talks after the court hearing for septa's injunction request. that hearing was to have been held at 9:30 this morning. then there was one last push to have a little shuttle diplomacy and they had a deal. >> i feel like it's christmas. like it's unfortunate that getting like a right of transportation back. >> reporter: relieved riders as city transit gradually came to life. first came the subway and the market frankford line. then trolleys then early afternoon buses started rolling in. >> it's a good thing they're running. >> reporter: overnight talks almost stalled. septa was due back in court today trying to get an injunction to force the strikers back to work but sources say representative dwight evans pushed for a little more shuttle diplomacy. there were tweaks made and then a deal. >> we believe disagreement is fair to all our employees and our customers and our taxpayers. we know that the strike has caused hardship for thousands and we sincerely regret the disruption. >> reporter: over the

weekend both the governor and city hall signaled they backed the idea of an injunction to force strikers back by tomorrow's election. did that put pressure on the union. >> we were there for a week trying get the job done and we got it done. >> reporter: because it must be ratified no one is officially talking about settlement terms but sources say it does give unionized workers an enhanced pension. union members will have to pay more for health insurance. as for a fare hike one was canceled this year. it will be needed next year. >> there will be fare increases but that's in the legislation now that we have to do fare increases every two years or three years. >> reporter: riders were curious about the unused portion of their trans passes. >> we going to get refunded having the monthlies and we bought it before the month and like it's like six days we missed out of the monthly trans pass. >> reporter: well, the answer is yes to that septa announced it will issue a credit voucher for the unused portion of those passes to be used toward the purchase of a

subway running again. right now trains running every 10 minutes. on the broad ridge spur it's every 20 minutes. that service resumed at noon today. market frankford line is back up and running bullet not quite as frequently as normal. every six minutes is your service there right now with no stops at fifth street and independence mall. that's because of the clinton rally tonight. more on that in just a second and trolleys also resumed service but again, it's limited service. full service should be running by tomorrow. on the septa regional rails it's looking a whole lot better than it was pretty much all of last week. but already this afternoon we are seeing some 10 to 20 minute delays on some of the select trains on the regional rails. now to that clinton rally which is the other big traffic story tonight. it's right on independence mall so already portions of market street between fourth and seventh portions of fifth and sixth street are blocked off and already we've got gridlock around center city not because of the strike this time but because of the rally tonight. also keep in mind throughout the evening especially the end

clinton was in pittsburgh this morning ahead of her major event tonight in philadelphia. and republican donald trump will be in scranton in less than two hours, all part of his marathon day. trump will hit five states in 24 hours. he started his day at this rally in sarasota florida. recent polls show the the presidential race there is a dead heat. trump told supporters the system is rigged and the way to quote beat the rigging "is to go out and vote. from florida trump flew to this rally in raleigh north carolina. his next stop is pennsylvania at 5:30 today followed by new hampshire and then app late night 11:00 p.m. rally in michigan. while trump himself was not in our immediate area, one of his top surrogates was. rudy giuliani talked to voters at the collegeville bakery in montgomery county. "action news" reporter vernon odom will have a look at how important pennsylvania is to the race for the white house coming up in a live report at

4:30. meanwhile the two candidates vying for pennsylvania's senate seat are campaigning across the state rallying voters and taking last minute jabs at one another. first northeast philadelphia where incumbent state senator republican pat toomey visited the fraternal order of police lodge. he met with law enforcement and members of the fire and paramedics union. >> we have an election to win tomorrow night. and we're going to do it and what we're not going to do is we are not going to send another ethically challenged tax hiking liberal who doesn't take our security seriously and that's who katie mcginty is. >> reporter: toomey has five on the campaign stops in western pennsylvania on his schedule today. meanwhile, democratic candidate katie mcginty started her day as we mentioned at the university of pittsburgh at a rally with hillary clinton. mcginty says she's ready to unseat incumbent state senator. >> stop wall street toomey with his bad policies voting against renewable energy jobs,

around. a beautiful shot here. a little ripple along the delaware a little bit of breeze out of the north that brought in some of those chillier temps but above the ben franklin bridge here not really a cloud in the sky. temperature-wise a little below normal but again pretty prefreshing. 58 in allentown, 56 in reading same for wilmington. dover at 54 degrees. 53 in millville. lower 50's at the shore so again a very cool evening will set up to be cold night across much of the area but high pressure in control and as you can see, not a cloud anywhere along the i-95 corridor all the way west into the ohio valley. you have to head over the open waters of the atlantic where you get that colder air to kind of hit that relatively warmer water and that creates those cold air cumulus clouds you see developing just off of the coastline. so, for tonight, 36 in wilmington, 31 in reading, 30 in allentown so you do see some numbers at or below freezing here. millville at 32, dover 38 degrees, a lot of stars but

