suburb of st. paul. >> castille was killed while sitting in a car last night. reynolds says they were pulled over because of a broken headlight. she live streamed video on facebook moments after the shooting. she says that the officer opened fire said he had a license to carry a fire warm and reached for his license. and that they did everything the officer asked. >> they did not check for pulse at the scene of the crime. they did not check to see if he was breathing and immediately rushed their colleague off to the side and comforted him. >> castille's death comes one way after another deadly police involved shooting. that was in louisiana, alton sterling who was block was

killed by two baton rouge police officers. they have launched an investigation into his death. president obama released say statement saying all americans have to be troubled by the shooting of both men and we have a serious problem. local advocates will gather for a march at the philadelphia convention center and that is set to start at 5:30. in other news, bill cosby is back in a montgomery county courtroom. asking a judge to either throw out his criminal sexual assault case or force his accuser to testify before trial. a decision could come any moment from now. vernon odom is live with the lightest. >> reporter: good afternoon rick, we expect within a few moments a ruling by the montgomery county common pleas judge after a motion by cosby's

lawyers trying to get the charges dropped. and they may have to go back to another hearing but that was their courtroom maneuver today. another day in court for bill cosby, this was a defense bid to have the sexual assault charges thrown out. the grounds insufficient evidence at his may hearing. his lawyers challenged the decision by prosecutors that kept his accuser, andrea constand off the witness stand. now former temple employee after drugging her. the montgomery county d.a. says they can confront the accuser at trial when constand must take the witness stand. cosby's lawyers say he is being treated unfairly here. and says it was based on hearsay

wilmington 90 and dover 92 and trenton 90 and we have got due points across our region in the low 70s and that really cranks up the feel like temperature. the heat index. 98 in philadelphia and 95 in trenton and 99 at the atlantic city airport and in dover, it feels like 102 degrees, this is a good day to find the air conditioning and drink lots of water. we have not been getting much water falling from the sky. it's a slight jog to the north and that took most of the activity with it and rolling off the coast in northern new jersey, we saw a few spotty downpours, not providing much relief and the excessive heat warning continues for the i-95 metro area through 6:00 tomorrow evening. that is the area that will see the highest heat indexes tomorrow around 100 degrees, it will feel 95 to 100, the place

off and there was just suvs and detectives and blanks and e mexico ts and fire department. and that is not all there when someone just passes away. >> the block is quieter today just a trio of investigators. 45-year-old shannon o'rourke was founded in her home by an acquaintance. authorities say it's a homicide but not how she was killed. neighbors say that o'rourke worked at a local printing company and was a pet sitter. they were friends with her niece who often stayed at her home. >> very kind and welcoming to anyone who she meets and just a great friend. >> i don't see how anyone can try to harm her or anything. she is a nice person to me and laid back and everything. i mean it's just terrifying it happened right next door.

more on the dnc security plans in philadelphia coming up in our next half hour. uber has struck a deal with philadelphia to operate legally in the city throughout the summer. officials with the ride sharing service and the philadelphia parking authority were on hand for that announcement today. the deal was prompted by the recent disruption in septa's regional rail service and the upcoming democratic convention. before that uber was being fined for operating without the proper permits but that will not be enforced until after september 30th. officials say that with so many visitors, everyone including taxi drivers stand to make big profits. >> everyone including uber agreed to a stand down agreement and that doesn't mean anything about us enforcing it. cab drivers may not be happy but

from our new jersey newsroom, the coast guard is investigating the death of a recruit that collapsed at a training center in cape may. he collapsed after completing a

mile and a half run as part of a physical fitness assistant. and was rushed to the cape may medical center where he later died. recruits of all military branches undergo examinations before enlisting. turning to business now verizon is giving customers more control over their monthly data plans but it comes with a cost. the nation's largest wireless carrier is introducing their version of an unlimited plan and a new safety mode that eliminates fees but cuts speeds down and a data boost that gets rid of throttling, at a cost, and all data for free but it expires after a month. and now closing numbers, the dow down 22 points and the nasdaq up nearly 18 points and

