good morning, america. donald trump on the attack over questions about his donations to veterans. >> i have never received such bad publicity for doing such a good job. >> and newly released documents pull back the curtain on his embattled trump university. their so-called playbook to woo students plus the new poll breaking right now on the clinton/trump showdown. flash floods rush through texas. roads turning into rivers. rescuers going house to house to save people. waters hitting record highs. >> very scary watching the water rise so fast. it came up so fast. i couldn't believe it. >> now new flood watches an warnings spreading across the state this morning. a criminal investigation now launched into the death of harambe. the little boy's pardons under new scrutiny after their 3-year-old fell 15 feet into the gorilla's exhibit. what we're learning now about the family and the new changes being made at the zoo this

morning. johnny depp's divorce bombshell. estranged wife amber heard fighting back. the new images showing injuries allegedly from depp in december and the incident that she says made her fear for her life. what really happened behind the scenes of their marriage. and good morning, america. boy, so much happening this wednesday morning. let's start out with those devastating scenes still playing out in texas. >> you see those floodwaters rising above 54 feet and horses stranded on a porch. helicopters delivering food to them overnight. you have family in texas. >> my parents are down there and have been affected by it in houston and trying to stay inside and hopefully everybody who is affected is staying safe. >> it is not over yet. we have politics this morning. brand-new national poll shows a tight race for the white house. you see it right there. hillary clinton holding a slight lead over donald trump. >> he's now facing new questions
7:02 am
about trump university and lashing out at the media accusing reporters of treating him unfairly. abc's tom llamas was there at the press conference on tuesday and joins us now with much more. good morning, tom. >> reporter: robin and george, good morning. donald trump telling the press exactly how he feels but also a san diego judge he's not happy with. the judge just ordered documents released in a trump university lawsuit where recruiters knew many of the potential customers may not have the funds to cover the school's tuition fees. overnight, donald trump raging on following a fiery news conference where he took on the press. >> a big portion of them especially the political press are the nose dishonest people. they're bad people. >> reporter: back in january, trump claimed he raised $6 million at the iowa event including a million he personally chipped in. >> we just cracked $6 million, right? 6 million. >> reporter: but trump's campaign manager recently
7:03 am
suggested the total amount raised was closer to 4.5 million. and trump's own million dollar contribution, it was only made last week. trump showing a photocopy of the check. mr. trump, writing a million dollar is incredibly generous but the night of that iowa fund-raiser you said you had raised $6 million. clearly you had not. your critics say you tend to exaggerate. you have a problem with the truth. is this a prime example? >> no, i raised almost $6 million. some of it didn't come through but more money is coming through than didn't come through. the number of probabilities is going to be over the $6 million. >> reporter: but that question seemed to strike a nerve. because three minutes later, trump said this. >> i'm not looking for credit. but what i don't want is when i raise millions of dollars, have people say like this sleazy guy right over here from abc, he's a sleaze, in my book. >> why? >> you're a sleaze because you know the facts and know them well. >> because i ask fair questions.
7:04 am
for months he would not receive the full list of those who received money. he claims he was vetting them and tuesday he read a long list of those he says got checks. >> project for patriots, $100,000. >> reporter: abc news reached out to all 41 groups and spoke with most of them. some told us they received the money months ago. but others say they only got it last week. and this morning, trump dealing with a new problem. documents released in one of his trump university lawsuits show employees of the university had a playbook instructing them on how to entice prospective students to enroll in its real estate seminars by saying, quote, you know who my boss is, right? mr. trump is on a mission to create the next wave of independently wealthy entrepreneurs in america. and potential students were also asked by recruiters if they have retirement funds or credit cards to cover the cost. trump has disputed the allegations and lately firing back at the judge. >> the judge has been very
7:05 am
