packed beach and the man who jumped in to warn others. good evening and thank you for joining us on this busy saturday. i'm cecelia vega. in for tom llamas. we begin tonight with that breaking news in the bill cosby sexual assault case. a hung jury. the judge declaring a mistrial after jurors made it clear they could not overcome their deadlock. no verdict on whether the man once known as america's dad drugged and molested andrea constand. but now from the da a promise to retry the case and soon. we have been covering this story from the beginning and she starts us off tonight from that pennsylvania courthouse. >> reporter: legendary comedian bill cosby walked out of court raising a triumphant hand a free man for now. the man once known as america's tv dad greeted by scorn and support, some chanting free bill. [ chanting ]

>> reporter: after more than 50 hours of deliberations, the jury of 12 hopelessly deadlocked. seven men and five women, including 2 african americans, unable to come to a unanimous decision. cosby leaned back in his chair and closed his eyes. >> what was mr. cosby's reaction? >> relief you know 52 hours of having 12 perfect strangers deliberate on your fate has to be a strain the likes of which i can't imagine. >> reporter: a cosby representative read this scathing statement from cosby's wife, camille. >> how do i describe the judge? overtly arrogant and collaborating with the district attorney. how do i describe the counsel for the accusers. totally unethical. >> reporter: the district attorney immediately announcing plans to retry cosby. >> our plan is to move this case forward as soon as possible. >> there are a lot of cases where you get a mistrial and the next time around prosecutors are able to get a conviction. >> reporter: the woman at the

heart of this case, andrea constand, claimed cosby drugged and sexually assaulted her in 2004. cosby claims it was consensual. consta constand's attorney releasing this statement saying in part, we are confident that these proceedings have given a voice to the many victims who felt powerless and silenced." for now it is a brief reprieve for the 79 year old who by many accounts had already been deemed guilty in the court of public opinion after more than 50 women came forward accusing him of drugging and or sexual misconduct. while some have filed civil lawsuits, constand is the only option for a criminal prosecution. for the other accusers, like victoria valentino, the statute of limitations has already run out. >> what is your message for bill cosby? >> you are not off the hook buddy! >> and linsey joins us. from outside the courthouse. we heard the da in your piece vow to try this case again. tonight bill cosby remains out on bond. so how soon will he be back in court? >> reporter: out on bond and

still charged with three counts of felony sexual assault. the timeline, the judge expects it would happen within the next 120 days. it would be the same judge again. >> thank you. we do want to turn to the urgent search under way at this hour in what is called the worst accident in years for the u.s. navy. the uss fitzgerald colliding with a cargo ship off the coast of japan. three sailors injured and seven still missing. the damaged ship towed back to its home port and investigators piecing together what caused that crash. matt gutman has the latest. >> reporter: tonight us ships and aircraft scouring the busy waters off japan for those seven missing sailors. but officials say they could also still be trapped in the wreckage on board the ship. >> we've still got an active search and rescue going on for our missing shipmates. >> reporter: now, a mystery emerging -- multiple maritme trackers show the acx crystal cargo ship

hooking this giant u-turn friday night minutes before nearly t-boning the uss fitzgerald. abc news has reached out to the owners but so far no response. three crew members, including the ships commanding officer medivaced, others treated on board. the collision with the 30,000 ton acx cyrstal in one of the world's busiest shipping lanes seemed to gut the ship's midsection. but the navy said there was also damage below the water line. >> the damage is consequential and will probably take the fitzgerald out of service for months if not years to come. >> reporter: this evening the fitzgerald limped back to port nudged by tugboats listing to its right side. those hoses pumping sea water overboard. this ship, whose missile defense system has become more vital with recent north korean provocation. >> this is a bad mishap for the

us navy because the fitzgerald is one of the most sophisticated ships in the us navy. >> reporter: probably the biggest question is how did a u.s. navy ship with some of the most sophisticated radar equipment on the planet fail to see a nearly city-sized ship bearing down on it especially after it hooked that very conspicuous u-turn. >> thank you. we want to turn to the white house. the first family making their first trip to camp david. tonight it is president trump's personal vacation home mar-a-lago that is in the spotlight. a new financial report shows the club took in millions in profits and that's not all. abc's david wright has more on the president's booming business. >> reporter: today the first family boarded marine one, headed for camp david. it's president trump's first visit to the rustic cabin in maryland, where so many previous presidents have enjoyed quiet weekends away. until now trump has preferred to visit his own properties instead. according to a new 98 page financial disclosure they're

enjoying a banner year. revenues at trump's mar-a-lago club up 25 percent over last year's report. after doubling membership fees after he took office, now $200,000 a year. the club took in more than $37 million. trump's bedminster golf course brought in nearly $20 million. his new d.c. hotel operating in a building owned by the federal government has brought in nearly $20 million since it opened last september. all tolled, trump lists assets worth $1.4 billion. the president must be eager getting away from the clammer surrounding the investigation into russian meddling in the november election. today the associated press sites. unnamed "advisors and confidants" who describe the president yelling at tv sets in the white house, "insisting he's the target of a conspiracy to discredit, and potentially end, his presidency."

