but yeah. i actually very much enjoy -- it's an extension of myself. it's watching her pleased and stuff from different angles. i feel awkward saying all of this. >> here's being high and being low and being in. good night. >> to the eye it looks like a typical, normal american neighborhood. >> reporter: we visited their home in the suburbs of cincinnati, ohio. one of the most conservative parts of the country. politically, a swing state, now a state that may come to be known for its swingers. >> you're such a girl sometimes. >> look what you're wearing. >> it doesn't matter what i wear, i always look good. >> reporter: although their relationship is open tony and diana say they follow strict guidelines to keep their marriage healthy. their number one rule? they only have sex with others together. >> same room. because, again, it's got to be about us. if we are separated it doesn't make sense to us.

>> reporter: other rules keep their lifestyle in check. >> if we didn't meet you in the lifestyle and we were friends before, we will not ever cross that boundary. >> i'm comfortable with tony individually texting another girl. you know, i guess i could look at his phone at any point in time if i wanted to. >> what are the downsides to being in the lifestyle? >> jealousy is always a big issue for some people. especially first getting involved in the lifestyle. it's a hurdle that you have to get used to. one of our hurdles is finding a couple we're both mutually attracted to. >> reporter: you might call them spokespeople for swingers. they're not shy when it comes to teaching others the ins and outs of swinging. >> you're coming friday? >> we'll be here. >> i'm pretty sure after you come friday that you'll be a little more motivated. >> reporter: they've agreed to allow cameras into their lives and are the new a&e reality show "neighbors with benefits." >> we're playing a version of truth or dare. give the person of your choice a

lap dance. >> we need some music. >> feel the rhythm. >> why a reality show? >> we've been open and out to our community, to our families, for five years. so our community and where we live already knew. >> reporter: challenging the institution of marriage, held sacred by millions has brought them many critics. one of them just next door. >> are you surprised at those different events late at night next door to you, going on in your neighborhood? >> initially -- shocked, you know. i'm like, i thought that that was really just a thing that people did in the '70s with the bowl and the keys and everything. >> reporter: tony and diana caution their lifestyle may not be for everyone. >> if monogamy works for you and you're happy that's great. for us this is what works and makes us happy. >> reporter: in a reality show tony and dianas' children's

faces were blurred. >> i go to work pick up the kids from school, do homework, cook dinner, no different than anybody else. except that i happen to be a swinger on the side. >> reporter: when we showed up the children were out of the home and at a friend's. >> do your children know about your lifestyle? >> i don't know many 10-year-olds that know anything about their parents' sex life. so i don't see how it would be appropriate for them to know at this point. >> it's something we're definitely going to have to address. we were already planning on being honest with them as they got older. and understanding our lifestyle. obviously we're out in the community, they're going to find out. >> we're happy. and we might have a different marriage than your typical marriage. but it's okay to be different as long as you're happy you're a good person you don't hurt anybody. >> reporter: tonight, tony and diana are spending a romantic night on the town with couples who are also in the swinging lifestyle. >> what's going on tonight? >> this is a typical night out for tony and i.

>> as a woman how do you say, i'm okay with my man talking to somebody else? i'm okay with my man having sex with another woman? >> honestly it's like i'm bragging. bragging, like yeah this is mine and i'm sharing him with you. but in the end, he's mine. i'm the one that gets to bring him home, i'm the one that gets to have the life with him. like, you're going to get a little taste. but he's mine. >> you don't get jealous anymore after 11 years? >> she's my wife, i love her very much, i'm protective of her. we did it together and that makes ups and downs easier for us. doing it as unit, not as a my fantasy, your fantasy. even if it was your fantasy, you know, i want to fulfill that for her. if that's a young 21-year-old guy, i think i have more moves than him still, i think i'm okay. >> reporter: these are swingers that mingle in the general public. tonight, tony and diana are heading to the town's local bar

we're going undercover tonight to investigate a dangerous problem that you might not even know about. many americans are unwittingly buying new cars that are subject to safety recalls which, by law, should have been fixed before they were sold. abc's geo benitez has given dealerships the road test for our series ""nightline" investigates." >> reporter: heading into this new jersey car dealership undercough tore buy a new truck.

