saltzman is live in the 4200 block of whitaker. wendy, what is the update here? >> reporter: well, jim, we have now learned there is surveillance video of this incident and police are not releasing it. but by their own account it shows the last shot taken pie this police officer, they say that the male who was about 30 years old was running down this alley way with his back turned when he was shot. >> (screams). >> reporter: the chilling screams ring down whitaker avenue as the family claimed their loved one was killed by police. >> y'all wrong. y'all know. >> reporter: the family says the 30-year-old male wasn't armed and described him as a goodbye but police say he was known to law enforcement. the incident they say started when he was recklessly riding a motor bike down the street and an officer who was driving another suspect to the station stopped him. >> when the officer grabbed him and appeared to feel a weapon he said he, himself, looked the guy in the face and said, don't do it, man, don't

do it. and as if to say don't pull that gun out. >> reporter: and that's when will commission eros says a scuffle ensued. >> it was a very violent encounter initially. this individual then pulls this 9-millimeter out which was fully loadeddism. >> reporter: and the officer shot his weapon. it's the third shot that police are investigating to see if it was justified. >> this happened very quickly, of course, but the one video vantage point is actually showing or depicting the officer firing and the guy is running away. >> reporter: ross says the department it's policy allows police to shoot a fleeing suspect. he warns the video may not show if the male was threatening to fire while he was running away. >> it's no question that from the witness' standpoint the officer had every right to shoot. the question is is whether the other round should have been fired and i don't know. >> reporter: commissioner ross says they are now reviewing this incident as

well as their policies. the male was shot twice, once in the back and once in the buttocks. he was taken to temple university hospital where he was pronounced dead just before 7:00 p.m. last night. live in hunting park, i'm wendy saltzman channel6 "action news." >> thank you wendy. philadelphia police say a repo man got into a deadly shootout with another man in the point breeze section of philadelphia today. the incident happened at 10:20 this morning at the intersection of 18th and dickinson. the worker was repossessing a minivan when the owner called her boyfriend. police say that man showed up and got into a physical fight with the repo man. the situation escalated to a shootout. the boyfriend was taken to the hospital and pronounced dead a short time later. so far there have been no arrests or charges. today falls township police announced the arrest of three people for an arson that destroyed a home in bucks county. the fire happened along stevens road in morrisville last weekend. police say 23-year-old abraham

kieta and two juveniles tossed fireworks at the home. the fire destroyed a truck, a car and an atv. the three arrested for arson along with two other minors are also charged with stealing the fireworks. >> ♪ the prosecution has rested its case in the bill cosby sexual assault trial. the defense will start presenting its case on monday. let's go live to "action news" reporter vernon odom outside montgomery county court. vernon. >> reporter: jim, this cosby case has moved along at a much faster pace than anticipated. the prosecutor did rest their case late today and now the defense will take center stage on monday morning. >> we have not ruled out. >> pushing me over. >> mr. cosby testifying. we are weighing all options imbill cosby's spokesman after court today signaling there may be a sudden change in the did he first strategy. cosby had said he would not take the witness stand.

that brought this response from the civil rights lawyer here to support central accuser andrea constand's case. >> i would say that that is about as likely as any of us leaving for the moon on monday. >> reporter: the prosecution rested today. one of the final witnesses, a cheltenham detective whom read more of cosby's decades old deposition testimony from andrea constand's civil lawsuit against him. cosby admitted giving women quaaludes back in the 70's, women with whom he want sexual relations but earlier in that same sworn testimony cosby claimed he only gave the over-the-counter drug benadryl to andrea constand back in january of 04 in his home. the night she testified he drugged her leaving her incapacitated unable to fend off his sexual advances. the last prosecution witness was a toxicologist who told the court both benadryl and quaaludes could render someone nearly unconscious or a combination of both could even be more potent. as for the possibility of a show biz giant taking the

witness stand, his spokesman had more to saily. >> this is a trial and we have to come up with our counter moves and plans as well. >> if he does testify, he is going to be subject to cross-examination. a very long cross-examination. a cross-examination which could potentially open the door to other accuseers. >> reporter: jim, unless bill cosby does take the witness stand next week the jury may start deliberations as early as monday or tuesday. live at the courthouse in norristown in montgomery county, i'm vernon odom channel6 "action news." >> thank you, vernon. an suv slammed into a downed tree in west deptford this afternoon. officials say the driver was treated at the scene. this happened at 3 o'clock along parkville station road near kings highway. the tree also brought down power lines. the live wires sparked small grass fires along the way. there were plenty of hugs

