"action news" reporter chad pradelli is live outside the courthouse tonight. chad, what are the details here? >> reporter: well, jim, this is a perjury case and it appears that form is going to be part of kathleen kane's did he first on these charges. you may recall that kathleen kane conducted a review of the jerry sandusky case and why it took prosecutors so long to bring charges. during that review, she found that porn was e-mailed on office computers and throughout the attorney general's officers. a short time ago her did he first attorney says those porn e-mails will be part of her defense and in the hearing he wanted to presenter those but he would not say as he took the podium a short time ago why or how they relate to this perjury case. >> not testing my defense with the media. i'm not previewing my defense to the media. my obligation is to my client

and that's the case there i want to resolve and i will resolve it there. >> reporter: led by her twin sister and other supporters attorney general kathleen kane had no comment as she entered the montgomery county courtroom. prosecutors first called special agent david piper who works under kane and the attorney general's office. he testified that kane requested a 2009 memo regarding the investigation of jay wyatt mondesire. then the head of the philadelphia chapter of the naacp. it was written by agent bill davis and directed to then chief deputy attorney general frank fina under cane's predecessor tom corbett. prosecutors allege kane directd release of the grand jury file to the press to smear fina for not prosecuting mound tire who has denied any wrongdoing. kane testified to the grand jury that she never saw the memo prior to its release in news reports but piper testified he showed kane and her aides the file prior to the news report. but what is the motive for the

grand jury leak? sources say fina and kane will been at odds after fina tried to prosecute several philadelphia democrats during a corruption investigation. when kane took office, she terminated the investigation and alleged racism all of the philadelphia democrats are african-american. fina has denied the allegation of racism and he later went to the philadelphia district attorney's officers where d.a. seth williams reopened the case that resulted in several convictions. kane is accused of releasing the grand jury material, lying about it and spying on a subordinate to see who was cooperating with the investigation. and kane has a formal arraignment scheduled for october 14th. now, one of her aides patrick reese is also charged in this case but he's been being tried separately. live in norristown, chad pradelli channel6 "action news." >> thank you chad. the ocean county prosecutor's officers is investigating a deadly

police-involved shooting. it happened on cherry wood circle in brick township at 10:50 last night. a man called 911, said he was going create a disturbance and then hung up. when officers arrived, they say they were confronted by a man with what appeared to be a semi-automatic handgun. police say they ordered the man to drop the weapon and when he did not, the officers fired and killed him. officials have not released the names of those involved in the incident. four investors -- for investors this was another stomach churning day on wall street. the dow jones average lost over a thousand points within minutes of the opening and the rollercoaster ride was on. once again experts are pointing to china and the fact that the american stock market has been long overdue for a correction. "action news" consumer reporter nydia han is live at the big board tonight. nydia, what are experts and private investigators -- or i should say private investors saying about all this tonight? >> reporter: well, jim they are saying a lot. take a look at the

rollercoaster ride investors were on today. from 9:30 a.m. until 9:40 a.m. the market plunged down 1,000 points in the first 10 minutes. by midday the market had recovered so much the dow was down by only about 200 points but then just an hour before closing at 3:01 p.m. it nose dived again down 623 points. the dow closed at 588 points in the red and while i know this all looks really pretty terrifying, when you put it into perspective you'll see there's actually no reason to panic. soon after the opening bell rang that terrifying 1,000-point plunge. >> my heart stopped mostly because i think what's happening is out of the control of people in the united states. what's going on in china, what's going on in the european union so i think it adds an element of uncertainty that there's nothing we can do about it or very little we can do about. >> reporter: the dow ended at 588 points in the red. the worst one-day loss since

august 2011. the people we talked to seemed rather calm. >> i know that it will rise again, so i'm not too like, you know,. >> reporter: paniced. >> panicked about it. >> as a long term investor i'm just going watch right now and see if this is just a market correction. but still a little nervous. >> reporter: as long as that nervous energy doesn't turn into action, based on fear, financial experts say you should be okay because let's put this into perspective. the dow took a nose dive by 22 pinterest 6 percent on black monday. today the dow was only down about 6.6 at its worst point. stocks have gained 200 percent in the past six years. thyears. >> if you're looking at your portfolio especially for those people with retirement plans and if they have three, four, five years to go before they're going to start to need the money you don't make any changes today. >> reporter: what you should do is take a look at your

