bostian left the criminal just its center in philadelphia today a free man with the judge saying he saw no evidence of criminal negligence in the crash of an amtrak train in philadelphia that killed eight people in 2015. john rawlins is live outside of the cjc. john, is the bottom line case closed? >> reporter: well, nothing is etched in stone. the ag's office could refile charges and after a short statement. they were looking into such options about this but did not make a decision at this point in time. for now the man that was the defendant in a high-profile case is now not a defend. brandon bostian continued his long public silence letting his

trial react. >> the charges that were brought should not have been brought. and a good judge made sure that justice was done. >> bostian was at the controls of amtrak 188 when it crashed in 2015. blair berman had a few words using his cell phone to call family and the state called first responders and a rail expert the contention was that the defense was negligent and pushing back findings that after being distracted by a rock attack on the nearby septa train it was possible that bostian lost situational awareness. but the judge says it was more likely an accident than a crime. >> brandon bostian is a good man and his heart breaks for the loss of life in this case and the tragedy that occurred but he is innocent.

>> tom klein that represents many of the victims upset by the dismissal saying that eight people are dead. >> one man is aquadriplegic and others have life disabled injuries all because of what was done by one man, brandon box. patrick murphy was on the train. >> the judge said it was an absolute tragedy but an accident. i think it gives some of us a sense of closure but never change the fact that eight people lost their lives on our train that night. >> reporter: again, charges dismissed today by a municipal court judge, the attorney general's office who said they inherited the case after the da's office declined to prosecute. it has the option to refile charges or do nothing. live in center city, john

and the plane brought water and food and emergency equipment and medicine. for the latest on irma itself let go to meteorologist, melissa magee. will we feel remnants of this form? >> in a much weaker fashion. it works its way into the atlantic region but looking at stormtracker 6 live double scan you see the remnants of what was once irma widely spread out in the eastern half of the u.s. and the showers are starting to dissipate and as you go in tighter you see moisture inching closer and closer to our region and a lot of that moisture is falling apart. over the next few days, expect the next few clouds than sunshine. and a shower here or there is likely and a rumble of thunder very little .25 inch to .50 inch of rain and isolated spots could fine more than an inch of precipitation and you'll notice it will become more muggy and

questions but they do not suspect foul play. >> we lost a student here and the details and facts surrounding this is not clear yet only that the death is an end result of a chain of events that cull nated into a medical emergency. he was found unk. outside of the building and pronounced dead the next day at lehigh valley hospital. the college president released a statement reading in part. losing a member of the class of 2021 is a heart breaking start for the year for the newest students in particular. we hope that the community will be helpful to all. >> the baseball team and lacrosse team and basketball team and all the female teams also everyone is trying to stick behind the lacrosse team as a whole and hold the family in our prayers. >> it's awful for everyone

29-year-old delinda williams turned herself in and she dropped her student off in drexel hill last week and two dozen bags of fentanyl fell out of her purse or pocket. williams was charged with possession and reckless endangerment. >> investigator trying to determine what caused the fire last night in wilmington. the fire that claimed the life of archie monroe. vernon odom has the details. >> reporter: archie monroe was a quiet man who lived on this block with his wife donna for more than 40 years, they were highly respected in the neighborhood. and tonight the entire wilmington community is mourning their cruel fate. >> all day wilmington firefighters were collecting samples at this rowhouse fire scene as they try to determine the cause of last night's deadly blaze in the 100 block of west 37th street.

the home of archie and donna monroe, he was killed as he charged back into the inferno trying to rescue her believing she was trapped on the second floor and then jumped into the arms of neighbors. among them jamar warren injured making the catch. and donna remains hospitalized in critical condition and family and friends are mourning archie monroe's cruel fate. >> going in after a person is out of the fire and he goes in to retrieve his wife. that alone shows his character. that speaks for itself. i pray to god, for his wife. she is going through something now and to heal the family. >> they are really good people. really family oriented. just sad. >> reporter: indeed. jim, tonight the fire marshall says the official ruling on the cause will not come until

outside out there in south philadelphia where a lady is painting a picture. we had comfortable conditions once again and temperatures were slightly below average but tonight the phils are back at home taking on the marlins, what to expect for the game the southwesterly wind at 5 miles per hour. the first pitch shortly after 7:00, that temperature of 76 degrees and 10:00 tonight the number drops down to 70. but numbers all in all were comfortable. the high once again. 79 degrees in philadelphia. right now coming in at 78 in the city. 77 for allentown and the lehigh valley. and same in reading and 70 in the poconos. and 70 at the coast in cape may and dover 72. satellite 6 along with action radar showing you it's quiet across the mid-atlantic region but what we are tracking was once irma, you see the moisture starting to thin out across much of the tennessee river valley

and the ohio valley. the rain shield is spreading out and as it does so the precipitation is falling apart as well. the moisture is creeping into the region into tomorrow and on thursday as well. so for the next 12 hours the clouds increase and showers are likely by dawn, we drop down to 60 and 65 in philadelphia for the overnight low and 60 at the coast and the boardwalk. over in toms river we drop down to 55. fast forward into the middle of our work week. 8:00 in the morning, the clouds are starting to spread out across our area. these are the showers from what was once irma. also to the south and west of wilmington as we go throughout the day, 4:00 in the afternoon, spotty, and a quarter inch and half ink of rain and some spots could get higher amounts than that. to the tropics we keep a close

eye on hurricane jose. maximum sustained winds of 75 miles per hour. jose is starting to do what we think it will do stay away from thesy main land. this is the track with jose, it does the loop deloop into the end of the work week and weekend. you notice it's 480 miles north-northeast of the grand turk island. it stays away from the main land and stays in the atlantic on wednesday the big difference is the humidity. it feels different with the moisture overhead. a high temperature of 77. humid on thursday still with a high of 80 and thundershower is likely. and friday clouds and sun and a high temperature of 81 degrees. saturday it's warm and muggy and a high up to 82 and sunday a
