up here to the hospital. they are in shock and disbelief that that 4-year-old child is gone. and while they are grieving, police are working really hard to put the pieces together of this case to figure out exactly what happened. heartbreak in north philadelphia. family members are overcome with grief after hearing the tragic news that a 4-year-old girl has died after being shot in the head. family and friends who showed up to hahnemann university hospital were too emotional to talk. police say exactly what happened is still under investigation. >> at this point in time, the investigators are going to try and ascertain how this incident actually took place, how this happened, how this 4-year-old was shot, in terms of the weapon that was used and ascertain how many individuals were in the house at the time this incident occurred. >> reporter: there is still a lot of uncertainty. but we do know the shooting happened before 12:30 p.m. inside a home in the 1800 block of north 20th street in philadelphia. we also know, at the time of that shooting, the victim's 25-year-old mother and 3-year-old sister were at home.

one person describes the traumatic scene of seeing the frantic mother rush out of the house clinging to her 4-year-old daughter, who had just been shot. >> i told her, what happened? she goes, she got shot. the kids were playing upstairs. and next thing you know, she said she found her baby laying on the floor like that and ran outside. >> reporter: witnesses say doctors and nurses from a nearby clinic ran to help before medics arrived. but it was all too late. the child was pronounced dead a little after 1:00 p.m. at the hospital. those living in the area are stunned and trying to make sense of it all. >> it's just crazy, crazy. it's a shame. it's a little angel. >> reporter: and so tonight back out live, a family and community heart broken tonight. we can tell you that police recovered a weapon. we don't know whose weapon that is. also, we don't know who pulled the trigger. so tonight, the investigation continues. live outside hahnemann hospital, gray hall, "channel 6 action news." rick? sharrie? >> all right, gray. thank you. two major decisions came out of the supreme court today. one was a major win for civil

rights advocates. the other a blow to the white house. >> in a 4-3 decision, the high court upheld the admissions program at the -- program at the university of texas which factors in race. that outcome comes just months after the death of justice antonin scalia who opposed affirmative action. >> in a second decision, the court deadlocked barack obama's measure for undocumented immigrants. he called it a setback but vowed to push forward. >> sooner or later immigration reform will get done. it's not a marry if. it's a matter of when. >> more on the fallout of the immigration ruling. we turn to the lana at the supreme court tonight. lana? >> reporter: good evening, rick and sharrie. protests are spilling out across the nation as people are reacting to the supreme court's decision or, some may say, nondecision. outside the supreme court today, a sense of sadness and anger

among protesters. [ chanting ] the eight-member supreme court deadlocked, unable to render a decision in the challenge to president obama's executive order that would have granted legal protections to family members of u.s. citizens living in the u.s. illegally. republicans felt vindicated. >> this is a win for the constitution. congress, not the president, writes our laws. and today, the supreme court validated that very core, essential fundamental principle. >> reporter: the president vowed to make it an election year issue and maintain his administration would not prioritize those deportations. >> we're going to have to decide whether we're people who accept the crument of ripping children from their parents' arms. or whether we actually value families. and keep them together for the sake of all of our communities. >> reporter: while his executive order has been defeated, the president will still try to offer his protection. >> congress doesn't give the president enough money to deport all 11 million. so what the president confirmed today was there was still some

prioritization. they've always said their priority was people with terrorists, people with criminal records, but not people who work hard and have family members they support. >> reporter: and the president also reiterated in his address to the nation that the fact that the supreme court was deadlocked occur because the senate has consider his nominee merit garland. reporting live outside the supreme court, lana zach, "action news." >> thank you. also in washington today, democrats ended their sit-in on the house floor more than 24 hours after they started their protest. [ applause ] the group was tieing to force a vote from republicans on gun control. many gop leaders called the protest a publicity stunt. early this morning, republican house members even voted amid the chaos on a zika funding bill, then acted to join the house into next month. meanwhile, a bipartisan bill

