>> and i'm gio benitez in for kendis gibson. we begin with president-elect donald trump's cabinet picks back in the spotlight. >> confirmation hearings get under way for betsy devos, his pick for education secretary and congressman ryan zinke. >> meanwhile, the inauguration boycott is picking up steam led by john lewis. at least 35 lawmakers are planning to sit out and lana zak has the latest. >> reporter: in just three days donald trump will become the 45th president of the united states. and as the nation's capital prepares for the inauguration and the 400,000 expected protesters, a new protest is growing among democratic lawmakers. >> i will not be going. people have not forgotten that he attacked a mexican-american judge, that he attacked a gold star family and now a civil rights icon. i cannot pretend that this is a normal transition of power. >> reporter: abc news has

identified more than three dozen members of congress who say they will be boycotting mr. trump's inauguration. >> nothing has changed since the campaign. you know, i don't think that's something i need to do in terms of celebrating. >> reporter: in movement by democratic lawmakers is being led by congressman john lewis, a civil rights icon who mr. trump dismissed as all talk, talk, talk no action or results after lewis questioned mr. trump's legitimacy. speaking at a martin luther king event yesterday lewis seemed to allude to his fight with the president-elect. >> when you see something that is not right, not fair, not just, you have a moral obligation to do something to say something and not be quiet. >> reporter: republicans though are crying foul. >> i think it's irresponsible for people like himself to question the legitimacy of the next united states president. >> reporter: but most democrats including hillary clinton still plan on attending the inauguration. >> i want to be there visible in the audience. i want to be there at every turn because i want to see i'm going to be an agent for change.

>> reporter: the country tips to be divided about this new trump administration according to a brand-new "the washington post"/abc news poll. it finds that 44% of americans do not believe that mr. trump and his associates are abiding by federal ethics law while 43% believe that tez. gio, diane. >> three days away, lana zak in washington, thank you. donald trump is about to become the first president in decades who has refused to release his tax returns. trump continues to say the public doesn't care about his taxes but our new poll shows nearly 75% of americans say he should release his tax returns. >> trump's health care plan calling for insurance for everybody appears to have taken some fellow republicans by surprise but house speaker paul ryan insists he is on the same page as the president-elect. looking to get everyone access to affordable insurance trump says he won't cut medicare and plans to negotiate with drug companies to lower prices. but, he hasn't offered specifics

on how to pay for the replacement. european leaders are responding after trump again called nato obsolete. he complained that allies are not paying their fair share and predicted more countries would leave the european union. french president francois hollande says it doesn't need outside advice to to it what to do. angela merkel says we europeans have our own fate in our own needs. signs the obamas are getting ready for their new home and movers took some of their belongings into the home they'll rent in d.c. contractors could also be heard inside and there's also a secret service presence there. but the obamas won't actually be staying there on inauguration night. they'll be flying to southern california right after the sear upon for a warm weather vacation. a reminder abc news provides nonstop coverage of his inauguration all day friday starting at 7:00 a.m. eastern. breaking this morning a major milestone in the mystery

of malaysia airlines flight 370. officials in australia say the plane search has been called off after a search of a desolate stretch of the indian ocean found no trace of the plane. the boeing 777 disappeared three years ago with 239 people on board. electrical failure and a fire in the cockpit are among the stheerryes about what caused that crash. also breaking right now authorities in turkey say the suspect in a deadly attack on an istanbul nightclub has confessed. the alleged gunman was captured during a raid yesterday. two weeks after the new year's attack that killed 39 people. the suspect has been identified as a native of uzbekistan who trained with isis. he's believed to have entered turkey in january of last year. according to one official, his fingerprints match those left behind by the attacker. we're learning more about the young american woman who was killed during a nightclub shooting in playa del carmen. the 18-year-old what's college student from denver who worked

to help support her family. her brother described her sister as an artistic and loving person as he recalled their last conversation. >> we were talking about how she was going to come back. she was going to tell me -- she was -- he was going to tell me all about her trip. i didn't know that was going to be the last day. >> investigators say the gunfire erupted when security tried to stop a man from entering the club with a gun. five people were killed. police have ruled out terrorism as a motive. >> heartbreaking for that brother. the winter storm that's made travel a misery in the midwest is moving overnight into the northeast. winter weather alerts in parts of 16 states from colorado to maine. for some it's snow and other areas it's freezing rain. and icy, icy dangerous roadways. >> this is what it could look like in ohio and western new york as well as pennsylvania. on the west coast, california's

you're looking at the wreckage after a private jet skid off a manager runway in freezing rain and burst into flames. the pilot was the only person on board but guess what, he was saved by this town's mayor. the mayor saw the accident on his way to a rotary meeting and helped get the pilot out of the wreckage. the man had only minor injuries. incredible. >> quick thinking by the mayor. three workers had less fortunate occurrence in the florida keys. three workers are dead and a firefighter in critical condition after an accident. >> the victims entered a 15-foot

hole to repair a roadway when they were overcome by toxic fumes. the volunteer firefighter went down the hole to rescue the men leaving behind his air pack because it was too big. offs say he was just overcome within seconds. >> no signs of any pre-venting going and in going into a contained environment where there are gases can be deadly. >> federal safety officials will investigate this accident. this morning general motors is expected to announce a major investment in its u.s. auto plants. published reports say the automaker will spend $1 billion and create or keep more than 1,000 jobs. president-elect trump has been pressuring u.s. automakers to produce their vehicles in the united states but gm officials have previously said the company's plans were made well before that. a study finds there is a reason why so many have hacked diane's accounts. we're making it easy. >> don't encourage them.

judge accused of helping her husband carry out his massacre. she's seen here now charged with aiding and abetting and obstruction of justice. the fbi arresting her near san francisco. neighbors stunned to learn she was living there with her young son. the fbi focusing on her almost immediately afterwards confronting her with video of her and her husband shopping fo. linzie janis, abc news, new york. researchers in florida found displaying bad manners toward your doctor could affect crucial factors including the accuracy of their diagnosis. they estimate 40% of medical errors are caused by rudeness. concerns that thousands of los angeles families may have