the s&p 500 not a lot of movement down nearly 2 points. wendy's now says that the security breach it suffered is larger than first thought. they announced that 300 stores were hit by hackers in the fall but today the company says it's more than 1,000 locations that were affected. hackers were able to access card numbers, names and expiration codes on debit and credit cards. and some cards were used to make fraudulent purchases at other stores. wendy's has posted additional information on their website for those that have additional concerns. now for the accuweather forecast. time to sweat if you head outside. lets head to cecily tynan who knows how hot it is out there today. as we step outside it takes your breath away. you appreciate air conditioning, it's tough out there. taking a look at the center city

sunday and monday 88 and guess what, the middle of next week i'm tracking the run of some heat and i'm talk about that in the full accuweather forecast. >> we have breaking news to get here at 4:00, this is in reference to become bill clinton bill cosby, the judge has denied the motion, the question that the charges are dropped. that means that bill cosby will stand trial for the charges that were filed against him. again this is breaking news the judge denying the defense's motion to request that the charges be dropped again bill cosby he will stand trial and this ruling coming down of course from the judge in norristown, pennsylvania, where this is happening. the lawyers filed this appeal with the hopes of getting the case against him dropped but that will not happen. these charges the judge has ruled there is enough evidence

involving two african-american men are sparking protest and the country demands answers about what happened. >> they argue that these are not isolated incident. the latest. philando castille was killed during a traffic stop and his girlfriend life streamed the incident and saying he was shot while complying with the officers request to take out his license and registration. >> and alton sterling was killed in baton rouge, louisiana, video shows him being pinned to the ground and then shot. while these shootings played out more than 1,000 miles from here they are close to homes for our area. advocated have planned peaceful march here to condemn the

shootings. >> in our culture and men in particular have no value. their lives, i'm very upset and very hurt. >> police arrested a dozen protesters in center city on tuesday as they protested the death of alton sterling. the coalition for black lives matters was one arrested. he says the target will be on philadelphia with the democratic convention coming. >> we are going to shut philadelphia down when the dnc comes, it's amazing we have not heard anything from hillary clinton or bernie sanders, you want our vote but when it comes down to black and brown bodies being murdereded in the street you are silent. they say the incidents have an indirect affect on the department when it comes to policing. the key is building positive relationships with the public before bad things happen.

was the intended target. and police have charged a teenager for shooting an 11-year-old girl in the chest. the teen was playing with a gun when it off inside a home on it's 1600 block of lloyd street in philadelphia. at last check the 14-year-old victim was in stable condition. police in newark have released new surveillance video of a man wanted for two attempted abductions, he is seen here walking around a parked car. two female victims say a man put a chemical soaked rag over their mouths and tries to abduct them. it was on east main street sunday night and early monday morning. philadelphia police have arrested one of three men accused of robbing a west oak lane grocery store. that 26-year-old tyrese shaw is charged with robbery and other

offenses. he went into the grocery along the 2600 block of north 20th street. and they are accused of grabbing a box of cash and getting into a struggle with one of the employees. crews in south philadelphia are working to repair a water main break. chopper 6 hd was over the intersection of 5th street and schneider avenue and the break is not impacting any customers in the area, and the intersection is closed so the 6 inch pipe can be repaired. it's thursday and that means "action news" is down at the shore and today we are in north wildwood where they are getting ready for a big barbecue contest. we know who likes to be around the food. melissa magee is live now giving the competing teams a helping hand i'm sure. >> that is right sharrie and rick, i can't feel official enough without the tongs in my hand. we have ourselves a competition ladies and gentlemen, so on my left we have mikey's and he is

the delaware office of highway safety is taking a stand against drunk driving, today it

aggravated sexual assault. this is the second judge in the cosby trial, ruling there is enough evidence in the case to try the comedian. now, bill cosby was in the courtroom today as the decision was handed down. his attorneys argued that all the evidence presented against cosby is hearsay, and the statement made by the accuser by police read into the court record by a detective. and he has a right to face his accuser andrea constand in court and to cross examine her, but the judge rule there had was enough evidence at the preliminary hearing for cosby to stand trial. and at the trial constand will take the stand and answer questions then. here is what