by susan collins of maine survived a motion that would have killed it but it fell short of the margin needed to pass on the senate floor. david muir on abc news will have more on developments in supreme court and capitol hill coming up on "world news" at 6:30 tonight right after "action news at 6". philadelphia congressman chaka fattah has resigned from the house of representatives effective immediately. fattah was convicted on nearly two dozen counts and a federal racketeering corruption charge case last week. the democrat was planning to stay in office until october 3rd but then drew heavy criticism. officials say fattah's capitol hill and local offices will remain staffed until his replacement is elected. the democratic national convention begins in philadelphia in just about a month. and today, the aclu filed a law shut against the city seeking the right to protest during rush

hour while the convention is in town. city officials previously said they wouldn't issue any permits to march during peek traffic times in center city. civil rights advocates say it's something the philadelphia police have dealt with before and they don't understand why the change now. >> this is something the philadelphia police do all the time with marches and other events in the streets of philadelphia. there is no reason why this event could not be managed in the same way. >> city officials said they have no comment until the law department reviews the lawsuit. well, we got a better look today at some sites you'll see around the city for the convention coming up. the host committee unveiled the 57 fiberglass donkeys that will be scattered around philadelphia for the democratic convention. each is painted by a local artist. and each represents a delegation in town for the event. it is a big day for the philadelphia 76ers. tonight, the team makes the first pick in the 2016 nba draft.

>> and all eyes are on brian caangelalo and this all-person selection. a giant draft watch party just got underway there. lots of excite, john. >> reporter: that's right, sharrie and rick. it's been a while since there's been this much excitement over the sixers. gates are just opening right now and fans are starting to come in to this party. we are told some 4,000 free tickets were gobbled up in just 48 hours. clearly, a lot of anticipation over what a number one draft pick could mean for the 76ers. the stage is set and food is ready to serve at the draft party. eager fans who lined up early couldn't contain their excitement over the 76ers having the number one draft pick. >> i'm happy to finally, like, win games next year and we have a chance to win. that's a really nice feeling. >> reporter: as old ben franklin watches over the party, all eyes, however, are on another ben, former lsu forward ben simmons, who many believe will be the sixers' choice.

of lot of speeds in the 20s near the street road interchange. that luckily has been pushed out of the way. remnants of a truck fire on the new jersey turnpike in burlington county are still slowing things down south of exit 6. and it's jammed once again this afternoon on the admiral wilson boulevard eastbound because of the emergency construction by the old air circle. the good news with this is the construction should be cleared out tomorrow night. we'll check it again, rick and sharrie, coming up in the next half-hour. >> okay. thanks, matt. there's still much more ahead on "action news at 5." an animal attack in burlington county. coming up at 5:30, why police in south jersey are on alert after a man captured a fox that bit him in his own backyard. but first, in "healthcheck" tonight, why doctors are saying a little pain could go a long way when it comes to keeping your kids from getting the flu. cecily? well, rick, it's a bit on the muggy side right now. lots of clouds could get a spotty shower or thunderstorm tonight. but will it all clear out in time for the weekend? i'll have the answer in the accuweather forecast when

good news here. stocks made their biggest gain in a month today on the heels of a key vote in the u.k. investor confidence boosted companies across the board.

the dow jones jumped 230 points. that's nearly 1.5% up. the nasdaq was up 76 points and the sbp500 was up 27. in the u.k., polls just closed on the so-called brexit vote and some are worried about the role mother nature played in voter turnout today. thunderstorms and flooding caused travel problems as people around london had head home from work. that's when many people were expected to cast their ballots. nearly 46 million of the country's 65 million residents are registered to vote. "healthcheck" tonight. there could be a major change in flu vaccinations this fall. some health experts say kids should get shots, not the less painful nasal spray. >> health report and registered nurse ali gorman live at the "action news" big board to explain. hi, ali. >> reporter: hi. many kids are not going to like this but an advisory committee with the cdc has voted to not recommend the nasal spray flu vaccine because studies have

shown it wasn't very effective the last three years. the nasal spray vaccine uses a live weakened virus. when it first came on the market it was said to over the same or even better protection against the flu than the shot. but this year it showed only 3% effectiveness. the shot was 63% effective. experts don't know why it isn't working. for now they're recommending kids getthe shot this year instead. there's another small sign of progress on improving american's eating habits. obesity among kids in philadelphia dropped slightly in 2006 and 2013. 1 in 5 students between kindergarten and 12th grade in the city are still obese. but the robert wood johnson foundation says healthier nutrition standards in schoolles plus efforts to make healthy food more available do seem to be working. and finally today, mosquito control agencies around the area

