moments ago the bucks county da announced he could charge the customer with a crime but decided he would not. it was around 10:00 last night around closing time when two masked gunman walked in pizza in levittown. >> everything got crazy. >> the only people inside of the shop were co-oper alex and employee and customer whose identity is withheld. the da says that as one gunman pointed the gunman in the owner's face the other gunman knocked the customer in the head with his gun knocking him to his knees. >> when the suspect turned his head for a moment. the customer pulled out a weapon and shot the suspect that had hit him killing him. >> the gunman that die said

identified at 24-year-old sean rose and the injured gunman is the 22-year-old brother, justin rose. and the owner says that he can't thank the customer enough. >> to me, right now, he is became part of the family now. our hero. >> pretty much a hero. >> two interesting notes about this case. two guns on the left of the photo, are the actually weapons used by the suspects and the customer's gun on the right. the one is a very real pistol and the others are air soft despite having the look of a glock .45 and the customer's permit to carry a concealed weapon is expired. >> he is a lifelong law abiding citizen, you get credit for that. and had the gun solely for his

own protection and thank god he did last night. >> the other suspect remains in critical condition. the customer is now a local hero from bucks county. >> all right thank you. a chester county high school teacher's aide was arrested accused of having sexual contact with students. as sherry mull ford was walked into a district office, that she the mother of two had sexual contact with two boys that attended unionville high school. the same school she served as a teacher's aide several times. one student says he met her outside of a party and had sexual contact in a parking lot and the other says she gave him alcohol. >> they went to a restaurant and

had illicit sexual contact outside of the restaurant. we don't know how this happened. but the suspect's husband showed up and at the end of the day gave the victim a ride home. >> in delaware three people are facing multiple drug related charges after a drug bust at a motel in dover. it started at the dover inn. police responded william niburg and anthony fountain coming out of a room where they suspected drug activity was happening and police found more than 70 bags of heroin on them. when searching their room they found a womanabatha corown. and each suspect is held on $21,000 bond. >> from our new jersey newsroom. casinos at trump taj mahal and

know that doesn't bode well for the evening ride heading towards the sixers game at a crawl on 95 southbound from tasker on down to the accident scene at broad street. one of several red zones on the big picture along 95 and several on the schuylkill in fact. single digit speeds westbound by city avenue and trying to get to the schuylkill on the westbound vine, now we get word of a crash westbound approaching 76 taking out the right lane. and an accident on the base of platt bridge and traffic is stopped coming off the platt into south philadelphia. if you are coming away from the airport use the girard point bridge and 95 and away don't use 95. meanwhile in hatfield by the produce junction a crash at lynn hart road just 12 miles per hour there. we'll check it again in the half hour. still ahead on "action news" at 5:00, the transfer of power

lesson on political history. former philadelphia governor ed rendell led a discussion about the electoral college and whether it should be abolished. this was part of an essay where the kids wrote about the electoral college and' nouned the finalists for the contest. philadelphia mayor jim kenney talked today about the importance of getting technology into the hands of more children in the city. he took part during a chat in grays ferry, part of the campus of pennsylvania. it offers a place for researchers and entrepreneurs to develop their ideas. kenney encouraged those that use the center to create ways to innovate our city's young people. and the philadelphia school district got $12,000 today to enhance its robotics program. amazon delivered the grant at woodrow wilson middle school. five schools in all will split

time for accuweather tonight. cecily tynan has the story. >> reporter: we have light showers around, stormtracker 6 live double scan showing we have got a weak front pushing through and it's producing some showers, most of them on the light side. we do have one batch of steadier showers moving towards middletown, delaware. crossing route 1 and bridgeton, new jersey, and light showers and another batch also in the northwestern suburbs, it's light but near reading and need wood and pottstown. it's moving out quickly and behind it partly cloudy skies tonight. but even with the cloud cover, temperatures running 6 degrees above normal today with a high of 62 and if you look across

most of the nation, it's unseasonably warm. bismark, north dakota 60 and dallas made it up to 87 degrees. we continue a mild trend and with the mild temperatures, we got one of the slowest starts to the snow season in the nation on record. if you look across the eastern u.s., there is really no snow even eastern canada have you to go to the northwest northern rockies and cascades, but only 1% of snow cover in the continental u.s. and we have a shot of that increasing as we head towards the weekend and a very strong cold front moves in. today though just dealing with clouds and showers this afternoon. satellite 6 along with action radar showing 8:30 this morning. we have plenty of sunshine and now with the front pushing in, some showers again on the light side, they are moving through in the next couple of hours and behind it partly cloudy skies tonight and not as chilly as last night. overnight low is 46 if philadelphia and allentown 39

