poison food at several grocery stores. and millions of additional vehicles could be included in an expanded recall. and the big story on "action news" is the investigation into the shooting of a man by a philadelphia police officer. the man was killed driving a minivan in overbrook last night. now investigators are trying to figure out if the shooting was justified. >> reporter: we are waiting for a new update from police but what we foe is four shots were fired by a police officer. and the gun fire killed the man driving the minivan. they saw the minivan and called because they thought it was suspicious and maybe casing the neighborhood. marked cruisers and officers were in uniform and four of them were at the scene. it all unfolded here at the

intersection of lancaster and overbrook. the shooting happened on the other side of the block but the minivan went to this side of the block and crashed into the vehicles causing a chain reaction. >> preliminary reports indicate that the driver of this minivan was acting suspicious. there was concern that he was casing the neighborhood. >> they tried to stop the vehicle and he attempted to flea and they had plain clothes officers on the scene and they went around the block and told him to stop. apparently he attempted to flee from them and trapping an officer between the car and the other area and he didn't feel he could escape and discharged his weapon. >> the driver was pronounced dead at the hospital. no weapons were found on him or in the vehicle. his vehicle crashed into two parked cars. >> i heard the kid yelling i'm

stopping i'm stopping. and then pow pow pow. >> a woman that did not want to be identified. she believes the person that said that was the suspect. but she did not see anything. >> heard freeze stop. and three, four or five shots. and when i came to the window police were blocking the streets. per protocol homicide and detectives will interview witnesses. >> it's early in the investigation, i'm not making judgments, whether it's good or bad we'll have to see. >> police also say there are multiple surveillance cameras in the area and they will also review the video from those. annie mccormick, channel 6 "action news." >> thank you. police also shot a man in southwest philadelphia, this happened on the 5300 block of grays avenue late last night. investigators say that the man

was firing a gun into the air on the back porch and he fired at police when he asked to drop the weapon. officers fired back hitting the man in the leg and he is expected to survive. and a forecast that sounds like a broken record. another day of damp, cool and cloudy conditions. david murphy is tracking the latest from the big board. >> reporter: we have clouds and cool conditions with a breeze off the ocean. there are showers a couple moving away from the northwestern suburbs, i want to look at this stuff from south jersey and delaware, these are more than just showers. we have a couple of thunderstorms that have erupted inland from the beach and west of the garden state parkway some of this is pushing into southern areas around millville around the southern portion of route 55, and it looks like some of it will be hitting the atlantic city expressway in atlanta

county before too much longer, these lightning strikes are live strikes happening in the last couple of seconds and the yellow flashes are within the last few minutes or so. these are not severe storms but you will want to take cover when they come by you and they are forcing lightning through the region. temperatures are cool, 54 in philadelphia, currently not much better than dawn, 51 in allentown un53 in wilmington and 52 in trenton and again the thunderstorms creeping northeast right along the coast just inland from the water. winds right now are out of the northeast and they are not real strong but when you have temperatures in the low to mid-50s and you have the cool moist breeze blowing, it's jacket weather and shoulder hunching weather. today's high is only 58 degrees, well below the average high of 70 we expect cloudy and damp with spotty showers. unfortunately that is the way it

ireland in themoors. the thunderstorms appear to be coming down the delaware bay and dumping good bits of rain across areas just inland from the jersey shore. so inland cape may county, atlanta county around mays landing and another cluster around millville there is still decent lightning bolts there in the last 10 minutes or so. but we are looking at seven strikes in the last 10 minutes total. these are not severe storms but you want to be careful of the lightning of course. don't go dancing around if you hear that coming through. i'll move that quickly and you can see it moving straight up the coast and not coming to philadelphia. and at the same time there is
