the case a police officer charged in the death of freddie gray, the judge has declare aid mistrial. william porter was accused of refusing to buckle gray into a police van and not calling an ambulance when gray called for help. he is the first of six officers facing charges in gray's death, the jury could not reach a decision after three days of deliberations. prosecutors and attorneys are due back in court to set a new trial date. >> as you see cab drivers and limo drivers and uber black drivers came to protest lift and uber x. gray hall is live now with more. >> reporter: brian and sharrie back to normal traffic here in

we are taking you back to the scene of the breaking news where a jury is deadlocked in the case of the first police officer to stand trial in the case of freddie gray, a hung jury and the judge declaring a mistrial. this is the live look where police officers have gathered along with many members of the media, this is not a protest underway, but obviously there has been a lot of protesting in the city of baltimore since this case first began when freddie gray died in the back of a police van, no signs of violence or protest now but the city on guard there in baltimore, police gathered outside of courthouse, we'll bring you the latest as this unfolds this afternoon.

to the truck driver. a texas teen plead guilty to killing four people in a drunk driving crash could be heading to jail two years after the crash. he -- the teen reportedly lived alone in a 4,000 square foot house was sentenced to four years probation and rehab, he missed a checkin and now an arrest warrant is issued but court officers are unable to find couch or his mom, couch's father has no idea where either of them are. big talkers now and new numbers from health officials in montgomery county, are raising big eyebrows, aparentsly the number of babies and toddlers being prescribed anti-psychotic drugs has soared.

this shows that last year in 2014, almost 20,000 prescriptions were written for kids under the age of 2. that is up from 13,000 the year before, a more than 50% increase. of most concern a steep rise for prescriptions for prozac designed for use in adults and not babies and a drug used to treat schizophrenia in adults and teens, doctors are saying they are writing the scripts for those that are having a hard time with their little ones that are fussy. and little is known of long-term effects on children that are very much develop snoog if have you a cell phone more than fee years old you may want to trade that in before the new your, surfing the web and using social media sites may not be safe or even possible.

"action news" delaware valley's leading news program. with jaime apody, meteorologist, cecily tynan, rick williams and monica malpass. wednesday night the big story is out of west philadelphia, police are investigating the suspicious death of a 10-month-old baby at this day care. this is the 3500 block of german town avenue just after 1:00 this afternoon, we know the baby was a girl and was found unresponsive by a family member. katherine scott is live at the scene with the latest. katherine?

>> reporter: well, the circumstances here remain under investigation, but we are being told that this baby girl was 10 months old and her death is considered suspicious, if you take a look at the front window here at this facility, it says a state licensed facility and the officers are positioned right in the front door as this is well underway here, this is on the child care center on the 3500 block shortly after 1:00 this afternoon, police say a family member found a day care member performing cpr on the baby girl and the baby was taken to temple hospital and she was pronounced dead at 2:45 this afternoon, parents of the other children are allowed back in to pick up their children one by one and some were notified but some were surprised to hear and said this is a good
