this noon, a third person has died after being shot on a philadelphia street corner. and the police commissioner talks to "action news" in a new interview. and tony romo is handing in the football field for a career in broadcasting. >> and the big story on "action news" is the trial for accused pennsylvania cop killer, erick frein now underway in pike county. he is charged with the ambush shooting of two state troopers one died and one was wounded. it captured nationwide attention and now a small town is center stage for his trial and extra security is in place. john rawlins live at the courthouse in milford pike county. tell us more about the opening statements. >> reporter: well, we just had an opening statement by the prosecution the likes of which i have never seen. it was an audio visual and show and tell. maps and photos and still frames

of the surveillance video of the actual attack on the police barracks and you saw the officers fall in the video in the still frames and the jury heard the first gunshot fired captured on audio tape on a phone conversation not related to the attack and blowups of the defendant's journal where he talked about shooting the two troopers how surprised he was the first victim fell so fast. and here is the scene at milford. a tall screen is erected to obscure the suspect during his trial. erick frein was a wanted man on the run, police searched areas in pike and monroe counties. theal gage is late on the night of september 12 and while lying

in wait of the blooming grove barracks, frein a weapons enthusist using a rifle ambushed two state troopers, killed was corporal byron dickson and wounded was alex douglas. >> he was found hiding in a hangar at a -- and last month 12 jurors and six alternate s wer chosen in chester county. it went for an hour and 40 minutes, the defense's opening statements lasted less than five minutes, the jury was told that erick frein, the defendant would not take the stand but the defense asked the jury to keep an open mind that the point because they would hear from him

on the lengthy video statement that he made with murder investigators in 2014. all that is to begin later on we are in a lunch break later on and the actual trial should begin later this afternoon. >> john, thank you. in other news, police have identified the three men that died in a shooting at a school in north philadelphia. a 20-year-old and 22-year-old and 27-year-old were killed in a hail of gun fire yesterday. a fourth man was wounded and hospitalized in stable condition. police found at least 25 bullet cases on west styles street. and the shots were fired at 3:30 yesterday afternoon while students were dismissed from the saint malaki school from across the street. >> whenever you can be so brazen to fire well over 20 gunshots

and striking four people and anyone could have been around. >> the school was placed on lockdown and no children were hurt. police are looking for two men that fled the scene in a small gray dodge suv. a man's body was pulled from the pond in delaware this morning respect the pond is on the 800 block of warwick road in middleton. authorities don't know who the man is and further tests are needed to figure out how he died. and a sniper accused of targeting people faced a jury this morning. lauren mitchell is facing attempted murder charges. mitchell aregally opened fire in delilah's and it narrowly missed a woman hitting her vehicle twice. all right turning to the weather now the feel of spring is settling in nicely for your tuesday but keep the umbrella close by. sky 6 hd looking live at the ben

franklin bridge, you see the cloudy skies and clouds moving in. and we'll soar into the 70s in philadelphia and the heavy rain is also gone but only temporarily. adam joseph is at the big board with the forecast. >> reporter: i like that sky 6 hd shot it shows you the skies brightening a bit after a cloudy and wetter start and things are drying out at least for now with the only shower up by pottsville and this one heading towards the east. and you may catch that in allentown the next hour. and farther to the west east of pittsburgh and state college there is the possibility later in the afternoon of some of that stuff coming through and maybe a rumble of thunder popping up out of that and later in the afternoon we start to dry and dinner time maybe more sunshine than what you have right now. the wide view on satellite shows a fairview of clouds and there is break up of cloud cover to

the south in particular. you see that where you see the darker shade of gray that is the ground showing through the clouds and once we get the shower through there say chance of additional sunshine in play in the afternoon. temperatures are not a problem since early this morning we were in the 60s and now almost at 70 in philadelphia. and on 70 in millville, wilmington and dover and cooler in some of the northern suburbs. and a breeze from the southwest. and we could get gusts up into the 30s at times later this afternoon. blustery and made out there. and as we roll through the rest of the day 71 by 2:00 and we expect 74 by 4:00 and the high today is 5-degrees around 3:00 and still holding the low 60s by 6:00 and close to it by 8:00. and a mild day ahead and the best chance of showers probably right in here as we get into the later afternoon and evening. probably dry the rest of the

the subway. and seen here the panic moments following the attack. passengers scrambling to escape after the deadly bomb ripped through a subway car in st. petersburg. the train exploded between two stations and seconds later chaos and thick black smoke and the smell of gun powder and the driver's decision to continue to the next station may have saved lives. the driver is speaking today saying it was not time to think about fear, i needed to work. passengers and subway staff dragging out the wounded and the entire subway system coming to a full stop. >> a passenger describing a flash and surprise and screams filling the carriage. 20 minutes later another bomb at a different station. here inside of this black bag