some of that aimed at special counsel bob mueller and deputy attorney general rod rosenstein, the man who appointed mueller to lead the russia investigation. >> if president trump ordered you to fire the special counsel, what would you do? >> senator i'm not going to follow any orders unless lawful and appropriate. >> reporter: the president and the president's men lawyering up. even his long time lawyer hired a lawyer. one member of the cabinet says the investigation should run its course. >> i would give him the chance to see if he could do that because if there's nothing there he's not going to find anything anyway. >> david, we know the president has added a new lawyer to his team, john dowd. he has quite a record. >> reporter: this guy is a heavy hitter among his many high

profile clients he defended john mccain and as a lawyer for major league baseball. got pete rose banned for life. >> david, thank you. tomorrow much more on abc's "this week" when martha raddatz goes one-on-one with newt gingrich and the leading democrat on the house intelligence committee adam schiff. an update now on that virginia baseball field shooting some good news tonight. congressman steve scalise regained consciousness and is responsive. speaking to loved ones. his condition upgraded to serious following the wednesday attack. two afghanistan where the u.s. military is confirming u.s. service members have been wounded in yet another insider attack. it happened in the northern part of the country. at least seven service members when an afghan soldier opened fire. the second insider attack in a week reported in afghanistan. now to frightening moments in the choppy seas off cape cod.

a passenger ferry plowed into a jetty, stormy weather possibly to blame. at least 15 people sent to the hospital. nearly 40 others had to be rescued. we pick up the story from here. >> reporter: tonight the incredible images. this high speed ferry slamming into the rocks in hyannis harbor. the boat stuck, taking on water, dozens of people on board. >> we just received a mayday. >> reporter: overnight the water rescue teams evacuating 57 passengers and crew. a coast guard chopper, hovering over the scene, this infrared video showing the moment one injured person was airlifted to safety. >> all of a sudden i just felt this huge jolt, and i flew forward there were people outside who had fallen over and injured their head really bad it was just chaos at that point. >> reporter: those frightening moments captured, passengers waiting to be saved, life vests on. many forced to climb down a ladder on to slippery rocks to

escape the grounded ferry. >> i just don't have enough awesome words to say about all of the emergency services folks that came out. >> reporter: 15 people transported to the hospital. at the time of the incident, the ferry company pointing to strong winds and rough seas. bad weather and poor visibility, likely factors in the crash. but the official cause, still under investigation. cecilia? we turn to the severe weather threat, dangerous winds and hail. the main concern for millions tonight. south of omaha winds over 100 miles per hour. not confirmed to be a tornado but take a look at the video capturing the destruction. abc's senior meteorologist rob marciano is here. a lot of damage in the plains. >> another reactive night. for mid june. the threatening areas will be from kansas city to chicago as it heads into the zone and tomorrow watch these storms develop and roll across the mississippi and ohio rivers that stretch from little rock to louisville to the st. lawrence

river and big time heat building from kansas city back to phoenix. we could see near record breaking high temperatures and this sort of heat, 115, maybe 120 last through midweek. so a long dangerous stretch. >> brutal numbers out there. good to see you. we turn to minnesota where the cleanup is under way after a night of protests. anger in the streets following the acquittal of the police officer who shot castile. found not guilty and was fired from the force. you will remember that controversial killing captured live on facebook by his fiance. to london on the tragic apartment fire is on the rise. 58 people presumed dead but there is mounting anger over ignored warnings about how dangerous that building was. molly hunter is on the scene. >> with the death toll climbing protesters desperately trying to force their way in.

the angry crowd storming this government building. >> we want justice! >> people are missing. people are dead. no one is telling us the truth. >> reporter: residents of the tower had warned of the dangers of the catastrophic fire. the building had no sprink her system. throughout only one staircase, own though the building went through a $13 million refurbishment last year. investigators back in the building trying to recover the bodies now 58 presumed dead. but police say that number could rise. [ chanting ] >> reporter: much of the anger directed at prime minister theresa may under attack for not reaching out to the community sooner. when she finally met with victims friday a mob gathered outside. she fled out a side door and cameras caught her into her land rover. >> this is ridiculous. if you care, show you care. >> reporter: the big question is how many other buildings are vulnerable to this kind of massive fire.

residents want to know they're safe. >> thank you. we turn to the death of hollywood actress carrie fisher. her cause of death ruled in part of sleep apnea. a serious breathing condition that affects millions of americans. here's abc's eva pilgrim with more. >> reporter: tonight carrie fisher's sudden death being blamed in part on sleep apnea. fisher best known aspirin cecilia leia suffered a massive heart attack on a plane in december. >> we have nurses assisting the passenger. we have an unresponsive passenger. >> reporter: a report blaming sleep apnea and other undetermined factors pointing to signs of heart disease. finding the actress had taken multiple drugs, however, that report could not pinpoint an exact cause of death. >> the risk is really when someone is undiagnosed or untreated for sleep apnea and then the risk for cardiovascular disease and death really does go up.
