headlines about her private e-mails. the latest, that mrs. clinton paid assistant brian pagliano to set up her private e-mail server. he also worked at the state department and now refuses to answer congress' questions, pleading the fifth. clinton has urged him to cooperate, but so far no sign he will, at least not without immunity. with more congressional hearings ahead on mrs. clinton's e-mail, her campaign is preparing for as one aide put it, a bumpy fall. devin dwyer, abc news, washington. the kentucky clerk who refused to grant marriage licenses to gay couples is spending labor day in jail. attorneys for kim davis have filed an appeal in her case. the three-page motion does not include arguments why she should be released but amends her earlier appeal of the judge's order. among those supporting her position, republican presidential candidate mike huckabee. >> what we've seen is the overreach of the judiciary. this if allows to stand without

her father is coming. then. i can't believe it. >> reporter: a family is reunited. >> reporter: do you think your daughter will have a good life here in germany? >> sure. the best. germany is the best. >> reporter: but now with so many people arriving, there are new warnings tonight. austria saying it will soon remove the emergency measures that kept its border so open and germany warning its limits may soon be overstretched. alex marquardt, abc news, munich. thousands expected in the illinois, today for the funeral of police officer joe gliniewicz. the 52-year-old lawman was gunned down last week after he radioed he was in foot pursuit of three suspicious men. kelly miller is among those mourning his loss. >> he was very friendly, very active with the community. but he took his job seriously.

he was a very fair officer. strong willed but at the same time, almost like a teddy bear. >> reporter: the search for his killer has turned it up nothing despite the $50,000 reward being offered. las vegas police calling the shooting of a cop an ambush. the officer and his partner returning from a call at a discount store. the suspect walking up to the police car when it stopped for a traffic light and opened fire. the injured cop was shot in the hand. while sitting in the passenger seat, the two officers got out of the car and ran down the suspect on foot. a violent holiday weekend in charlotte, north carolina. at least five people were killed and five others injured in several shootings. a 7-year-old boy is among the dead shot in the front yard of a home during a birthday party. police have called in special firearms and gang units to patrol the streets and some officers were called back from vacation. politics now. through the labor day weekend hillary clinton and bernie sanders were courting union voters. sanders has pulled ahead of

clinton in new hampshire and he's making a strong showing in iowa, as well. not long ago, clinton was trouncing sanders in iowa by 24% and now her lead in the hawkeye state is down to only 11 points. and clinton, sanders and other democrats running for president have a new challenger, harvard professor larry lessig has joined the race running on a single platform to expand voter access and instatute campaign finance reform. he spoke to george stephanopoulos about the challenges ahead. >> you have to find a way to elevate the debate to focus on the changes that would actually get us a government that could work again that is not captured by the tiniest fraction of the 1% who fund campaigns and make it impossible for our government to do anything. >> campaign finance reform, voting rights reform. >> and dealing with the crazy way we have political gerrymandering where politics pick the voters rather than voters pick the politicians.
