case, this is the surveillance video that led the d.a. to press charges of aggravated assault against the two officers "action news" reporter david henry is live at police headquarters ton. david what is the full story? >> reporter: this disturbing case comes in the midst of the national debate of policing activities in minority communities and it could have led to a miscarriage of justice if not for the video found by the victim's girlfriend. >> he never resisted or struck them or fought back, they just started hitting him. it is all on this video obtained exclusively by "action news." that is the police control car running down a motor scooter in north philadelphia what happened next left rivera looking like this. after he was knocked off the scooter, the two alleged

officers can be seen beating him up as rivera screams in agony pleading for help. >> another officer arrived at the scene thought that mr. rivera had been shot because there was so much blood. the two officers are arrested. mcknight and robinson. they charged rivera first with resisting arrest and assault and when the girlfriend found this video the d.a. dropped all charges against him and started to investigate the two cops, another black eye for a department that saw two cops slapped with charges in federal court yesterday. >> it brings issues across the country but sometimes in order to get healed you have endure

"action news" reporter, sara bloomquist is live at mitchell elementary school in southwest philadelphia. how does something like this happen? >> reporter: jim, police are trying to figure that out tonight the four boys a 13-year-old and three 8-year-olds remain at childrens hospital under observation. and we just learned that the 13-year-old boy accused of bringing that crack cocaine to school will likely be held at the hospital for observation overnight because he has marijuana in his system police want to know how the boy got the drugs and who should be held responsible. >> police were called to mitchell elementary school just before noon after school officials discovered students with packets of crack cocaine, police say that a 13-year-old boy brought the crack into the building this moning and in a boys restroom he passed off some

of the narcotics to an 8-year-old boy. >> he asked the 8-year-old to hold on to the items until after school and the 8-year-old refused initially and then the 13-year-old placed them in the book bag and said he would pay him 7 degrees to return them after school. and he brought them bang to the classroom and thoughed them to two 8-year-old boys, one took a sniff of the drugs and the other went to the school counselor to tell them what happened. they later discovered two more packets in a sink drain where they believe the 8-year-olds tried to get rid of them and parents were surprised by the details. >> nothing like this. nothing like this. i never heard of something like this, someone bringing drugs i heard it on the news before but to see it that close to home,
