with breaking news out of the maryland a baltimore police officer has been cleared in all charges in the case against freddie gray. pro protesters taunted him as he left the courthouse, abc's elizabeth hur joins us with the latest. >> reporter: just a quick background. officer nero opted for a bench trial not a jury trial meaning his fate was up to judge and the judge ruled that the state failed to approve that the officer acted intentionally and unlawfully, so the court had to find him not guilty. the verdict is in and it is not guilty for baltimore police officer edward nero. we're obviously outraged and angered. >> reporter: the 30-year-old spent the last week fighting assault and endangerment charges

after the prosecution alleged he arrested freddie gray without probable cause and was negligent when he did not buckle him into a seat belt. gray died last april after his neck was bron in the back of a -- broken in the back of a police van when he was left unshackled and unbelted. the defense argued he did not arrest gray himself. gray's death led to widespread anger an protest in the streets of baltimore more than a week prompting a citywide curfew. the investigate ended with 6 officers being arrested in the case. officer nero is the second officer to stand trial, but the first to reach a verdict. after officer william port's manslaughter trial last december

ended with a hung jury. now in court, observers say officer showed no emotion when the verdict was red. not guilty on all four counts. outside protesters are upset, but so far remaining peace. live in new york, elizabeth hur channel 6 "action news" back to you. back here, grief counselors are at burlington city high school following the death of a student a month shy of graduation, antwan timbers, junior was struck and killed by a driver suspected of dui early yesterday morning. katherine scott is live at the scene of the crash with more on how his classmates are honoring him today. >> reporter: sarah that's right, we're standing with the accident happened. the school is right down the street from here. a number of students passed by the site this morning on the way to class. you can see there's a memorial set up on the corner for the

17-year-old. grief counselors are at the school to offer support for students. he didn't deserve it. he wanted to go to the army. >> reporter: students arrived at burlington city high school wearing black to remember antwan. he was walking at route 130 at federal early sunday when he was struck and killed. he had a lot of aspiration growing up. he came here a couple of times to get a haircut. >> reporter: the pole snapped in the lot out front after the car went careening off the road. it's a tragic loss for the community. >> reporter: the driver are a card doe j. patterson the third was behind the wheel and remained at the scene. he arrested for driving under the influence and reckless
