preliminary injunction on an emergency basis. it expects to have a hearing on this petition sometime in the next hour or so over at city hall. the focus is not specifically on election day as many of us thought but it has a wider focus that the transit strike constitutes a clear and present danger to the health safety and welfare of riders and citizens of philadelphia. it alleges that five classes of the public have been unduly harmed. the first class would be those who are in the school districts and the school children some 52,000 school kids use septa normally when it's on strike it means those school kids have to cross through crowded intersections. the poor of the city who cannot afford a car and can in the afford using a taxi. the disabled on election day as we say election day is included in all of this it would be that voters would have difficult time getting to work and finding enough time to get back to vote and then the fifth category would be medical patients. now, as we say they're hoping to get an emergency hearing

strike. septa today filed a lawsuit in the court of common pleas seeking an injunction to end the twu local 234 strike asserting that it constitutes a clear and present danger to the health, safety and welfare of our riders and the citizens of philadelphia and the region. in the lawsuit, septa notes that the strike has caused people to miss critical medical appointments, is making it impossible for some disabled residents to get to facilities for special he tea care and get assistance with fundamental life care matters. it's causing students to miss school and presents a risk to citizens' right to vote in the november 8 election. septa is asking the court for an injunction ordering twu local 234 employees to return to work immediately to alleviate the devastation

caused by the strike. now, we had hoped to have our general counsel here to explain the process and answer questions. unfortunately, he's in court right now. my understanding is once this is filled he will be assigned to a judge for a hearing and once that hearing is set, we will present evidence and testimony to the court. it has been assigned to judge linda carpenter. the union has been served and this is the latest that we have. for the sake of our riders, employees and our taxpayers, we have to get this done. too much is at stake. thank you. >> will you take a brief question or two. >> yes do did you find that negotiations have gone sour at all [inaudible] the last day

continuing. >> hearing has been assigned but not set just yet. in the meantime we are following a developing news out of burlington county new jersey today where two brothers are accused of murdering their roommate. they were arrested after police found the victim's body buried in the backyard of a house they all shared together in lumberton. new jersey correspondent nora muchanic just stepped out of court today. he she joins us live now with the brand new details here. nora. >> reporter: hi there brian. it was a first appearance for the brothers via video hookup where a judge continued their bail at half a million dollars cash each. now, the unemployed brothers remain behind bars as investigators work to determine the motive for this disturbing crime. >> oh, my god, just, you know, unbelievable. >> reporter: this man lives near where the house where this bodies was buried in the

backyard. authorities charged two brothers into live in the house with his murder. 24-year-old brian costello and older brother 27-year-old christopher. >> i -- shocked. i don't know what to say. never think they would do something like that. speechless. >> reporter: the victim has been identified as 23-year-old justin cube boys who -- dubois who lived in the house with the better. residents say they stopped seeing him around the neighborhood. police went to the house with a search warrant yesterday and discovered dirt in the backyard that had been disturbed. when they began digging, they found dubois' body. one neighbor spoke to us but didn't want to appear on camera. >> there is obviously some drug activity that's for sure. the whole neighborhood is shocked to say the least. this is lumberton. this doesn't happen here. >> reporter: neighbors say they mind police for years about the steady flow of strangers in and out of the costello house but they never imagined he what was happening there would end up way body buried in the backyard.

>> a little scared. i have a seven-year-old. you know, i try to keep him -- try to keep him, you know, safe and stuff like this, it really hits home. >> reporter: again, the motive is unclear. you can certainly expect investigators will be looking at any connection to drugs. now, an autopsy was scheduled for today but so far officials have not said exactly how the victim was killed before he was buried in that backyard. live at the courthouse in mount holly, i'm nora muchanic channel6 "action news." sharrie. >> nora, thank you. jerry sandusky was back in a courtroom today fighting to have his child sexual abuse convictions overturned. a man who claims to have been the young boy that was seen being abused by jerry sandusky in a penn state shower 15 years ago testified in today's hearing. it's the first time the 29-year-old has testified in the case. the former penn state university assistant football coach is serving a 30 to 60

year sentence for sexually abusing 10 boys. no decision was made in today's hearing. >> from our new jersey news room today, a verdict was reached in the bridgegate trial. a federal jury announced that the two defendants, two former aides of new jersey governor chris christie are guilty on all counts. bridget kelly christie's former deputy chief of staff and bill baroni a christie appointee to the point authority of new york and new jersey both convicted of creating an epic traffic jam at the george washington bridge for what prosecutors called political he revenge. now, governor christie was never charged in the plot and has denied all wrongdoing saying he knew nothing about the scheme. prosecutors called it payback for when fort lee's democratic mayor didn't endorse christie. today they said they're still investigating who else is behind this. >> because what they have done is so far over the line and is illegal that we have to seek them out and we have to see

across the scudder falls bridge south of that accident scene just south of 332. on the northbound side there's construction again today at the scudder falls bridge so one of the two lanes is blocked there as well. elsewhere in bucks county on the ramp from 95 northbound to 413 a crash and downed light pole partially blocking that ramp. bottom line route one the any other so super highway is going to be a better bet than 95 through bucks county inform princeton route one southbound a crash past meadow road taking out the left lane. this is 95 in delco. we had a northbound accident by highland avenue gone now. the delay is starting to thin. in christiana by the hilton a crash involving a bicyclist along churchman's road at highway one. watt watch out for emergency crews there. again this afternoon delays across-the-board on the septa regional rails worst we're seeing at this point is about 22 minutes. let's grab the ipad do the commuter report on this finally friday afternoon near conshohocken crash on the blue route northbound just north of the schuylkill. and just 14 miles per hour there. we'll check it again brian,

coming up in the next half hour. >> all right, see you shortly matt. thank you. we've got breaking news out of new york city right now where two policely sergeants have been injured in a shooting in the wrong. the officers were rushed to jacoby medical center and one is said to be critically injured right now. this is video from moments ago at the scene where dozens of police officers remain in an active investigation but the suspect was killed in an ensuing police shootout. officers were responding to either a burglary or a moment invasion at the time but the circumstances of that shooting are unknown right now. >> federal investigators say they have found numerous safety violations into how new jersey transit operates its commuter trains. the executive director of nj transit disclosed the findings to lawmakers during the state oversight hearing today. the bile violations include a lack of on board emergency tools and working fire extinguishers on some of the trains. today's hearing was pushed