overall portfolio and make sure you're comfortable with your risk profile. >> risk profile will determine how you should have your dollars allocated. >> reporter: here's more perspective for these closing numbers. over the last week the average american's 401k lost $6,000. but over the last five years, that same retirement account is actually up 61 percent and very good to fidelity folks who stayed vested during the financial crisis recovered faster and are doing far better than those who dropped out of the stock market in 2008 and 2009. so again this looks really scary but experts tell us it is not a reason to panic although i understand someone just tweeted me and said listen that's easier said than done. jim, back to you. >> in fact that's true. world news tonight with david muir will have more on today's market action. that is next at 6:30 right after "action news." it was slow going for drivers in west chester today as crews worked to clean up a small fuel spill which is the scene near dillworthtown road and route 202 at 8 o'clock

this morning. a fuel truck spilled some of its load after colliding with another vehicle. fortunately nobody was hurt. two weeks from the start of the new year and a group of philadelphia area students including those with special needs have suddenly lost their school. "action news" reporter walter perez has that story. >> reporter:. >> right now we're living our worst nightmare. >> reporter: olga is referring to the closure of the education plus cyber charter school facility in abington. a move that has devastated these parents who say this school has done wonders for their children who suffer from disabilities including dyslexia and autism. caroline says her son who has asperge gary's syndrome has flourished since entering education plus two years ago. >> now he has friends. he wants to be a veterinarian. he went if being below average to doing eighth grade work when he's going in the seventh grade. it's -- we don't have another choice. >> reporter: the problem is that education plus is chartered as a cyber school, not a brick and mortar

facility. so, last week the state sent education plus this letterman date they go shut down the building they use as schools. the department of education also sent "action news" a statement specific to this case reading in part "the department has given education plus many opportunities to fix its educational model ton comply with the law and they have chosen not to and now have put their students and parents in a difficult position. "but nick torres ceo says he met with officials weeks ago believing these issues had been resolved. >> our parents they've tried four, five different public options most of them can't afford a private option what we've essentially done to them or been forced to do to them is two weeks before school now they'll have to either -- they have to make hard decision. >> reporter: educationy indication plus will remain opened but only as a true cyber school. that has resulted in the closing of four of their eight facility its, 42 teacher layoffs and approximately 500 families searching for new

schools for their children by next month. reporting from abington, walter perez channel6 "action news. >> and the battle over funding for special etch today asian in delaware county is playing out in court today. hundreds of parents and teachers showed support for the chester up lands school district and protested outside the hearing. state officials want a judge to approve a plan that would cut funding to the special ed program in the district. the program is publically financed but privately managed by charter schools. some see this as a move by governor wolf to cut charter school funding. >> ♪ today the world meeting of families mosted the so-called papal play book. the online guide answers questions about transportation and other topics for the pope's visit and related events in philadelphia. we have the link to the papal play book for you right now at 6abc/pope. prisoners at the curran fromhold correctional facility are busy making a special gift

for the pope. for the past few weeks the inmates have been building a commemorative chair which they'll present to pope francis when he visits the correctional facility. today we got a look at their progress. they were busy standee sanding and refinishing the 6-foot wooden chair. the chair highlights the prison's philadelphia core program which provides vocational training. about 100 inmates will be selected to attend the pope's visit on september 22nd. coming up on "action news" tonight a construction project decades in the making is now under way in atlantic city. we'll show you how it's expected to transform the struggling city at the shore. chip kelly s isn't happy about the nfl'sy response to this hit on eagles quarterback sam bradford. ducis rodgers has that story. >> and we're tracking a broken line of downpours and a couple of thunderstorms moving in from the west but this will bring a big change starting tomorrow. i'll have all the details coming up in accuweather. >> those stories and much more

>> students at west chester university headed back to class today despite lingering concerns over legionnaires' disease. the school turned off the hot water to a least nine of its buildings after the bacteria was discovered over the weekend. administrators technological "action newstell "actionnews" tn sanitized and the water is back on. these have been tougher times for atlantic city but there's a new project under way that is sure to have a very positive impact. new jersey correspondent nora muchanic has the story. >> reporter: cranes and heavy equipment on the beach near oriental avenue signaling

the start of a $50 million project expected to transform atlantic city's inlet section. construction of a seawall and new boardwalk in this area will mean that you'll once again be able to bike or stroll the entire boardwalk from margate all the way to gardener's basin in atlantic city. >> we have to go, you know, through the the streets and otherwise we would go -- we would use the boardwalk. >> look at it and see how it is and you just say well it's time to turn around so now you'll be able to go all the way to the basin and enjoy the basin. >> reporter: replacing this damaged boardwalk is a big deal. officials say once you can walk continuously to the other end of it in the inlet, it will become a major economic driver for this area. >> it's critical for the inlet, it's critical for moving our town away from a gaming centric city to a place that everyone will come down and play and have a good time. >> reporter: the mayor says it will spur development making now vacant water front properties desirable for building and guardian predicts the new boardwalk will draw more people to inlet attractions like the abseek

son lighthouse the aquarium and other businesses is the gardener's basin. >> kind of connects us. we're sometimes a little bit of an aisle land. this gives us connected to atlantic city in nice way. >> for us we can finally be able to walk down the boardwalk and get to enjoy some of the things you have to drive over. >> reporter: the seawall and boardwalk project is expected to take two years and is being built with money from the city, state and federal governments. >> it's going to be exciting. it will bring business to this part of the city again. and we're really looking forward to it. >> reporter: in atlantic city, i'm nora muchanic, channel6 "action news."

