with today's new developments. john. >> reporter: well, hi, guys. well, the authorities set aside time to pick a jury today but as you say new evidence turned up over late last week to the defense altered the landscape here. that prompted the two guilty pleas, one for assault the other for fleeing arrest. as for the man who was the target of that assault he is relieved that things are winding down. >> yeah, just happy it's over. you know, every now and then -- the fact that it's over. >> reporter: in this video from last may michael ryan who has cerebral palsy in the gray shirt walking out of a 7-eleven. he is mocked and then punched in the face by barry baker. until today, baker had claimed while the attack was wrong, the video didn't tell the entire story. his defense, he and michael ryan had traded insults earlier at this nearby pub barnaby's but a check of barnaby's surveillance video and a system that records all patron's photo id's dashed that claim. according to baker's own

news." monica. >> thank you, john. the ntsb trying to figure out what caused a plane crash in montgomery county. that crash happened yesterday afternoon in whitpain township. the plane hit some trees and bushes here before slightly damaging a house. officials say the plane had just taken off from nearby wing's field. a witness to the crash who did not want to be shown on camera saw the plane struggling before takeoff. >> noticed that it didn't seem to be getting the amount of rpm's that it should be getting and then it started to roll down the runway i knew it wasn't getting the full rpm's that it should get because it took most of the whole runway to take off and that plane's a light plane and it should have been off the ground sooner. >> the person who lives at this house where the plane hit was not injured. the pilot has been identified as philip beckner, a 29-year-old from maryland. right now he's in critical condition at penn presbyterian hospital. >> ♪ >> all right, developing news now. tensions are on the rise between the u.s. and north

korea over a tweet from president donald trump. in the tweet posted by the president, he said north korea official "won't be around much longer." that prompted north korea to claim the u.s. has declared war giving them the right to shoot down american bombers near north korean air space. tonight, the white house is insisting they have not declared war on north korea calling the idea "absurd." abc news is tracking reaction in washington as this war of words continues to escalate. david muir will have more on "world news tonight" at 6:30 right after "action news" at 6:00. >> reaction continues to pour in tonight to president trump's attack on nfl players. yesterday about 200 players decided to stand, kneel or raise their fists during the national anthem. some like the tennessee titans and seattle seahawks refused to leave their locker rooms leaving an empty field. nfl players are getting support from some other big name athletes. >> it's unbelievable.

to come together so we can make him feel what he's doing is wrong. >> bayliss also said he hopes the protests will help create change and unity rather than more division. >> turning now to the accuweather forecast and the dangerous conditions around the delaware valley and at the jersey shore. around the region we're dealing with unseasonably hot temperatures. some areas could break records today. and at the shore, seas are rough because of another storm off the coastline. meteorologist cecily tynan is live outside with the first look at that back to work forecast tonight. hey, cecily. >> hi, rick. it certainly doesn't feel like late september. feels like the dog days of summer. we had two days in the 90's, yesterday's high 92, today so far 91 degrees, only 1 degree shy of the record high for the date and the latest pair of 90's since way back in 1970, so this is unusually warm and we are not alone. if you look at the high

temperatures across really the eastern half of the country, chicago 92, cincinnati 87, memphis very warm, 88 degrees. we've got two more days of warm humid air before much cooler air arrives. you can see bismarck, north dakota is 53. raleigh is 82. the reason why raleigh is lower than us is because they're dealing with some clouds and showers thanks to hurricane maria. it's a category one hurricane. it's moving north very slowly and the problem with maria, it's not the wind, it's not the rain for us, it's the fact that it's bringing us more rip currents. that rip current risk continues for the next three days, a very high risk, rip currents proved deadly this weekend so really you want to stay out of the water. the system that will kick maria out to sea is the same system that will bring us seasonably cool weather by the end of the week. i'll talk about that coming up in the full accuweather forecast. rick. >> all right, cecily, we'll see you back inside. thank you. meanwhile hurricane

maria's presence off the coast has created a dangerous situation down the shore. officials say rip currents there are life-threatening. and despite several warnings, rescuers have needed to aid several swimmers who were in trouble. new jersey correspondent nora muchanic has more now from ship bottom. >> ♪ >> it's scary. it's extremely scary. >> reporter: that's how lifeguards are describing ocean conditions the the jersey shore. with the beautiful weather we have been having lots of people have been heading to the beach in the off season. it's natural they want to swim but this past weekend rip tides and rough water claimed three lives. >> it was very dangerous. the ocean was very rough. there was rescues all up and down the coast deaths as we heard and even in ship bottom a couple assists. >> reporter: we spoke by phone with lifeguard. that's him coming out of the water in beach haven sunday after he saved a man who was caught in a rip current in rough water. >> i said this guy's got to be saved or he might die to