and wilmington 4-and cape may 48 degrees, tomorrow temperatures about the same as today. feeling a little bit warmer in the afternoon with the bright sunshine and thursday planner showing at 7:00, 47 degrees and by 11:00 already 56 and by 3:00 making it up into the low 60s and loads of sunshine and clear skies tonight. and it's going to get even warmer as we head towards friday and saturday. tomorrow mostly sunny and 62 degrees, friday though nearly shorts weather, 68 degrees and saturday ahead of a cold front, 69 and then the cold front blasts through late saturday night and early sunday and for the philadelphia marathon it's blustery and cold and perhaps a few showers here and snowflakes are possible. in the poconos 49 degrees be monday it stays cold 48 degrees. we are talking about wintry weather, a lot of people are asking me, the biggest question i get what will the winter be like? stay tuned for the winter

continues now with video you will not see anywhere else. a hot air balloon crashed at the mcveigh center in kensington you see the babt that hit the ground right there and children rushed to grab it and stabilize it, lucky nobody inside of the balloon was injured. the balloon was being used for advertising for home depot it was on the way to the store on the roosevelt boulevard and it had a problem and was forced to land, we have an "action news" crew on the way to the scene and we'll bring you updates as we get them. donald trump continues to shape the administration with his closest advisers he had meetings in trump tower again today while rumors swirl about possible fighting in his inner circle and protests for his election continues across the country. we are joined from washington with more.

causy and they had a child together. the detectives say that he forced himself into the home and stabbed the victim several times and marshall was rushed to the hospital for treatment but died. if you know where rashawn is please call 911. investigators are trying to figure out the cause of a fire in the brewery section that killed an 81-year-old woman. it broke out in the 1400 block of north hollywood street. it took firefighters 15 mines to control it but when they got in the home they found a woman lifeless on the living room floor. in king of prussia police are looking for two men connected to an armed robbery at wal-mart. this is video of the suspects walking into the store on friday, minutes later they pulled out guns and demanded cash from employees, just days earlier these persons of interest walked into the store and left.

they may have information about the crime and each time they were in a newer silver hyundai san afay. call upper merion police if you have information. we have an update to a story we brought you yesterday. a north hampton county judge threw out a sands lawsuit. he spent four years in prison for the crime and the judge ruled halfway through the trial that he had no one to blame but himself. a delaware family said they will continue their plans to distribute meals to the less fortunate even though they lost everything they had in a fire. the family was working on a service project for the fairy god sisters of delaware, they were collecting food and storing it in their home but most of that got damaged in the blaze. >> we have lost everything but

rick and monica back to you in the studio. >> nice work. >> time to get a check of the traffic scene out there midweek. >> all right matt. >> things turned pretty unpleasant. look at the big picture a whole lot of red across the map this afternoon rick and monica but a little bit of good news, our crash on the platt bridge at the base of bridge in south philadelphia is off to the side however it's jammed solid coming away from philadelphia international airport. if you head to the sixers game i would use 95 northbound instead of the platt but 95 southbound lets zoom in and focus on that. the crash by broad street by the linc off to the side so the lanes are open but it's a slow crawl south of pens landing on 95 southbound. here in center city they have south street blocked off and local vine appears to be blocked. a protest going on here at 12th and marchers coming north away

from filbert street. and 12th street jammed in both directions and it closes tonight for construction starting at 11:00. a crash on the pennsylvania turnpike eastbound approaching norristown in the left lane. schuylkill is not a better option at 12 miles per hour. and a pair of accidents in delaware, one blocking philadelphia pike in northern newcastle county and use 495 instead but there is a crash on edge more road restricting traffic and gloucester county 322 at corker lane, another accident seen. and a closure at tonight i'll tweet about that coming up. the eagles go back to work hungry for another win, against another tough opponent. and a groom of youngsters will be warm thanks to the generosity of strangers. >> a couple of showers passing through parts of the region we take a scan at stormtracker 6

christmas is still several week as way but the youngsters received the gift of warmth. dozens of coats were given to the kids as part of the driving away the cold program. from the lincoln dealerships and office of health services, the youngsters were happy to model their new coats and smiles around thanks in large part to the auto dealers caring for kids foundation. >> we'll need the heavy coat for a few days. >> the next couple of days don't even really need a jacket it's extremely mild. the tale of two seasons into the upcoming weekend. as we look at that time stormtracker 6 live double scan temperatures in the lower 60s and again we remind ourselves normal is 56 this time of year and a cold front passing through with sprinkles and a few more
