home and that is when they were told to go back and try some more. it's thursday night and the big story on "action news" tonight is bill cosby's jury. is it deadlocked or hopelessly deadlocked? how many longer will judge steven o'neil tell them to keep trying to reach a unanimous verdict. anchor monica malpass is outside of the montgomery county courthouse. what is the situation there right now? >> reporter: well, good evening jim the question can 12 jurors come together and make a unanimous decision on at least one of the three charges against bill cosby. it's a complex case and points of view of what happened at his cheltenham home. that is where the rub comes in, celebrity actor bill cosby's legacy is on the line and a

former temple employee that wants to be vindicated on her account. vernon odom has more on what is happening today. >> reporter: good evening monica, this morning judge o'neil nixed a defense try at having him declare a mistrial here and a number of of experts are saying he is considering that option at this hour. as he and the world wait to hear from this jury. the cosby jury seven men and five women chosen from the pittsburgh era have not been seen since late may. they told judge steven o'neil they are deadlocked after 30 hours of deliberations, saying quote we cannot come to a unanimous consensus on any of the three counts. that is three counts of aggravated sexual assault. >> we hope now that the three

courthouse. >> thank you. and outside of the courthouse earlier today there was an argument between cosby supporters and a third cosby alleged victim they got into a war of words behind me and a security guard asked them to move from the steps to the sidewalk behind them. and sara bloomquist joins us now she talked to experts on what is going on in the jurors' minds. they are not surprised they came back deadlocked. they were deliberating all week long really, and long for any jury. the judge will try to press them to come to a unanimous decision on any or all of the charms. cosby jury is deadlocked. they have not been able to reach a verdict as deliberations continue through a fourth day. >> i think there is one or two people, my guess that have their

heels dug in so to speak and no the in agreement with the other ten people in the room. >> he is a defense attorney not associated with the cosby case and it's up to the judge on howl to press the jury from pittsburgh to reach a verdict. >> it's subjective it's up to judge o'neil to make the decision i can't see him go past tomorrow. they are deliberating for approximately a week and that should be enough time to make a decision. >> she sits in on many criminal cases, she agrees to push the jury for a unanimous decision. judges have a lot of discretion. eventually the judge uses the common sense and will decide. how to proceed. >> you see it going into next week. i don't see him torturing them like that. i think that would be a bit

much. >> the legal experts we talked to said that often juries will reach a verdict even after coming back and telling the judge they are deadlocked. the legal experts we spoke to today had differing opinions as to whether or not this jury could actually come to a verdict at this point. >> thank you sara. the jurors by the way have not ordered dinner yet but a snack, water ice they are still in there deliberating and following judge o'neil's instructions to keep at it. back to you jim. >> other news at this hour. a suspicious piece of mail prompted a homeland security investigation, several employees of the mail room reported eye irritation at 11:00 this morning. police say that the envelope that they came into contact with was wet and had a sweet smell to it. the newsroom was closed and the building remains open for business and there is no word

yet what investigators found. in washington house republican leader steve scalise shot in the explosion of gun fire yesterday morning at a congressional baseball practice is june going a third operation today. he was one of four people shot. shot in the hip and the bullet fractures bones and injured internal organs, wendy saltzman is live at nationals park in washington where the the congressional charity baseball game will go on tonight. wendy the game even more significant than usual. >> jim, that is right you see people are starting to pile into the stadium. the game is expected to start at 7:05, and it could very well be soldout. that is because this is now about the strength of america and how everybody can come together from both sides of the aisle. after the shooting the ticket sales skyrocketed to about 500 tickets an hour. today congress members are taking the field with their

jersey comes in. nora muchanic has that story. >> reporter: in south jersey 57,000 children are at risk of going hungry every day. officials at the food bank say they don't know where their next meal is coming from. >> they have access to free meals in school and now they are not there any more. a shortage of food. >> they are going without because they are not aware that the programmed exist and we are here to help them. >> the summer meals program, the program provides free mealed to children 18 and under. volunteers pack breakfast, lunch and dinner and snacks that go out to parks and camps that host the program. >> they know that they can come and they will have something to eat during the summer if they don't have enough at home. it's making a difference in their life.

members of congress are on the field at nationals park in washington getting some pictures taken. they just took part in a prayer before their annual charity baseball game and much drama and much significance with this coming a day after that shooting yesterday at practice. steve scalise the third ranking republican in the house of representatives still in critical condition. and we have two players from this area ryan costello and pat meeh meehan involved in this game tonight. lets get the accuweather forecast for the tri-state area from cecily tynan. >> certainly beautiful tonight. but humidity is increasing as well as temperatures. stormtracker 6 live double scan

getting a break before the workout for the next four days, with showers and thunderstorms moving in and tonight feels really nice out there. it's comfortable with low humidity and temperatures that is where we should be for this time of year. down from the high of 83 the normal high for this time of year. and the poconos 71 degrees and trenton 78 and cape may 70 degrees with the ocean temperature 68 it's cooler along the shore with the wind off the ocean. satellite and radar showing we are dealing with a good amount of sunshine but if you look out to the west you see the system pulling in showers and thunderstorms and most of this activity tonight will lift up to the north and that is where the warm front, the warm front to the north brings us increasing humidity and also the threat of some showers and thunderstorms. future tracker 6 showing 8:00 tomorrow morning, the cloud residence in place and a few scattered showers and i don't think we'll see all that much activity and you will feel the difference in the air mass.