>> one of the biggest dealers. >> reporter: but not just any truck. this one. which we know is under a safety recall for a potentially dangerous defect. just this last year there were nearly 64 million safety recalls, ranging from powers to power steel defects to air bags. by law the dealership is obligated to fix these potentially dangerous defects before a new car is sold. we want to see if this dealer will fix this truck before they sell it to us. >> pushing this button here tour it on. >> reporter: enter unassuming investigative producer jerry wagshaw. >> i look a little like johnny cash, the much shorter version. >> reporter: his clothing rigged with two undercover cameras. >> walking over there. >> reporter: with cameras rolling, jerry heads in to buy that 2014 silverado. >> jerry. >> how can i help you? >> i saw this. nice-looking truck on the

website. >> reporter: within minutes we are looking at that truck. >> look how big it is. >> reporter: the one we know has an open recall which could cause some cars to unexpectedly shift into neutral and lose power on the road potentially putting everyone on that road in danger. >> nice-looking wheels, i have to say. >> reporter: after hearing about all the upgrades, jerry gets down to business. >> is there any recalls or anything on this one? >> no, no. >> no? >> nope. just clean, perfect. all the recalls are done. >> reporter: did you hear that? no recalls on this one. legally, dealers don't need to disclose that the car has a recall. they just have to fix it before we leave the lot. jerry hints at the recall one more time. >> you had a problem with the ignition switch, right? it would turn off. anything like that on this car? >> nope. no recalls on this truck at this moment. >> because they're new? >> yeah. >> reporter: with that we head back to price out our new truck.

>> about $650 a month. >> i'm going to go home discuss it with my partner, and see what she says. >> reporter: just like you, with a handshake -- >> thank you very much. >> reporter: we leave the dealership. >> have a great day. >> reporter: four days later, we're back to complete the purchase. >> tell me when you want the money. >> yeah, i can take it now. >> reporter: jerry counts out the cash for the deposit. >> $400, $500 -- >> reporter: within minutes jerry is the proud new owner of a nearly $50,000 2014 chevy silverado that we knew had that recall. the question is did the dealer fix it before we left the lot? >> my pleasure thank you very much. >> thank you very much, thank you for selling this truck. >> if you have any questions, call me. >> thank you. >> now we have to find out whether, in fact this recall has been fixed. >> reporter: next, we get together and check the recall website to see if the dealer fixed it. >> all right.

what's the vin number? here it is. recall status, incomplete. this is something that people don't typically do at home on their own. >> no, especially not on the new cars. >> reporter: he's sold us a new vehicle with a recall that hasn't been fixed which is against the law. >> what's the plan? >> the plan is we're going to go to hawthorne chevrolet. >> let's go to that dealership. >> reporter: we give arnie a visit. >> hi, there. >> how you doing? >> theo benitez with abc news. you sold jerry this car and you said there were no recalls on it. but in fact, there are recalls on it. in fact, a very serious recall -- >> there's a recall on this? oh. i have to check it out and see. i don't know. i wasn't aware. >> why did you say there wasn't a recall? >> i don't remember even talking about that. >> reporter: to refresh his memory we show him that undercover video a benefit that everyday consumers don't have. >> that's -- it's a new car, that's why i figured there's no recalls. i did not physically check to see. >> is that something you think you might change now?

people aren't expected to sort of know -- >> when you get a brand-new car, it's always supposed to have all the recalls taken care of. i made a mistake. >> reporter: arnie walked away poll jet and i can promising to double-check all cars for recalls. the dealer admitted that they made a mistake telling abc news we have realized that our failure was tied exclusively to human error. he added that the dealership will now be running vin numbers to check for recalls before vehicles leave the lot. but it's not only this dealership. we've uncovered hundreds of new cars from multiple manufacturers that were sold with unfixed safety recalls in over 40 states. incredibly, the national highway traffic safety administration, ntsa headquartered here in the nation's capital, only fined two dealerships in 2014. >> i think this is very serious. i think that americans have a right to know that when they buy a brand-new car, the car has no defects in it. >> reporter: senator ed markey

sits on the senate subcommittee on consumer protection. >> we found hundreds and hundreds of new cars that have recalls on them, and they were sold. >> and that's wrong. you have to assume that when there's a brand-new car with that new car smell in it that there are no defects. >> ntsa has 51 people on that enforcement team. we have a couple of producers. why can't ntsa do it? >> ntsa should have done that work. it shouldn't take an investigation by abc to find this problem. ntsa is now put on notice that its job is to be the cop on the beat. >> reporter: ntsa declined an on-camera interview but defended their enforcement efforts in light of budget restraints. the makers of our truck gm says they tell dealers not to sell cars with open recalls. so here's what you can do. get online at safercar.gov and use your vin number to search for recalls. you can also plug your plate number into a free app called my