again, seasonably chilly and in fact, for some of the suburbs we could see a little frost tomorrow morning in new castle county as well as delaware county in pennsylvania. but here's that voter's forecast. a high tomorrow in philadelphia we're going 69 degrees. first thing in the morning a chill at 41. lunchtime 64 degrees, 3 o'clock near that 70-degree mark. 6 o'clock 63. and at 8 o'clock when the polls close across our region temperatures will quickly fall back into the 50's given that very early sunset now. future tracker six at 8 o'clock here tomorrow evening again as the polls close, just a few high clouds coming in from the north and west but as we get into the morning hours of wednesday, some rain will be arriving in time for the morning rush on wednesday. much need rain but again, getting a little bump in the road here at the early part of the week. the middle part of the week and then by wednesday afternoon you can see some drying to puncture into those northwestern suburbs but still a rainy afternoon wednesday south and east.

i'm katie mcginty, and i approve this message. >> ♪ >> a fire that started with a car in the garage ended up engulfing a home in wilmington. the action cam was on the scene as firefighters tried to knock down the flames in the stone wall development. officials say a woman who was inside at the time was injured here. no word at this point of her condition or just how this fire started. meanwhile in philadelphia man is under arrest for allegedly setting a house on fire while his mother and relatives were still inside. the fire broke out early yesterday in the grays ferry section of the city. 29-year-old keith pane is now charged with attempted murder and arson among other things much police say he doused the kitchen with lighter fluid. his mother another woman and three week old baby had to be rescued from an upstairs bedroom. all three victims were taken to the hospital and they are expected to be okay. >> chopper6 was over a dramatic rescue this morning.

brian we'll see you later. >> bensalem high school students weighed in on the presidential race during a mock election today. teachers set up these fake voting booths inside the auditorium and asked the the teens to choose between donald trump and hillary clinton. many of them said they have been paying very close attention to this contentious campaign. >> i think they have some very interesting choices for office but i voted for who i thought was the best in what we were given. >> i think it's much crazier than other years but it's nonetheless an election. it's going to be great for our country. >> the more they're involved the better off they're going to be in the future and the better off we are in the future. >> notice those students held it close to the vest about what they did but here are the results results. hillary clinton got 58 percent of the vote donald trump got 32 percent. gary johnson got 7 percent and the green party jill stein, came in with 3 percent. >> no word if a write in for brian taff on that one. >> not a chance. >> all right. hundreds of local students

over to independence mall for the clinton rally and already this afternoon we are seeing a lot of congestion on streets like eighth street here by the roundhouse. that's because there's a box that's blocked off already around independent mall. it's basically arch down to chestnut, seventh to fourth, all those streets are shut down in preparation for the big rally tonight. if you're not headed to the rally i would stay far away from the independence mall area. again, septa city services are resuming service, not quite as frequently as normal and we are seeing delays again this afternoon on the regional rails. worst one at this point is 20 minutes. we'll check it again, brian and sharrie, coming up in the next half hour. >> all right, very good. see you then my friends. thank you. still to come tonight not everyone's job provides a 401k savings plan. up next we'll tell you what to do if you're in that category.

dome of high pressure in that control voiding much of the eastern part of the country here without any cloud cover at least east of the ohio valley, tennessee valley and this is our weather maker, in the form of a cold front working area of low pressure along that front to come in here for the middle of the week. but for tonight, it's mainly clear, seasonably chilly below freezing in the suburbs, 41 for center city and those light winds will remain on the variable side. as we get into election day here tomorrow, lots of sunshine from start to finish, a little chilly in the morning, 41 degrees. at 10 o'clock, 55. jumping to 65 right around that lunch hour so if that's the only time you can escape from work, hey, it's a good thing here tomorrow 'cause that's the peak of the day with the high temperatures between 1 o'clock and 4 o'clock and then by 7 o'clock your temperature will start to dip below that 60-degree threshold. front coming from the north and west but again that holds off for tomorrow. 69 for a high with a very mild afternoon. as the low pulls through -- the cold front pulls through

low pressure will develop along that front and that will help to enhance the rain a little bit on wednesday, so kind of damp and dreary for the middle of the week, about a quarter to a half an inch of rain here on wednesday before we dry out on thursday. the exclusive accuweather 7-day forecast a morning chill tomorrow and then really a delightful afternoon, near 70 degrees. only 58 on wednesday, some steady rain especially late morning into the afternoon but then behind it it is breezy but sunny on thursday as the temperatures stay below average or at least a degree or so below, 57 degrees and then bright on friday, the temperatures go back up to 63, winds will start to increase ahead of the next system and that will bring a brief blast of winter on saturday. it's dry but our highs are only in the 40's. wind chills could be in the upper 30's especially in the suburbs throughout your saturday but then that's gone. we go back a little bit above normal going into late sunday and monday staying dry and around 60 degrees.
