is off and an escaped prisoner is back in custody find out how police captured him in delaware today. and a woman claims they was raped in a hotel her new lawsuit. we learnd this morning that the engineer was not talking or texting on his cell phone when he was operating the train when it derailed last month and brandon bostian suffered a head injury and does not remember what happens during the deadly accident. john rawlins has the report from the 30th street station. >> reporter: hi rick, this is interesting, it takes off the table the idea that a cell phone call or texting or an active data search some how became a distraction for the engineer but it does not take off the table that the device it self

may have been a distraction. >> the analysis of the phone records show that no calls texts or data occurred during the derailment of the train. and the engineer did not access the wifi system while operating the locomotive. that was the big question when the ntsb chair was on the hill and that the records were more complex than first thought and the analysis with was taking longer than expect. >> we are inexpecting the engineer's records. >> now the safety agency can now say that the engineer's phone was connected, they cannot say if the phone was in use in airplane mode, if it was in

airplane mode it could still be used to listen to music or view videos stored in the phone it said that it continues to examine the phone's operating system. >> the agency is trying to figure out why amtrak 188 was traveling at more than 100 miles per hour into the frankford curve that has a 50 miles per hour speed limit. brandon bostian does not remember the time that the locomotive accelerated. hundreds of people were seen by medical personal and some are still in rehab and care up and down the east coast of the united states, we find that there are still four in acute care in hospitals in philadelphia and two at temple not in critical and two at hahnemann still in critical.

they are looking for the car that struck the man in olney the victim was walking westbound at a crosswalk against the red traffic light at 1:30 this morning where he was struck and is being treated at einstein hospital police believe he was driving a dark colored accura or honda and are working on a better description of that vehicle in north philadelphia police are investigating an overnight shooting where a neighbor was struck by a stray bullet along the 3100 block of front street a man riding a bicycle started to shoot at another man and missed the target and one bullet struck a 53-year-old bystanders sitting on his front steps. police are still looking for the shooter. from our delaware news room, the prisoner that escaped from delaware corrections is back in custody. isiah thompson was on work detail when he escaped yesterday, he was arrested at

the first data facility. a security guard was looking at surveillance video and called police when he saw someone crawl through a broken door. meanwhile, the manhunt is still going on door-to-door near a state prison in new york. abc news correspondent, marcy gonzales reports from the prison site in upstate new york. >> after combing through dense woods -- and going door-to-door. >> there are cops everywhere. >> following up on a tip that the two fugitives may have been spotted in a small town 35 miles from the prison. >> they were trying to get an idea of where they were. investigators found nothing. now moving their search back to new york where they escaped from the federal facility this

weekend and reaching out to the convicted killers friends and family. >> she slipped down and were on their way. >> today the attention is focused on this woman joyce mitchell, the prison employee that supervised the prisoners work assignments. >> her son confirming that the day the convicts were reported missing and she did not have a relationship with either convict insisting she had nothing to do with the escape. >> officers are again speeching every home, not because of a specific tip because of the general possibility that these guys could still be hiding out nearby. marcy gonzales, channel 6 "action news." >> thank you. >> a crash involving a new jersey transit bus is blocking traffic in one of the busiest routes in and out of new york

significant backups while police worked to clear the accident scene. the driver of a tractor trailer had to be rushed to the hospital following this accident on i-95 in burlington township the truck overturned spilling its load of apple juice 30000 pounds of apple juice, it happened in the northbound lanes of 295, near exit 47 it caused rush hour backuped as two of the lanes were blocked by the spilled cargo no word on why the driver lost control but his injuries were said to be non-life-threatening. time for the accuweather forecast on a beautiful wednesday, lets look outside at the jersey shore, pretty picture from cape may, a calm sunny afternoon. meteorologist, david murphy who has not left for the beach yet is outside of our studios. >> the humidity is on the low side and if you like warm conditions without the heavy

humidity you have it today. lets start you with satellite there is not a lot of significant cloud cover around and the precipitation to the west looks to fall apart before it gets here and i'm starting to see the expected fair weather cumulous clouds popping up and we expect the day to remain bright, 80 in philadelphia 81 in millville and the upper 70s in sea isle city and the boardwalk in atlantic city and upper 70s in allentown trenton and reading and in wilmington. the humidity as i mentioned is on the low side not that there is absolutely bone dry conditions in the amount of water vapor in the air we are looking at dew points in the 60s and that is when it feels comfortable and with the heat rising and the sun out you need to take shady breaks that is my advice for you sunscreen is important and we are getting close to the summer solstice and

meteorologist, david murphy is back inside now, the nicest day of the week. >> absolutely, the humidity is lower be it's warm out there. we are dry across the region and that is always nice, we have chopper 6 hd out above fort delaware state park along the delaware river and upper bay and a nice day to go to the park or anywhere else, and 80 in philadelphia and the dew point down below the 60 degree threshold. and winds from the southwest at 8 miles per hour. and the southwest west overnight into tomorrow will change thing a little bit. not bad and warm and 83 in philadelphia and upper 70s fromal ep town and trenton and

all the way to the coast in sea isle city. future tracker 6 we won't boernl with that today, just actual satellite and radar. not a lot of significant cloud cover but every once in a while sp fair weather cumulous. 85 in allentown and less humid and lots of sun overall in bethlehem and easton and down the pike to reading, and at the shore 78 degrees and lots of sun and pleasant conditions with the lower humidity we'll go for a high of 87 and lots of sun and less humid and a breeze running 6 to 12 dipping to 69 overnight, and it will get more humid by the time you wake up in the morning, this evening is comfortable but by the time the morning dawn arrives, we'll see an uptick in humidity and that is the story for tomorrow and the next several days as a frontal boundary makes its way
