linzie janis has the details. >> reporter: a perfect storm of mistakes, a botched response, passengers not wearing seat belts and most of all, a driver too tired to be behind the wheel. >> the drivers have a professional responsibility to do the right thing. >> reporter: 14 months after the new jersey turnpike crash that left median tracy morgan seriously injured and another man dead, the national transportation safety board says the 35-year-old walmart truck driver had been awake for 28 straight hours. investigators say kevin roper came speeding into a conduction zone at 65 miles per hour slamming on the brakes just two seconds before before smashing into the lynn mo van sending it into three other cars, then flipping it on its side. one thick investigators don't very, roper's point of view. he's refused to talk. >> we tried to work through his attorneys, through his employers but in the end, no, we couldn't speak to him. he declined to be interviewed.

take a look at this impact video. the impact between a fire truck and an ambulance in miami causing the fire truck to flip on its side. the front of the ambulance virtually sheered off. the fire truck was rushing to a call at the time. the ambulance had a patient inside. in all, a dozen people injured and treated at hospitals. many of them first responders. a federal judge has ordered all sides in the new england patriots deflategate scandal to reach a settlement before a hearing set for today. patriots quarterback tom brady and nfl commissioner roger goodell are scheduled to appear in court here in new york today

he would live up to his agreement that it would be temporary and three years has not been temporary. >> she argues this is a far cry from shared custody because he's not allowed into the u.s., she's forced to go out of the country to visit her kids. it's been a legal hot potato on both sides of the atlantic. but giersch's attorney says he's thrilled with the ruling. >> he's very excited to have his children back. >> reporter: because she didn't abide by the terms of the agreement, it could mean less access to her kids in the future. her next court date is scheduled for monaco early next month. linsey davis, abc news, new york. federal regulators say driver fatigue was the main cause of a deadly accident that injured tracy morgan. the driver which hit morgan's limo had been without sleep for more than 28 hours. investigators also found lapses in the emergency medical response. it took 40 minutes for first responders to get morgan and the others out of the limo. >> they were getting them out.

they didn't have enough basic life support units on scene. that further delayed the delivery to the hospital. regulators also found unused seat belts made the injuries worse and the customized limo left the passengers with no way to get out. the new fire that broke out on sunday north of san francisco has mushroomed more than doubling in size in just 24 hours. the jerusalem fire has scorched 14,000 acres and forced new mandatory evacuations. flames are racing through the dry and rugged terrain, moving so quickly, fire officials are concerned it could merge with the even larger rocky fire which has destroyed 43 homes. it's believed a strong storm that moved across rhode island could have had something to do with causing a big water main break. when it happened, an sinkhole opened up right under a pickup truck. a police officer who was working nearby ran to the scene and helped the driver get out. he wasn't hurt. >> i think it's very serious to get him to safety as you can see, that could have gotten even worse. that truck may have gone completely under.
