urgency here because the busiest route of the country the the northeast corridor cannot get back on line until they finish this work in the port richmond section of philadelphia. wednesday night, the the big story on "action news" tonight is the latest on america's deadliest train action in almost seven years. and tonight, one of the big questions surrounds this man he is brandon bostian, of queens, new york. identified by his lawyer as the engineer, who was at the the controls of the train last night. the ntsb says his train was moving at 106 miles an hour, with a limit was 50. and the words of the mayor michael nutter today clearly the engineer was reckless? what was going on in the cab. there is no excuse that could be offered. the death toll now stand at seven, 200 people were treated at a total of ten hospitals. and at least ten people are still in critical condition. standing by with the latest on all of this our

"action news" reporter sharrie williams monica malpass kenneth moton and dann cuellar, dann cuellar is live at the scene at frankford and wheatsheaf in port richmond. dann, bring us up to dayton what officials are doing and what they are saying. >> reporter: well, jim tonight we hear from the lawyer representing train engineer brandon bostian the ntsb has not ruled on what caused this derailment but mayor michael nutter was shocked and dismayed the engineer was taking a sharp curve at a speed of 106 miles an hour. >> i mean that is devastating information. >> reporter: sources identified the engineer as three two-year old brandon bostian of queens, new york. according to data retrieved from the black box the train was going at a speed of 106 miles an hour as it's a approached the curve with a 50-mile an hour speed limit. >> just moments before the the derailment, the train was placed in to engineer induced braking. >> reporter: ntsb says engineer tried to slow the train down, into last seconds

critically injured in the crash. gaines was pronounced dead at temple university hospital. his grieving wife simply says jim was more precious then us, then we can adequately express. then there was 20 year-old justin zemser a student athlete on break from the u.s. naval academy. mid ship man from rock away beach, new york was on his way home to his mother. >> he was a loving son nephew and cuss honey was very community minded. this tragedy has shock us all in the worse way. >> reporter: meanwhile family members of the missing maryland husband and father bob guildersleeve are in philadelphia handing out the flyers with his pictures hopes for word on his whereabouts. and, moments ago, we have confirmed the name of another victim, 42 year-old doctor derek griffith, acting dean of student affairs and enrollment management at megger evers college in brooklyn. the that is part of the it is i university of new york. tonight while we have now five

of how they all help each other. >> next thing you know the car geared to the left at first and then over to the right. i am 6-foot one 200-pound and i was thrown like a rag doll. >> reporter: yes cutler got beat up on the left hand and leg. he says he is just grateful. >> it is enough to be concerned that they wanted to x-ray for it. i'm mobile, i can walk. but there is in break. i'm lucky. i'm lucky i'm standing here. >> reporter: lucky indeed. many injured understandably are considering hiring an attorney for possible legal action. >> all right, monica. amtrak has also set up a hot line for anybody still trying to connect with a loved one who was on the train that number is, 800-523-9101. officials are also asking any passengers who got off safely but who have not reported their whereabouts to please call the number right away.

despite the high profile nature of this disaster, commuter trains air monk the most safe forms of travel, far safer than driving. we have analyzed statistics from the federal railroad administration over the past decade on amtrak, septa and new jersey transit. no one had been killed in the train accident in philadelphia, until last night. thirty-five people have been hurt from the beginning of 2006 through february of this year. there had been 77 accidents over that time, in the city. the main cause mechanical or equipment problems, followed by, something wrong with the the tracks, human error was the third reason. well, the the fact that technology exists, that automatically slows down speeding train cars. and, in fact, this section of track was due for that upgrade by the end of the year. well to day ntsb made a stunning admission if that breaking system had already been installed this accident

would not have occurred. sharrie williams joins us from the "action news" big board with more on this, sharrie. >> reporter: yeah, jim it is called positive train control. it has the ability to override the train engineer if necessary. in this case, after the train left 30th street station the posted speed limit was 80 miles an her before the the train began to approach the curve. in the curve the posted speed was 50 miles an hour ntsb as the train was going 106 high tech system would have determined the right speed ahead of time and made the correction. >> based on what we know right now we feel that had up is a system been installed in this section of track this accident would not have occurred. >> reporter: the system that may have prevented this catastrophe is called the advanced civil speed enforcement or ases. it is also known as positive train control. it uses digital technology and gps to automatically slow down

or even stop trains that are moving too fast or heading into a danger zone. >> ases is installed throughout most of the northeast corridor, for amtrak however it is not installed for this area where the accident occurred. >> reporter: the system isn't installed on this portion of the track just yet but under current law congress has mandated that the rail industry has to adopt the technology by the end of the year. amtrak says it is committed to meeting that deadline. adding that the technology to every railroad is a massive and taking and comes with an enormous price tag which has been a topic of debate in congress. >> after that accident, god forbid, things happen. >> we need to did more funding. >> had that system been in place, this would not have happened. it is a disgrace to hear frankly that something like this didn't have to happen. >> house democrats are pushing for more funding but just today, the the republican lead

"action news" is in north philadelphia tonight as police were in hot pursuit of two suspect carjackers. chase ended just before 9:00 at park and glenwood where the the fleeing chevy impala lost a wheel and came to rest on the sidewalk. both suspects bailed out and ran. one was apprehended immediately, another was caught a few blocks away. authorities have not said if the cars rightful owner was hurt in the carjacking. jury quick 39 year-old jason smith for killing a young doctor a at her center city philadelphia home. smith is an exterminator and when doctor melissa death newt
