assault trial will be allowed to hear the phone call cosby made to the mother of his accuser. a judge ruled the call is admissible as evidence. cosby's attorney went to court to block the call, arguing her mother recorded the 2005 phone conversation without bill cosby's permission. since she was at her home in canada, the judge ruled canadian law dies. sounds like a dirty old man with the sex acts he performed on their daughter. a 33 foot long humpback whale that is dead will stay on the beach overnight until officials can deal with it tomorrow morning. the marine mammal center says there are no obvious injuries to the 2-year-old male humpback. it weighs an estimated 20 tons, it appears e mansuated.

they did not say it intentionally beached itself. a pastor's wife in northeast philadelphia is getting attention tonight for taking down an armed attacker with her own weapon. the 66-year-old suspect allegedly confronted pastor robert cook, his wife and their 12-year-old son about this time last night. >> i was definitely in fear for our lives. i didn't want to kill the guy, i wanted him to drop the gun and get away. that is why i fired the first shot i aimed toward his lower body. >> the wounded suspect fled. the pastor chased after him. he was eventually caught by police. the weapon he used turned out to be a nail gun. as police try to track down the killer of an 8-year-old camden

girl, a woman got in the way of their investigation. she is now charged with providing a false alibi for a person of interest in that case. authorities believe multiple shooters opened fire on south 8th street at 8:30 on wednesday, august 24th. in the cross fire, a bullet struck gabby in the head on her front porch. she moved out of the home saying it is too painful to live there. a $76,000 reward is being offered. a second child died from a car crash. she died at lehigh valley hospital. 5-year-old rayvon robinson was killed the other day and four others injured. the driver of the nissan lost control, hit a guardrail and was hit by two oncoming cars. police say they found open containers of alcohol in the nissan.

pennsylvania lawmakers are considering a new way to put the brakes on -- debate installing speed cameras. speeders would be fined $150. they have red light cameras, but the road is still one of the most dangerous roads in the country. it accounts for 1 in 10 traffic deaths in philadelphia every year. call it friday night fright. tonight, a terrifying holiday tradition opens its doors. it may still be summer, but hundreds of folks are thinking halloween. jeff chirico joins us live from the first night from terror behind the walls. hi, jeff. >> reporter: as if this 200-year-old prison isn't creepy enough, my new friends are upping the fright factor once again.

an ohio man sus specked of being a serial killer. sean grate was captured after a woman he abducted called 1911. they found gray and the bodies of two other women in the home. he led police to another body. in a controversial move, penn state is set to honor joe pater paterno. the events celebrate the 50th anniversary of his first win. the school is under fire for honoring the late coach. paterno was fired from the job after his former assistant, jerry sandusky was arrested for child sex abuse. paterno was told as far as at 1 1976 he was abusing a child. we'll breng you complete