unfair, has not done a good job. >> reporter: documents released on tuesday instructors describe themselves as hand selected by mr. trump but those claim that was not the case and trump is facing a similar lawsuit here in new york related to the school. the billionaire said he's not settling because he knows he will wing these lawsuits, george. >> okay, tom, thanks. just for the record you are not a sleaze in our book. >> good to know. >> okay, tom thanks very much. hillary clinton took off on trump using his tactics and hit back hard on veterans but faces a tough battle against bernie sanders in california. cecilia vega here with the latest. good morning. >> good morning to you. hillary clinton heads to california today where the race is closer than ever but first she also is jumping in on the donald trump bashing saying he shouldn't get much credit for raising and donating that money to vets. this morning, hillary clinton ripping a page straight out of donald trump's playbook going after her opponent on twitter. >> he's a war hero because he
7:06 am
was captured. i like people who were not captured. >> reporter: taking him to task for his comments on veterans and then taking to the airwaves for round two of her assault. >> the problem here is the difference between what donald trump says and what donald trump does. he's bragged for months about raising $6 million for veterans. but it took a reporter to shame him into actually making his contribution. >> reporter: clinton's allies not letting up either. going after trump online. virginia's two senators both democrats sending these virtually identical tweets saying hillary clinton is the only candidate with a comprehensive plan to support our veterans. but with a tight primary race in california, clinton is now headed to the golden state today for a last-minute swing ahead of voting there. bernie sanders crisscrossing the state drawing huge crowds. >> this is a very loud crowd. [ cheers and applause ]
7:07 am
>> reporter: clinton received a key endorsement from california governor jerry brown saying in an open letter, the stakes couldn't be higher. this is no time for democrats to keep fighting each other. the general election has already begun. and a sign her campaign is feeling nervous about california, clinton canceled campaign stops in new jersey and is now heading to california instead but even if she loses there she almost certainly has enough delegates to clinch the nomination. but a loss there, george, could keep sanders in this race even longer. that keeps clinton from turning her attention to trump. >> thanks very much. more from abc's matthew dowd, tom llamas back, as well. matt, let me begin with you. in yesterday's press conference that tom was at pretty time honored tactic for presidential candidates to go after the press but did it help trump yesterday? >> well, i think he's trying to stop the bleeding in the course of this, the question surrounding this, i think donald trump just like hillary clinton knows that his greatest vulnerability in this race is if his business experience and
7:08 am
private actions are undermined in the course of this race, it's why he won the primary, being a businessman and he knows if that is undermined in the course of this, pushing back on it, he is in real trouble if that is undermined. >> new front, trump university documents coming out and the new york attorney general saying he's going after it full bore. the trial in california not until november but trump also going after the judge in that case. >> he's not only going after the judge but after the lawyer, he's going after everybody involved in that trying to taint them with the idea they're partisan, this is not really objective. this is not what they should be focused on in the course of this. again, i think he really understands which is why he's in this embattled place if he's undermined on trump university or other businesses or casinos or something like that he really loses the sort of asset that he won this race with and he knows this in the course of this. i think hillary clinton will prosecute this part of this for the next five months and he will try to defend it the rest of the
7:09 am
way. >> meantime, tom, you've been covering trump for a long time. what you saw is a lot of what you've been seeing for the last several months. he's not going to change. >> that's right. it comes with the territory. you have to have thick skin when you cover donald trump but it's a strategy that's worked for him up until now. will this work through november? yesterday what you saw a lot of the members of the press asking him why he constantly calls the press disgusting and some of the worst people he met. he's not going to change. >> tom llamas, matthew dowd, thanks very much. back to robin. now to those relentless storms in hard-hit texas. flash flooding in some areas. those rivers rising to record-breaking levels and abc's neal karlinsky is in richmond, texas, with the latest. good morning, neal. >> reporter: robin, good morning. i've got the hip waders on, about the only way to get around. police have warned us not to go in any further because it drops off back over there and there are fears it will get worse with more thunderstorms rolling through later today. even when the rain stopped, the
7:10 am
water keeps rising. streets underwater and frantic rescue efforts under way. >> very scary watching the water rise so fast. it came up so fast i couldn't believe it. >> reporter: this woman moved into her house just three days ago. more rain drenching parts of the lone star state overnight. flash floods rushing through san antonio's riverwalk tuesday. and ft. bend county more than 40 people have had to be rescued and this drone footage capturing the swollen brazos river where they have risen to 54 feet. >> never like this in the last 13 years my parents lived there. >> reporter: these horses abandoned on monday after their owners had to evacuate their sim simonton home taking refuge the only place they could, the front porch. >> it was up to my chin. >> reporter: the owners delivering feed by helicopter