now to that hit on sam bradford. the nfl has reviewed it. guess what? the league says terrell suggs did nothing wrong. the nfl price vees of officiating says there will be no fine and that a flag should not even have been thrown. the league's contention it was a zone read option and the quarterback was not fully established as a qb. bradford and coach kelly not happy. >> we know the rules. if our quarterback hands the ball off and isn't going anywhere you shouldn't be able to hit him the way the rule has been explained to us so i mean i don't -- if they want to get into that, they can get into that but every other quarterback in the league when they get back in the shot gun can be hit when they hand the ball off. if that's what they want to do, we'll vol to adjust 'cause everybody in the league runs out of the shot gun. >> just because you're running a play out of the shot gun doesn't mean that it's a zone read. we have a lot of plays in our offense where they're absolutely no reads for us its an automatic give so, you know, i think the slowing

>> big changes coming tomorrow with that drop in humidity and rest of the week looking pretty nice for the end of august. as we look at double scan live radar we have a couple of downpours and thunderstorms andy in the far western suburbs especially in lancaster county. this is a cold front that is moving in very slowly to try to wipe out that humidity. in fact, we look a little closer and double scan this was a pretty nasty thunderstorm when it was close to york and as it's been pushing east towards lancaster it's really been falling apart so just isn't light showers now along 222 and also south of lancaster but really that is all that is going on presently in the viewing area. so as we look at the highlights, we've had 28 90-degree days in philadelphia

so far this year. but then also a very comfortable stretch that's in here tomorrow for the rest of the week but it's been a hot summer, it's been a hot august. temperatures running close to two and a half degrees above normal for the month. today's high 89 degrees, so close to adding another 90-degree day, although it didn't happen but i'm sure we'll have at least another few before the summer season's over. but then the other side of this story is that comfy stretch comes in after the cold front passes through tonight and dewpoints which right now are in the upper 60's to near 70 which is humid or oppressive. you can see it's in the 50's, if not 40's by the end of the week so that means very dry air is set to move in tomorrow. so, temperatures, they're kind of all over the place root now. lancaster is down into the 70's because of some showers. along the shore we've got the sea breeze so it's in the upper 70's and then inlands we're in the mid to upper 80's. as we look at satellite and radar clouds are really blossoming in from the west ahead of those downpours and thunderstorms but again, not

everyone is going to see these downpours. it's a very, very fractured line as it's moving in from the west. overnight tonight the big story is the clouds and the humidity, 64 to 70. and then a scattered shower downpour or the rumble of thunder for a few of us. then that front goes off the coast here on tuesday, so we'll have a little cloud cover leftover shower at the shore tomorrow morning, then quickly turning sunny, low humidity, 86 degrees with a very let's just say powerful low north of the great lakes. that sits there on wednesday. so, we have the front to the east. we have the trough to the west that's associated with that low so we're sandwiched in between the two with sunshine on wednesday, beautiful, low humidity and a high of 84. the exclusive accuweather 7-day forecast, it is warm, less humid here on tuesday with your high of 86 degrees. again, early in the morning some leftover clouds or a shower east of the city. then that front returns. but wednesday, thursday and friday it's sunny with just a few puffy cumulus clouds in the afternoon.

very low humidity and temperatures right around average, maybe a degree or two below especially for thursday and friday. and then over the weekend saturday it starts to warm back up to 88 degrees. the humidity still stays in check but then that changes as we get into the second half of the weekend on sunday. 89 degrees. very humid. and the same thing for monday with some sunshine around, a few clouds, maybe a scattered downpour or thunderstorm in the afternoon at 89 degrees. so we're close to or on the verge of a few more 90's at the end of weekend early next week but that is almost heading into the beginning of september. so, these davis 90's and extreme humidity is pretty much behind us at this point but overall a pretty hot and muggy summer season. >> gut a gorgeous week ahead. looks awesome. thank you. more than a dozen high school students are on their way to becoming lifeguards. end of the summer training. today 15 teenagers graduated from atlantic city's junior lifeguard program. they spent part of the summer