have ramped up their efforts this year in light of the zika virus and also just to continue the fight against west nile virus. but they say, residents, you need to play a big role. al spray in delaware last night to kill adult mosquitoes, but the spray can't reach where they breed. that's in standing water and containers in the yards and on patios. the biggest target this year in delaware and elsewhere is the asian tiger mosquito which is already known to carry the west nile virus. >> now with the spector of possibly them being implicated in the spread of zika virus, there's even double concern to try to address and focus on tiger mosquitoes. >> the department of new orleans resources says residents should check around the house daily and get rid of any standing water no matter how small it is. trapping, sorting and checking millions of mosquitoes every day. and so far, there have not been

a jury said led accept zin will not -- led zeplin said they they did not lift the riff from wolf song "taurus" recorded nearly three years earlier. lawyers for wolf's trust argued both guitars jimmy page and singer rob eart plant had access to that stopping. they're asking for a songwriting credit for wolf and millions of dollars in damps. philadelphia mayor jim kenney said part of his day putting the spotlight on equal access to bike-sharing programs. kenney opened at the inaugural better bike share conference this morning in west philadelphia. the conference run by the better bike share partnership will focus on a range of topics related to bike share programs including payment, pricing, and community partnerships and runs through tomorrow. environmental lifts in philadelphia sounded an alarm today about the dwindling bee population by pointing out the impact it has on our summer picnics.

can see that the heavy weather is missing us way down to the south. we have tornado watches in effect for southern ohio, parts of kenneth moton, west -- kentucky, west virginia. you can see how this is whole continuing to push down to the south and the east. that same system spawned 16 tornadoes in illinois last night. i'm just trucking some dark tracking some pop-up activity. not everyone is going to see it. but you can see we do have one batch of heavy downpours approaching flornt just to the south of trnd right now. another one near writestown. maybe a brief thunderstorm this evening but not getting what they're seeing down in virginia and across the midwest. we do need the rain, though. the drought monitor, this is short-term impact showing that the lehigh valley and central pennsylvania is abnormally dry. new york, parts of new england now in a moderate short-term drought. so we really could use some

steady rain, but doesn't look like we'll be seeing any of that in the foreseeable future. temperatures right now, warm, typically warm. 84 degrees in philadelphia. 84, the normal high for this time of the year. atlantic city airport, 84. wilmington, 83. and trenton, 82 degrees. and also, a little bit on the muggy side. so the call from accuweather for tonight, it stays muggy overnight with a few spotty showers and thunderstorms. nothing widespread. i don't expect any severe weather. 67 degrees in philadelphia. 68 in cape may. reading, 60. and trenton, 63 degrees. so future tracker showing, as we enter the evening hours, i really think the best chance of seeing some showers and thunderstorms will be south and east of philadelphia later on tonight. we clear things out for the morning tomorrow. but this boundary is draped across virginia. so what this will do is bring more clouds south of philadelphia and tomorrow afternoon, again, we could see a spotty shower again mainly south and west. so the getaway forecast for tomorrow down the shore, 75 degrees with a mixture of clouds

and sunshine. philadelphia, spotty showers possible. mainly dry. partly sunny skies, 84 in the poconos, looking pretty good. sunshine with just a few clouds and a high of 76. so the five-day at 5 showing tomorrow still a little bit unsettled with some clouds, a spotty shower. 84 degree, but look at what happens over the weekend. sunny, 87 on saturday. sunny, 90 on sunday. monday could have some afternoon thunderstorms, 88 and tuesday, the heat returns with a high of 90. but today is a great day to go to smithville, new jersey, and mel ilsa, what did you guy me? you're so generous? >> reporter: i mean, i've been doing my fair share of shopping, cecily, and that's what you can do here in historic smithville. we're about 15 miles north of atlantic city. you can see all of these gorgeous shops behind me. i've got so olive oil. they've got a peanut butter cup company. and rick and sharrie, had is not making it back to the studio. i've got chocolate-covered strawberries from sweet thing. and i'm going to take a ride on the old smithville railroad.