7:11 am
but the horses remaining trapped as the brazos continues to rise. >> unbelievable. like nothing i've ever seen. >> reporter: three elementary schools closed after the wettest may on record. robin. >> ginger, more rain is coming, some flash flooding down there. >> taking over almost the entire state of texas. so from brownsville up to dallas, even into southeastern oklahoma, we're on alert through thursday because there will be rounds of heavy rain, we still have the flood warnings in place around houston, the rivers there, you saw in the piece, swollen and you can see it right here. we stopped at 11 a.m. thursday. the rounds become heavy at times especially tomorrow morning into the afternoon at that low circulates through thursday night into friday we're not done with it yet. some spots look to pick up 3 to even 5 inches of rain. much more coming up through the week. >> thanks very much. the latest on that killing of the gorilla at the cincinnati zoo. a criminal investigation is now
7:12 am
looking into how the little boy fell into the exhibit. who should be held responsible as the zoo makes changes to prevent tragic accidents like this from happening again. alex perez is on the scene in cincinnati. >> reporter: this morning cincinnati police confirmed they have now opened a criminal investigation into the 3-year-old boy's parents and family regarding the actions that led up to the incident and asking anyone who may have recorded the ordeal to contact police. >> mommy loves you. i'm right here. >> reporter: officials have not confirmed the identity of the mother heard comforting her son from above while he was in the enclosure. the 450-pound harambe grabbing the boy at one point even dragging him all the way to the other side of the cage after ten agonizing minutes the zoo's emergency response team making the decision to shoot and kill the 17-year-old gorilla to save the boy. zoo officials arguing a tranquilizer dart would have taken too long. >> milliseconds make a difference in life and death.
7:13 am
you have a human being or gorilla alive today. >> reporter: this morning cincinnati police confirmed they have opened a criminal investigation into the 3-year-old boy's parents and family regarding the actions that led up to the incident. and we're also learning more this morning about the boy's family. his mother working as a manager at a day-care center here. police department here says once their investigation is complete they will hand over their findings to the prosecutor's office to determine if charges will be filed. robin. >> all right, alex, thanks very much. we're going to have a lot more on the legal case in our next half hour. but now a rare recall involving the most wildly used flour in america. general mills is pulling 10 million pounds of its gold medal and signature kitchen's flower because of possible e. coli contamination after an outbreak sickened people in 30 states.
7:14 am
dr. richard besser has much more on this. rare for flour to be linked to e. coli. >> it is rare. i started my career at the cdc as an outbreak investigator, a foodborne disease outbreaks. flour, you eat cooked and baking, frying is going to kill any germs that happen to be in there. >> what do you think went on here. >> they'll have to look to see was there a problem in the production of the flour in one of their mills. but when you look at how contamination and illness takes place in the kitchen, it's often eating something raw that should be cooked so raw cookie dough, you know, that was always a problem from the eggs in there. that's a possibility and then cross contamination in the kitchen if you're using flour did it get on a surface. when they went to clean it up that contaminated something eaten raw? >> what are the most common sources? >> flour doesn't make the list. top group, fruits and vegetables number one and leafy green vegetables is the big culprit. meat and poultry, chicken is really big.
7:15 am
dairy and eggs and then fish and shellfish and but flour doesn't hit that because it's a safe food and if you practice good habits in your kitchen, if you're really meticulous about not keeping raw foods in with your meats and washing your hands you'll stay safe. >> okay, rich, dr. besser will be taking your questions throughout the morning on twitter. now to amy for the morning's other top stories starting with breaking news in the egyptair crash. >> the signals from the black boxes of egyptair flight 804 may have been located. egyptian authorities say a french ship has picked up signals in the mediterranean that are presumed to be from the black boxes of the plane which crashed on its way from paris to cairo last month. those boxed believed to be in 10,000 feet of water and investigators are anxious to retrieve them in hoping to find out whether an explosion or technical problem brought down the fliel killing allen board. dramatic video from the escalating violence in syria.

