger for a second time. and attorney general eric holder announcing the case is not over yet. >> i'm here to announce that the

justice department will proceed with a civil rights investigation into mr. garner's death. >> reporter: the police officer said he feels bad about mr. garner. his condolences rejected by his widow. >> no, i don't accept his apology. he's feeding his kids and my husband is six feet under. >> reporter: the sign says no raucous, just justice. that's what the family is urging. calm, peaceful protests. meanwhile, the nypd officer has been suspended and remains suspended. he could face disciplinary action. live in staten island, back you. >> thank you so very much. well, like many others, the garner family members are just in shock. say they're hurt by the grand jury decision. they're vowing to keep for remy

husband was yelling to breathe. that would have been the time for him to show some type of remorse or care for another human being's life. when he was screaming 11 times that he can't breathe. somebody that gets paid to do right did wrong. and he's not held accountable for it. >> well, you see the emotion there from garner's widow. but there was emotion all over the country. as carolyn mentioned, spontaneous marches all over the country. >> demonstrators hit the streets of the nation's capital, stopping traffic in dupont circle. rallying not just against last night's decision in new york, but the one in the michael brown case in ferguson last week. >> and peacefully in atlanta, georgia. no justice, no peace. it got contentious when they laid on the street. no violence and no arrest.

the attack took place. the victim is from colorado, a mother of two and a special ed teacher. it's not clear if she was targeted because she was american. new sex assault from the pentagon this year. 5900 filed for fiscal year 2014. that's an 8% increase over the last year. but the reason for the higher numbers could be due to awareness campaigns and growing trust that the military can prosecute the cases appropriately. a u.s. sailor is under investigation for secretly video taping three female officer while they were showering. the alleged incidents took place aboard the uss wyoming in georgia. they began serving on subs in 2011. enlisted female sailors are not allowed submarine duty. and california rains bringing relief to the drought-stricken state. more than 9 inches fell in parts

decided not to indict the white officer in the choke hold death of an unarmed black man. >> protesters were chanting and demanding justice. many shocked that a video tape showing the confrontation wasn't enough evidence to warrant a trial. it's not over yet, though. the justice department now investigating to see if garner's civil rights were violated. >> gathering from coast to coast, shouting the names of eric garner, michael brown and other unarmed african-americans killed by police. officers kept a close eye, everything remained peaceful. >> a whole lot more as it develops, more on "good morning america." a school bus driver is being praised for leading 38 students to safety after the bus caught on fire. moments after they got on, the bus went up in flames. it could have been very different if the driver didn't act quickly. she gives credit to the kids.
