suburban station. first, jeanette reyes is at the sheridan downtown hotel where everybody has been looking for a breakthrough. developments, anything but a breakthrough? >> reporter: everything seemed encouraging until moments ago when talks ended and negotiators stormed out. tempers flaired in the room to want, talks completely broke down. the issue, the pensions. they cannot come to an agreement and what it means for the riders as the strike goes into day three. no news may be good news. they are talking through a mediator and making progress. congressman bob brady has acted as the go between and is hopeful a deal will be reached. >> they are talking. when they had a ten-day strike,

they weren't talking. >> reporter: the sticking points haven't changed. neither side has given in. they are looking for changing to a pension. both are costly issues up against a tight budget. >> i talked to the governor. there's no money there. i talked to the mayor, there's no money there. >> reporter: the biggest concern looming is the countdown to election day. traffic on november 8 looks anything like the last couple days, voters are looking at a long day commuting to and from work with less time to hit the polls. >> they should be concerned, i'm concerned. i'm the party chairman. >> reporter: the only good news is they are planning on returning to the bargaining table tomorrow. they are going to continue talking. election day is on their minds. they are hoping to get it resolved. by then, the breakdown in the talk is certainly not encouraging. live in center city, jeanette

"action news" will be on again early in the morning, beginning at 4:00 a.m. to bring the latest developments on the septa strike and how it is impacting the morning commute. the med ya elwyn line was halted for hours due to a traffic collision during the evening rush hour. the train struck and killed someone near the angora station in southwest philadelphia. service didn't resume until 6:30. bill cosby was back in court. his lawyers told the judge his eyesight is so bad, he cannot identify his accusers. the trial will help the defense look at evidence. the attorneys are also trying to suppress cosby's decade old deposition from a relatedil case arguing he never would have testified under oath if it could have led to criminal charges. cosby is scheduled to go on

trial in june for drugging and molesting the woman whose picture you just saw, temple employee in 2004. former employee. the judge has not yet said when he will rule on the motions. >> josh huff is expected to play against the giants on sunday. no doubt, he will face serious consequences after being stopped with a gun and marijuana on the walt whitman bridge. dann cuellar has the latest on this. >> i apologize sincerely. it's not who i am. >> reporter: yesterday morning, eagles wide receiver was pulled over for speeding on the new jersey side of the bridge. according to a court complaint, the officer who pulled huff over smelled marijuana inside the car. huff handed over marijuana and told the officer, he had a gun in the driver door pocket. he offered this explanation on why he was carrying.

johnson, 2% for jill stein. three polls in pennsylvania are all in agreement, showing clinton maintaining an edge over her republican rival. quinn pack has her ahead 48% to 43%. cnn/orc43-44 and monomouth showing clinton up by the same margin. hillary clinton told voters in las vegas to imagine what life would be like if donald trump becomes president. for hispanics, she said it would mean having a president who did you want see you as american. for black voters, it would mean having a president who believes their lives are consumed by, quote, crime, poverty and dispair. clinton campaigned in arizona competing in a normally very red state. donald trump continues to focus on florida.

in pensacola he showed more discipline, refusing to respond to clinton. instead, trump predicted a clinton victory would trigger a constitutional crisis. e-mail practices while she was secretary of state. trump narrowed his deficits to where pennsylvania governor said today and these are his words, i am definitely nervous. malania trump will make her first speech of the campaign since the speech at the rnc. this is tomorrow and will deliver it in berwyn. abc news learned it is being written by malania with help from conway. the process began tonight. they are leaving the board of elections in east falls being deposited at nearly 1700 polling