7:32 am
newsstands today. "people" obtained new pictures of what heard says are a bruised eye and cut lip from an alleged accident that happened in december 2015, months before her split with depp. "people" said in the court documents she alleges during the entirety of her four-year relationship with thestar johnny has been verbally and physically abusive with me coming on the heels of this photo which she claims was taken after an alleged assault by depp on may 21st two days before she filed for divorce and claims the star hit her in the face with an iphone and there's this photo of depp with an injured hand taken in march of last year while he was filming the latest installment of "the pirates of the caribbean" franchise. sources tell "e.t." it wasn't from filming but punching a wall during a fight with heard. depp reportedly had to go back to the states for surgery. some of his supporters insist
7:33 am
heard's fabricating the abuse case in an effort to blackmail depp into a huge settlement. tmz quotes unnamed security guards who told them they heard her scream at depp to stop hitting her but that depp was more than 20 feet away from her. and what about the lapd which responded to a disturbance at the couple's home but reportedly saw no evidence of any crime. heard's lawyer tells abc news in a statement she declined to make a statement to the police in an attempt to protect her privacy and johnny's career. the lawyer accuses the depp camp of infecting the media with vicious, false and ma anything nantz accusations. we took the high road, the statement goes on. amber is simply a victim of domestic violence and none of her actions are motivated by money. no comment on the "people" story from the depp sued by a representative for depp has been saying from the start given the brevity of this marriage and the most recent and tragic loss of

his mother, johnny will not respond to any of the salacious, false stories, gossip, misinformation and lies about his personal life. george. >> okay, thanks very much. more on this from abc news senior legal correspondent sunny hostin. thanks for joining us. allegations from amber heard right now. we see the photos and we just heard david wright say depp's camp will not respond but how do the photos themselves change the legal situation? >> well, it certainly can be very significant. i think on several fronts, one, she has filed for this temporary restraining order granted by the judge and in that order she said that she had at least two different incidents of assault. now we're hearing more incidents of assault and so that is going to, i think, firm up her claims in that proceeding but, secondly, there is that divorce settlement and although in california it's a community property state which means she would get half of anything, any
7:35 am
income that he brought in during their marriage, the 15-month marriage this could have significant financial implications for johnny depp and i really think last but not least, there's the possibility of criminal charges. we are now hearing about not one, not two but three possible incidents of assault, domestic violence, that would be a criminal problem for johnny depp. >> so you add all that up and does that increase the motivation for the depp side to settle? >> no question about it. no question about it. this is not a case that johnny depp wants out in the court of public opinion. this is a case that he should want to put to bed as quickly as possible. >> sunny hostin, thanks very much. >> all right, george, we move on to those three women being called heroes for stepping in to save a stranger. after saying they saw her date put something in her drink. this man is now facing charges and the women who posted the photo on facebook has been

7:40 am
we welcome you back. we'll debut our big board over there. our team of insiders standing by live for more on this morning's top stories. so let's say we get to it. >> let's get to it. >> how about the criminal probe into the death of the gorilla at the cincinnati zoo to determine what circumstances may have led a child to fall into the animal's enclosure in the first place? dan abrams, you know him, our chief legal analyst joins us live. we talked about this in the first half hour, dan. there is a growing outrage against the parents, the mother in particular who was there and people are saying that they should be criminally charged. could that happen? >> well, look, under ohio law, it is a misdemeanor to endanger children. what dogs that mean? it means that you basically create a substantial risk for the health of a child by failing them in a duty of care. i don't think that's going to happen in this case. i spoke with the eyewitness, kim o'connor whose video you saw. i talked to her last night.
7:41 am
she said the authorities haven't even talked to her and when i talked to her, she said she did not think this mother was negligent at all. she said she just turned around for a few moments to deal with her other kids and turned around and her child was in the enclosure. >> she doesn't think the mother should be charged at all. there's a lot of public opinion. a massive story and we have a tweet from our social scroll from ina who says the mother should be fully charged with negligence of a child. what was she doing at that time? i'm just curious being a legal analyst will the public outcry have any effect on the investigation. >> yeah, well, i don't know how inna knows what happened at that moment but it is because of the public out cry the authorities are saying they're investigating at at all as a possible crime. i think without it there would be no, quote/unquote, investigation at all. >> but it has. it's lit up social media and
7:42 am
people -- >> absolutely. >> -- talking about it. they said the investigation is just beginning so we'll see what happens from here. >> we'll see what happens from here. thank, dan. let's get to kit harington, a big story. best known for his role as jon snow on hbo's "game of thrones" and the actor is now saying men face sexism in hollywood too, robin. sara haines joins us live. hey, sara, how are you? >> i'm good. we're hearing from kit in a recent interview and addressed the fact that sexism has always happened to women but happens to men as well and some of the quotes he said, i like to think of myself more than a head of hair and set of looks and mentioned some points during photo shoots when i'm asked to strip down i felt that referring to the sexism. it's not a surprise in this business, but, yeah, he has mentioned that enkind of interesting coming from a man now. >> he is very passionate. stop smirking here. >> i've been asked to strip
7:43 am