hello again. monica's off. sharrie williams joining us tonight and here's what's happening on "action news" this evening. a jury has reached a decision in the trial of a montgomery county man accused of breaking into a home and raping a child. one local county is increasing its emergency preparedness. find out who's being trained in case there's ever an active shooter. and orlando continues to offer support and help ten days after the massacre at the deadly nightclub. people in burlington county, new jersey, are on alert after a rapid fox attacked a man. the animal was captured but police say there could be more. >> nora muchanic talked with the victim about how he was able to cap you're the fox. >> he comes running up, just smashed in the head. >> reporter: john campbell is describing his recent encounter with a rabid fox that attacked

and bit him as he worked in his backyard. at first, the animal wasn't aggressive. he thought it might be a mangy cat or dog. but that changed quickly. >> so he jumped up and hooks me like that and that's where you get the bite. it's like a big cut like gouge. when he finally let go of the skin, he was still on a -- pull out like that. >> reporter: john had to punch, kick and fight hard to get away from the fox, which looked similar to this model. he says it kept coming after him like a zombie. >> he wasn't crazy. he wasn't foaming or any of that typical stuff. just kept trotting up with his mouth open trying to jump up and bite. >> reporter: finally campbell was able to escape when the fox got its leg caught in this fence. john was on his way to the emergency room when he notice nd the fox was still hanging around. he thought it might make sense to try to trap it in his garage. >> he come zipping right around the door after me. jumped over him and slam the door shut, caught him. >> reporter: that's when police and animal control took over. >> they put it in a cage, but it was very, very violent and

nasty. so in those cases, animal requests was to destroy the animals. >> reporter: when it tested positive for rabies, campbell had to immediately begin several round of shots to prevent him from tracking the disease. rabies can be fatal untreated. >> it's five individual series. >> reporter: authorities are warning people to avoid close contact with foxes and all wild animals who can carry the threat of rabies. john campbell wishes he'd realized sooner it wasn't just a cute little creature passing through his yard but a rabid animal that would attack. in edgewater park, i'm nora muchanic, "channel 6 action news." protests have been peaceful today after another baltimore police officer was acquitted of all charges related to the death of freddie gray. today, a judge found ceasar goodson not guilty on all charges in gray's death. goodson is the officer who is accused of giving gray a "rough ride." gray was left unprotected by a seat belt in the back of the van last year. he died from his injuries after

slamming into the van's metal walls several times. goodson is the third officer charged in gray's death to be found not guilty. four other officers still have to go to trial. "world news tonight" with david muir will have more on the case including what the decision can mean for the other officers who still have to be tried. you can watch that tonight at 6:30 following "action news at 6". nearly two weeks after the massacre at an orlando gay nightclub, officials have released a new way for victims to get help. today, the city opened the orlando united assistance center just blocks from the pulse nightclub. the center will offer everything from counseling to financial assistance. the goal is to provide the victims with the long-term recovery services that they need. the mayor of orlando says the new center will stay open for as long as it takes. tomorrow, youngest victim in the massacre will be laid to rest here in philadelphia. the viewing for 18-year-old akyra murray will take place

friday morning from 8:00 until 10:00 at monumental baptist church at 50th and locust streets. funeral services will follow at 10:00 a.m. she will be laid to rest at mount peace ceremonitry. murray graduated from west catholic prep a few weeks ago and was a standout scholar and basketball star. the montgomery county sheriff's office is improving its emergency preparedness by having county employees undergo safety training. today in more no istown, the sheriff's office announced that both civilian and law enforcement employees are learning what do in an active shooter situation. county employees are also learning the best way to evacuate if there is a shooter and possible place -- in possible places where they could hide if necessary. a montgomery county man has been convicted of breaking into a home and raping a 6-year-old girl as she was sleeping. today, the jury found oscar herrera guilty on six charges against him. last november, herrera broke into the family's home at the hatfield village apartments. the young girl's brother was