officials quickly defusing it. russian president, vladimir putin, was in town nearby for a meeting with the president of belarus and then the president laying flowers at the scene before speak with president trump and other world leader who expressed their condolences. >> and today another subway is shut down, they are on high alert there and across the country. the battle over supreme court nominee neil gorsuch ramps up as the senate begins the nomination. and the democrats say they will filibuster and mitch mcconnell may use the nuclear option. that includes rewriting rules requiring that neil gorsuch requires a minority votes rather than a traditional 61 votes. >> the nfl draft is still week

as way with the league expecting to take over the parkway. at 12:301 a.m. there is no parking on the south side of pennsylvania avenue. and that restriction lasts until monday may 8th, the first road closures begin on monday when part of spring garden street and the draft begins on thursday april 27th. long time dallas cowboys quarterback tony romo is retiring to start a career in broadcasting. the cowboys are expected to officially release romo, his last touch down came against the eagles this past season. he was hurt and in a backup role for most of the season. he is the all time passing leader but never won a super bowl. there is more to come on "action news" at noon. rescued on the whale.

a new jersey teenager admitted he plotted to kill pope francis on his visit to philadelphia in 2015. alfonso jr. faces up to 15 years in prison. he plead guilty as an adult for providing support to terrorists. and that he contacted someone he thought would be his sniper but that was actually an undercover fbi employee. a cell phone captured a rescue in new york. you see the man go on the track and rescue another man that had fallen on the platform within moments of the next trains arriv arrival. >> i made sure i was safe but the thought should i do this did not cross my mind. >> it's still unclear what caused him to fall from the platform. back here those that shows the commitment to the community war honored at city hall.

ups says it will offer saturday grown service nationwide by later this month. packages previously delivered on

meteorologist, david murphy, is here now. >> by this evening we are dry and then get ready for thursday. stormtracker 6 live double scan shows us that most of the area now is dry and i'll take you in tight on the only shower i'm seeing now and this is that cluster up by hamburg and northern berks county and a little out by lebanon, stormtracker 6 live double scan's live scan passing through the precipitation giving you a live track. and that may push east towards slatington and allentown and shouldn't amount to too much. as we look outside sun is farther south in cape may, there are folks walking along the beach getting ready for it to get warmer over the next month or two. and inland we feel comfortable. 69 in philadelphia and winds from the west-southwest at 14 and cooler down the shore. we'll show you that right now. at the beach in cape may 60 degrees and 71 at a.c. airport and low 70s in millville, dover

and wilmington and cooler up north but the warm air is coming up from the southwest and everyone sees an improvement over the next several hours, future tracker 6 showing you between now and 3:00 not a lot going on precipitation wise and there is a chance of another couple of pop-up showers through the afternoon and evening it's off to the north and east of the area and don't be totally shocked to hear a rum be of thunder but that will not be a super big issue. 70 is the high in the lehigh valley. clouds mixing with sun and spotty shower cannot be ruled out and down the shore some sun mixing with clouds and spotty shower there as well. but dry for the majority of the afternoon. 64 is the high on the beach. in philadelphia 75 the high this afternoon clouds mixing with sun. and while we can't rule out a thunderstorm. winds gusting over 30 miles per hour. 74 by 4:00 and from start to

finish, 7:00, 72 degrees and partly sunny skies. and as we head into the overnight hours, we dip to 52 and clearing out but we are breezy and winds running west 10 to 120 miles per hour. and tomorrow a nice day behind the departing system high of 68 degrees and high pressure ensuring sunshine and it will be warming up and in fact i think we'll bump the high to 68 degrees close to some bodies of water along the river perhaps. and on thursday you see a warm front coming through along with an area of low pressure ain warm front, during the day on thursday we see periods of heavy rain and 1 to 2 inches in total. and windy conditions and perhaps some strong gusty thunderstorms that pops through, future tracker 6 early in the morning, by noon there could be a thunderstorm around more of the same in the afternoon. and the whole thing dies down into thursday evening. that is the day to watch. the seven day from accuweather 75 today and spotty shower cannot be ruled out.

trooper despite the fact he confessed when he was captured. and two men went don't with their plane in the snow covered mountains in utah. three men shot and killed when bullets went flying at an apartment complex in philadelphia have been identified. a group of men were standing around when another group of men came up and started shooting in broad daylight. >> reporter: police have identified the three homicide victims and a fourth man remains in the hospital in stable condition and the shooting happening on this lawn behind me this afternoon and police believe it stemmed from an argument. today a visable police presence in the blocks surrounding a quadruple student. four men shot and three of them died. >> we suspect there is some rivalry between this group and some others,self blocks away. and it's