and hand shakes in smyrna delaware as families gathered to say goodbye to 19 soldiers who are embarking on a 12-month deployment. the national guard, the delaware national guard hosted a departure ceremony this afternoon. the members of the 261st theater tactical signal brigade will spend the next four to six weeks training in texas before deploying for southwest asia. the team will provide communications and logistic support. we first told you about this story last night at 11:00. substantial numbers of parents and family members were locked out of the william penn high school graduation ceremony at the university of delaware. "action news" reporter gray hall has more on the event and lots of reaction tonight. >> reporter: jannell flake still can't believe she was locked out of her son joshua's william penn high school graduation in delaware. >> it was a lot of people standing outside. there was some parents banging on the doors to the bob carpenter center and a lot of

them were crying. flake says it is something that just should not have happened. viewer video shared with "action news" shows she was not alone. she says hundreds of others shared her heartbreak and disappointment. they were all locked out of the university of delaware's bob carpenter center which held the graduation. they were told it was filled to capacity and even though they had tickets they they would not be allowed in. >> i don't know what they can say. i can't get that day back. my baby has graduated and i didn't get a chance to see him walk across the stage. >> reporter: rollins did not find out until after graduation that her mom was not inside the ceremony. >> the only pictures i have is me crying with my mom. like i was so sad. i didn't even look happy. my graduation basically was that ruined when i found out my mom didn't see any of it. >> reporter: her mom is still in disbelief and admittedly angered. >> she cried, i cried and we were upset. we were very upset. >> reporter: superintendent dusty make says blame is on the university of delaware. >> we gave out approximately 4800 tickets. i know their capacity a little

over 5600. so we were well within the capacity. >> reporter: blake says the university never took an official head count on made a visual assessment that the facility was overcrowded and then locked the doors. he says when he found out this was happening the ceremony was already in progress. >> moving forward we will make sure this doesn't happen again 'cause it's not fair to our communities, it's not fair to our students and it's a milestone that you can't get back. >> reporter: we did reach out to the university of delaware for a comment. we have still not heard back from the university. that is the latest from here in new castle gray hall channel6 "action news". >> and they are off. members of delaware law enforcement ran with the official torch of the summer special olympics last leg through wilmington today. the games are getting under way at the university of delaware. the run helps raise money to support the special olympics. delaware law enforcement has raised more than $6 million so far. a philadelphia teenager was again honored for his heroism today.

this is when temperatures climb up into the 90's and the heat index especially on tuesday will be a factor. tuesday is when the heat index will be soaring close to 100 degrees. that's the way it's going to feel. so you really have to take it easy drink lots of water find air conditioning. we're really not used to this heat especially since we're so cool and you definitely also need to make sure your pets have a safe cool place to stay. right now this friday evening it's just gorgeous out there. philadelphia 82. allentown, trenton, millville, dover, reading, lancaster popular number, brigantine 81 degrees. and cape may getting that land breeze, not a sea breeze, 80 degrees. that ocean temperature 63. so satellite and radar showing we're in between systems right now. we had that low pressure that was off the coast yesterday, tossed some clouds our way. that's moved out. there's another system moving north of cleveland. between the two we have a sinking air so that's why we're seeing all the sunshine. that's why humidity is pretty low, dewpoints generally in the upper 40's, kind of

squeezing out all the moisture in the atmosphere but this upper level low will be sneaking through early tomorrow morning. so, future tracker showing you wake up at 7 o'clock in the morning, we got a lot of clouds especially areas to the north and there could be some showers, perhaps even some thunderstorms up across the poconos but it doesn't last long. by the afternoon, good amount of sunshine and temperatures will be up into the mid 80's, about 87 degrees in philadelphia, 83 in allentown and even in the low 80's down the shore. this high pressure sets up and this creates that classic heat pump, that bermuda high with a clockwise winds around that high pressure pulling up the winds out of the southwest. sunday, monday and tuesday, temperatures in the mid 90's and we're looking at a good possibility of record warmth. it's going to be close on sunday, forecasting a high of 94, the record 95 set back in 1986. monday we will likely tie the record high of 95 set two years ago and tuesday could be a record breaker, forecasting

96. the old record 95 set back in 1956. so, this is a great place to be down the shore. enjoy it tomorrow. mixture of sun and clouds, 78 degrees. on sunday, temperatures in the 90's inland right on the beaches, though, 81 degrees, loads of sunshine, that ocean temperature a comfortable 63. and heading to the poconos for race weekend, tomorrow morning a shower, thunderstorm possible, otherwise partly sunny, 78 degrees and for the pocono 400 on sunday, it will be sunny and warm with a temperature of 84. so, the exclusive accuweather 7-day forecast, partly sunny, warmer tomorrow, 87 degrees. sunday hot, more humid, 94 degrees. on monday, record tying heat, 95 and tuesday, the peak of it, 96 degrees, a new record high that heat index close to 100. and then a back door front will sneak in on wednesday. that will bring us a chance for some thunderstorms, break the heat wave, 86. thursday drops down to 82 and friday it's warm and humid with some scattered thunderstorms, 84 degrees.
