it's the next phase for dzhokhar tsarnaev jurors have started hearing arguments on whether the boston marathon bomber should live or die. and teens learn about impaired driving just before prom season. and the power is still out for people in wayne county due to an underground explosion. here is video sparked by the blast of underground wires you can see the poof of flames and it knocked out power and is still out now. david henry is live now with the details. >> reporter: well, it will be a while yet peco is trying to assess the situation and trying to figure out what caused the explosion last night tonight was a close call for folks dining outside and inside the nearby restaurants and shops.

>> oh, my god, i thought my one employee was -- i didn't know if i would look and see him dead. >> frank was inside of his pizza parlor and said there was problems with the electricity all day and were concerned when sickening fumes came from the manhole outside. and then an "action news" viewer caught the explosion on video. outdoor diners were saved only by an iron fence that deflected the manhole cover. >> the windows came flying in and tables and chairs came flying and lights came off the wall. nobody got hurt, luckily. there were people in the window eating earlier, it as like people had just got out of there. >> peco doesn't know what caused the explosion, possibly expanding air inside of the cake

installation, and smoke began pouring from the manhole midmorning, frustrating for shop owners who lost their power. >> my salon power is off. >> most of it is in the area, and it will be a while before they will reopen. >> we cannot get in today there is damage inside of the building and once the township gets in we'll have the engineer doing the assessment and doing repairs to the building. peco says it will be late this afternoon before all the repairs are made and power restored to the buildings, this remains a major disruption to what is a bustling business district. >> thank you. penndot had an emergency of its own overnight when an

electrical fire was sparked into montgomery county inside of its district 6 building in king of prussia the fire ignited inside of an electrical cabinet on the second floor. >> it looks like electrical damage and it's somewhat severe the preliminary diagnose is electrical damage. it did not spread and stayed with the electrical cabinet. >> there was a to hour delay for employees to report this morning. finally the rain has moved out making way for nice sunshine this afternoon. some had to deal with the remnants of storm during the morning commute, the action cam was on columbus boulevard in penn's landing where minor flooding blocked the road, a police officer blocked the road, to keep people from driving flew it. now david murphy is here with more. >> that can be a hazard when you

>> reporter: back in the courtroom today a battle for convicted bomber dzhokhar tsarnaev the jury that found him guilty on all charges are seated again for the penalty phase of the trial. some are calling on the government to take the death penalty off the table. there are many that fear a death sentence could lead to years of appeals. >> part of us getting on with our lives is this ending and it's not going to end when it keeps getting drawn out like this. a sentiment shared by the family of 8-year-old martin richard, who was killed in the attacks. >> as long as the defendant is in the spotlight we live a story told on his terms not ours. >> the defense will use that.

and brown was killed by police officer darren wilson in august setting off months of protests. a female police officer accused of shooting an unarmed man is expected to dolphin county court this afternoon. in an effort to keep the video from being released to the public, lisa merkel is accused in the death of david masuk police say she chased him and tased him and shot him twice in the back. >> they say the shooting was justified because she did not know if he was reaching for a weapon. >> the case relies on the video it is and i expect it to be the corner stone of the prosecution. >> merle has waived her right to a preliminary hearing.

in western pennsylvania police are looking for a shoplift their made off with her goods using a shopping cart and tupperware. "action news" captured her making her get away from a wal-mart, everything looked normal she was pushing her cart and took groceries section bisection and then put items into tupperware container, and bypassed the line and used the shopping cart as her get away car. coming up a popular ice-cream maker issued a vol teary recall of its products. what prompted blue bell to make the move. and mammograms what they are saying about this potentially life saving procedure.
