with a vengeance. >> we got another day of snow rain ice for big portions of the country. you can see the radar here. storms stretching from the plains to new england. >> the newest system impacting 130 million americans, many bracing for more snow overnight. the winter weather that won't quit. snow falling overnight in boston again. beantown on the brink of breaking the all-time record of 107 inches. in the midwest snow and ice creating slick sidewalks and roads. this massive pileup in minnesota leaving one driver dead. and a scary scene in chicago. a driver losing control, fishtailing in and out of traffic nearly hitting two cars. >> it was pretty rough. that's why i had to stop. just rattled a little bit. >> reporter: and the main event yet to come. a final swath of snow and ice will create more treacherous conditions on the roads today. at least 30 states under winter weather alerts. the storm dumping snow ice and rain from utah to louisiana to

maine. some areas could see as much as a foot of snow by tomorrow. >> yeah accuweather's justin povick here with the timing and track of it all. good morning to you, justin. >> t.j. and reena, thanks and good morning. no break in sight for the northeast as another storm system pushes in. now, we will catch a brief break from the cold air, in fact a mild push of air working its way up the 95 corridor from our nation's capital to boston where temperatures will rebound into the 40s. at least above the freezing mark into central and north new england. colder air now catching up to the precipitation over indiana, ohio and west virginia. sleet will mix with and change to all snow and wednesday night into thursday we will have some travel delays and headaches from our nation's capital back into new york city where we could see three, four five potentially six inches of snow but a couple inches for boston upwards of a foot around charleston. back to you. >> justin thank you so much. we turn to the political storm swirling around hillary clinton. she spoke overnight at the gala

in washington. didn't mention the growing e-mail controversy, though. critics say she broke rues by using her personal e-mail account to conduct business while secretary of state using the government e-mail system would have put her messages under public and media scrutiny. however, clinton did hint at her political future last night. listen to this. >> along life's way you get a chance to make millions of decisions. some of them are big like do you run for office? [ cheers and applause ] >> applause and friendly audience but the e-mail issue is not going to go anywhere any time soon. it appears her aides main tine she did not break the law and released thousands of e-mails in december. a suspect is in custody after a series of shooting near washington, d.c. in one of the cases shots hit the windshield of this truck injuring two men inside just 12 miles away the national security

agency building was damaged by gunfire. it's not clear if the nsa was specifically targeted. it is an emotional day in boston. opening statements will begin in the trial of mar ton bombing suspect dzhokhar tsarnaev. a jury of 10 women and 8 men selected. the 21-year-old is facing 30 federal charges in connection with the 2013 attack which killed 3 people and wounded more than 260. more than half of those charges carry the possibility of death penalty. happening today a big test for obamacare facing a second main challenge before the supreme court. >> a ruling against the administration could mean the loss of health coverage for millions of americans. abc's bazi kanani is braving the wind and the rain this morning. she's joining us from just outside the supreme court. bazi. >> reporter: good morning, reena, good morning, t.j. this is the second time the supreme court is taking a look at obamacare. the justices first decided it was not unconstitutional and now three years later, another case that is just as critical.

a case that could unravel the entire 2,000-page affordable health care act on a techny kaltd. the supreme court hearing arguments this morning about these four words "established by the state." obamacare opponents say that means more than 7 million people are not eligible to get subsidies from the federal government to buy health insurance. >> the challengers are arguing that the language is crystal clear that subsidies are only available in states that have established their own exchanges. sort of end of story. >> reporter: and if those subsidies go away experts say the obamacare system will crumble. >> so only the sort of sickest people will participate in the exchanges, premium rates will go up for everyone and this death spiral will ensue. >> reporter: lawyers for the government will argue against a hyper literal interpretation of the law saying the intent is clearly to help people in all 50 states get affordable health care coverage. >> there's breast cancer in my family so for me it was very important to get the affordable

care so that i could go and get all of my preventive care. >> reporter: the fate of obamacare once again in the hands of nine justices republicans say either way, they will keep working to repeal the law. >> it's bad for patients bad for the providers, the nurses and doctors who cake care of them and terrible for taxpayers. >> reporter: the supreme court's decision is expected to come down in june. president obama would not comment this week on a backup plan to keep people insured if the justices strike down the subsidies. >> please go back inside. you look amazing outside live at the supreme court in the wind and the rain. >> yes. >> thanks bazi. a decorated army general and former cia director david petraeus will plead guilty to mishandling classified information. the charges stem in part from documents the former director allegedly provided to his mistress. he was forced to resign when the affair was revealed. he'll pay a $40,000 fine but will likely stay out of jail.

the justice department is releasing a blistering report today on the ferguson police department saying it routinely violated the constitutional rights of fringe americans after widespread protests triggered by the fatal shooting of michael brown. black residents made up of 93% of all arrests, 8 % of traffic stops and 88% of cases where police used force. they say racial bias was so ingrained in the department that officials even used government e-mail accounts to circulate racial jokes. well also new this morning, new information about the homeless man killed by police in los angeles. police say he's that man, 39-year-old charlie robinet a french official says he stole the identity of a french citizen and was living in the u.s. under an assumed name. and he was wanted for violating probation after being convicted of robbing a bank 15 years ago. lapd says officers opened fire after robinet tried to get one of the officer's guns. after a bitter political battle lawmakers have funded the department of homeland security

for the next year. the measure cleared the house yesterday. president obama says he'll sign it as soon as it reaches his desk. it's victory for the white house since conservatives failed to tack on restrictions. the president's authority to limit deportations. another twist this morning in the battle over gay marriage. the alabama supreme court has ordered probate judges across the state to stop issuing same-sex marriage licenses. this ruling comes just weeks after those same judges were told that they must issue those licenses. supreme court did not invalidate the marriages of hundreds of same-sex couples who wed in recent weeks. stay tuned. more to come. still ahead, oprah winfrey's big decision about her future. and federal agents swarming an unscale apartment. foreign women streaming into the u.s. so their babies can be americans. new overnight panicked passengers sliding down emergency chutes escaping this damaged plane. new details just in on exactly what went wrong.
