breaking overnight, the senate's failure to extend parts of the patriot ago. >> republican leaders were bucked by one of their own. in fact someone who wants the party's nomination for president obama. >> bazi joins us from washington. good morning. >> reporter: good morning. now, the senate does have enough votes to pass the bill to extend the nsa program but will have to wait to do so because rand paul forced a delay. >> the senate will come to order. >> reporter: the u.s. senate called in to work on a weekend but still missed the deadline to keep key parts of the u.s. patriot act from expiring. it means right now the nsa is not allowed to collect phone records in bulk and the fbi not allowed to use roving wiretaps to monitor suspects as they change phones among other measures. >> we are not collecting information of terrorists we are collecting all american citizens' records all of the time. >> reporter: kentucky senator rand paul refused to allow a

final vote on a measure that would extend then reform nsa's once secret mass collection of americans' phone records. civil liberty groups cheered his resistance but intelligence officials warn any lapse in the program puts the nation at risk with al qaeda and isis actively plotting against the west looking for any cracks in our security systems. >> heaven forbid we've got a problem where we could have prevented a terrorist attack but we didn't do so simply because of inaction in the senate. >> reporter: the president and most republicans agree this morning that a fix to restore the surveillance program must come soon. >> we shouldn't be disarming unilaterally as our enemies grow more sophisticated and aggressive. >> reporter: the senate will take up the measure again today but even after it passes officials say it will still take at least a full day to reboot

the phone collections program. t.j. mara. >> bazi kanani for us live in washington thank you. secretary of state john kerry woke up in a swiss hospital this morning after breaking his right leg while cycling in the french alps the 71-year-old kerry is an avid cyclist and crashed yesterday while riding on a road often used in the tour de france. kerry was flown to the hospital in geneva. today flying to boston where he'll continue to receive treatment. vice president biden's family remains closed door as they mourn the loss of beau biden. he died after battling brain cancer. jim avila with more. >> reporter: vice president biden and his son had a bond forged by tragedy. then senator joe biden sworn in for his first term in the hospital room in 1974 survived a car crash that killed their mother and sister. >> incredible bond i have with my children is a gift i'm not sure i would have had had i not

ground. the equipment weighing tons crashed into the building as it fell breaking off chunks of concrete metal and glass all rained down on madison avenue. seven people were injured. those who narrowly escaped are expressing gratitude. >> she was along the building line and missed her. she's shook up. going to church to pray. she's still in church praying. >> reporter: the injured were all struck by falling debris. offs say it could have been a lot worse if it weren't a weekend when it wasn't as busy on the streets. >> thank goodness for that. a little girl in critical condition after a wild car crash at los angeles international airport. the 9-year-old was hit by a car that plowed into terminal 7. the porsche went right through the wall coming to a stop in a l.a.x. utility room. the driver and a passenger were also injured. police say he may have mistakenly hit the gas instead of the brake. russia's involvement in ukraine is drawing fire on several fronts this morning. first, it's gotten vladimir

putin shut out of next week's meeting of world leaders in germany and there are new doubts about russia's report blaming ukraine for downing malaysia airlines flight 17 last year. an independent group saying the photos in that report were faked. western countries believe the plane was shot down by a russian unit. word this morning of a secretary accusers in the sex scandal now swirling. former house speaker dennis hastert. sources tell abc news that accuser is a former student of hastert's who was a teacher and coach at an illinois high school for 16 years. the man is not referred to in the indictment against hastert and didn't ask for or receive money from him. hastert is accused of violating banking laws while paying hush money to another accuser and lying to the fbi about it. let's turn to presidential politics. a couple of major developments. lindsey graham announcing today he is jumping into the republican race. a crowded field right now. everybody struggling to stand out but he stands out a bit. graham did serve in the

military. also stands out because he admitted that he never in life sent an e-mail. over the weekend martin o'malley joined the race facing bernie sanders and hillary clinton. o'malley supported clinton in 2008 but says well things are different now. he will sit down with our george stephanopoulos later on "good morning america." all the recent rain in oklahoma still poses a threat. >> yeah, the ft. gibson dam is near capacity. engineers are letting out some of the water before it forces itself out. that could mean flooding for communities downriver so they're if iing sandbags to try to keep the grand river in its banks. they could have used some of those yesterday in northern new jersey where torrential downpours overwhelmed storm drains and flooded roads, basements and stores and take a look at the radar right now. a large system is sweeping into the northeast once again stretching from west virginia to maine. areas around new york city and boston could get 3 to 4 inches

liquor store. parents who survived much he was later killed in a gun battle with cops. detectives say he had a run-in with the store clerk about an unpaid bill. united airlines apologizing amid allegations of discrimination. a muslim passenger said a united flight attendant refused to give her an unopened can of diet coke telling her it could be used as a weapon. the passenger a chaplain at northwestern university claims the same flight attendant had served an unopened can of beer to a man seated next to her. it happened friday. people out there, of course organizing on twitter right now threatening to boycott the airline. gas prices may be close to peaking as we head into summer travel. the average price this morning is $2.74 a gallon. that's 15 cents more than a month ago but practically unchanged in the past week. this time last year gas was at $3.67. can you thank more refineries coming back online.

boston basically all the major travel hubs. singer enrique iglesias is recovering after a freak accident during a concert in mexico. >> yeah he cut his fingers when he grabbed a drone during his show. you're seeing it happen here. saturday night. oh, you see him gesture then he tosses that thing, blood. can you see him bandaged up. he ended up bleeding so much he drew a heart on his white t-shirt patched up on the side of the stage. couldn't stop the bleeding. he continued to perform for 30 minutes even though being advised not to do so. he grabs the drone. a part of the show. he gives the audience a view his own point of view but something went wrong on this one. >> well the show goes on. what a professional that guy is. philadelphia that drone was being flown inside citizens bake park during a phillies game and landed outside where police and security took possession of it. no charges will be filed against the man flying the drone but he could be fined. police will brief the faa about that case today.

a scary scene from a circus performance near houston. a female acrobat happening from her hair spinning over the audience when she slips out from the contraption holding her. she falls several feet but luckily suffered only bruises. the circus blames the performers for failing to properly secure a safety cord during the performance. also this is not a movie stunt even though it sure looks like it. surveillance video capturing a car going flying over a row of parked cars in montreal. it crashes into an auto repair shop. the driver in his 60s might have confused the gas and the brake pedals. the owner of the shop says the damage could have been a lot worse, though. >> i'm surprised that he was able to clear the cars that we had lined up and there wasn't inexpensive cars porsches audis, he cleared them and did some good air. >> some good air. >> thank goodness no expensive cars were damaged. >> goodness. the driver went airborne

expected to recover despite having to be cut out of his car. the car at the shop saying the most damage was a fixer-upper like you say, mara the expensive ones were okay. the hunt is on for a woman who left a valuable classic computer at a northern california recycling center. that computer is a first generation apple desktop. one of only 200 of its kind. already been sold for 200,000 bucks but the recycling center's policy is the person who brought it in gets half of that money. unfortunately, she did not leave her name or information but they said they'll recognize her and honor it and give her a check when she comes in. >> that is very honorable of them. good thing for that policy. now to sports. the championship series in both the nba and nhl don't tart for another couple of days. >> what do we do? baseball highlights from our guy at espn. >> i'm john buccigross. the last day of the month was filled with surprises and walkoffs. a good day of baseball on sunday. let's start in beautiful