able to wake up their parents, who called police. herrera was arrested a short distance away. no date has been set for his sentencing. delaware state police are searching for the man who stole an atm from inside of a gas station in newark. happened early saturday morning at the valero gas station on pulaski highway. police released these pictures showing the suspect and the van he used to get away. if you recognize him, you're asked to call police. well, it's that time again to see what's going on down at the shore this weekend. >> melissa magee is live in smithville, new jersey, tonight. and you don't have to bring rick any strawberries, but i want some. >> just one. they're gone anyway probably. >> reporter: i don't know if it's going to make it back because they -- they are gone. we've moved on to other things. it is so cool down here, guys. we're in smithville. it's historic smithville, the area that we are in. and it's valley green. they've got about 60 shops, places to eat.

and also places to lodge as well. check out this cute little sign i found that pretty much sums it up during the summer season. it says, in jersey, we don't go to the beach, we go down the shore. hello. that is what we do here down in south jersey. or in this case we head over to smithville. and we head over to their man-made lake meone. if you're not in smithville, there's a lot going on this week and down at the shore. check it out. ♪ looking for some seafood? head to tuckerton, new jersey, for the seafood and music festival. you can fill your plate with fresh clams, crabs, scallops and shrimp. there's even local bands, boat rides and even live demonstrations. the festival is this saturday and sunday from 11:00 a.m. to 5:00 p.m. it's just $8 for adults and $5 for kids ages 5 to 12. a small price to pay for an all-day event and family fun.

if you're in sea isle city, check out the food truck festival. all of the yummy goodness will be parked at kicks mcnutley's at 63rd and landis avenue. in addition to food, there's also craft beer, cocktails and don't forget to leave room for dessert. the festival runs friday and saturday from noon to 8 and sunday noon to 5:00. cruise into ocean city for the annual antique auto show. more than 300 vintage cars will be on display for car afficionados. you can tour the tabernacle grounds from 9:00 a.m. to 2:00 p.m. followed by a boardwalk parade. the event is this saturday. the first weekend of summer is officially here. so make it a good one, and have some fun down at the shore. oh, my gosh, i totally for got, this is the first weekend of summer so we've got to make it a good one. guys, here at val green in smithville, they've got a peanut

anyway. in 95 near delco, the problems continue, rick and sharrie. they're trying to upright the overturned truck from several hours ago. haven't been successful yet. but they're working on it. and the ramping 95 northbound with 420 remain shut down as a result. we're also seeing extra slowing in the northbound lane the whole way from the state line north to this point of 420 as you head toward the airport. new crash in london grove township, chester county, near baltimore pike near lake road where it comes in with 41. and we still have that construction blocking the right lane on thee 09 northbound giving us a big old jam once again this afternoon coming away from ambler. stick with limekiln pike or 611 as alternates. it's night market tonight so a bunch of closures including chunks of 12th and 13t 13th streets until about midnight. and in pennsauken, emergency convucks on the admiral wilson buffalo vard and 38. so jammed up here once again this afternoon. sharrie, back over to you. >> no more ammunition for rick. >> sorry. i'm sorry.

volkswagen has agreed to pay about $10 billion to settle claims from its emissions cheating scandal. most of the money will go to compensate 482,000 owners who have two-liter diesel engines. those vehicles were allegedly programmed to cheat on emissions tests. some owners could get as much as $7,000 depending on their car's age. right now there is a gag order on the case but a judge expected to officially release the details of the deal sometime next week. meteorologist adam joseph joining us now. i was hoping for some rain today on my lawn. >> mine's turning brown and i'm like, please. >> there's something called a sprinkler that you can turn on.

thursday night and nba draft party is getting underway in center city philadelphia. and democratic lawmakers end their sit-in protest over gun control. but the big story on "action news" tonight is unspeakable tragedy in north philadelphia. a 4-year-old girl has been shot to death. it happened in the 1800 block of north 20th. and at this hour,s me are trying to sort out exactly what happened. we do know that the child's mother and 3-year-old sister were at home when the gunshot -- gun shatt -- gunshot rang out.