myself. you know, it's not something i really relish but i said to myself, you got to do it. you know what to do, then do it. >> i was in yesterday. i got up to here and it just pulls your feet out and the top is knocking you down. it's brutal out there. >> i don't go in. i'm afraid to go in. it's too rough. >> reporter: lifeguards tell us that with storms off the coast still coming, the ocean is only going to get rougher as the week goes on and the danger will increase. >> it can pull you out in a he could is. you get tired and scared and anything can happen. >> make sure when they see it's rough like this they're not going out swimming. they're staying where they can kind of jump around. >> reporter: ship bottom still has lifeguards at selected beaches but most towns don't. lifeguards say swim only where they are posted. that dip in the ocean is not worth risking your life. in ship bottom, i'm nora muchanic, channel6 "action news". >> ♪ >> pat's king of stakes is no stranger to celebrity diners

>> time for a check of that accuweather forecast for your week ahead. >> meteorologist cecily tynan is at the weather center with the very latest on what's been kind of a steamy forecast. >> definitely steamy. temperatures running 16 degrees above average. >> wow. >> but we will be cooling things down as we head through the week. let's head over to the "action news" weather center. we've got bright sunshine. sky6 taking a look live at the ben franklin bridge. just a few fair weather clouds. not only is the temperature up, the dewpoints are really high. this is the kind of air mass we typically see in late july, early august. dewpoints hovering very close to 70 degrees and that's tropical. you add that with the temperature, the heat index, the way it feels, definitely not feeling like fall. feels like 93 in philadelphia, 95 in allentown and reading,

93 in lancaster. excuse me. atlantic city airport currently quite a bit cooler, 81 degrees with that wind off the ocean. satellite and radar showing hurricane maria continues to just drift up to the north. it's about 300 miles south-southeast of cape hatteras. it's not going anywhere very quickly. what this will do is continue pushing to the north very slowly at about 7 miles per hour. then as we get after wednesday afternoon, this is when it makes a sharp right-hand turn, heads out to sea and what will kick out maria is also the same system that will kick out the summer-like temperatures. it's a cold front and that will bring us a big cooldown. but tonight it's warm and muggy. 69 degrees in philadelphia, allentown 65, cape may 68 and wilmington 67 degrees. tomorrow it will be warm, it will be humid but not quite as oppressive as today. we get a -- more of an easterly flow off the ocean so that should keep temps in the 80's but certainly still well

enjoy it. the accuweather team telling us that slight cooldown doesn't come until later on in the week. live at sister cities tonight, i'm sarah bloomquist, channel6 "action news. monica. >> thank you sarah. former representative anthony weiner headed to jail for nearly two years for his role in a teen sexting scandal. he pleaded guilty to having illicit contact with a teen in north carolina. prosecutors said he did send her pornography and got her to touch herself inappropriately on skype. today weiner made a tearful plea trying to be spared prison time. he must undergo internet monitoring and enroll in a sex offender treatment program. >> a 25-year-old man stands charged with murder tonight after a deadly shooting at a church in tennessee. officials say emanuel samson opened fire in the parking lot of the burnett chapel church of christ. he's accused of shooting and killing one woman outside before moving inside and shooting six other people.

more than 40 people were inside the church at the time. officials say a quick thinking church usher helped save many of their lives. a pistol and a shotgun were later recovered from samson's car. a motive is still under investigation tonight. from our delaware news room, state police are investigating after a noose was found hang tag warehouse in wilmington. this photo shows what an african-american worker says he found on the job at rubber rock on edgemoor road. the man who did not want to be identified says he believes the noose was left for him by three white coworkers. he says one of them said they left it but meant no harm. >> he said he didn't leave it intentionally. i believe that he did leave it intentionally as a way to intimidate me and threaten me. he is saying he has been tying nooses since 1994 and one day at work he was bored and decided to tie the noose and he don't know i would take offense to it. >> delaware state police are conducting more interviews with those involved. the investigation is ongoing

warm weather stretching on if you like that summer feeling. many folks hit the shore as well. put their feet in the sand but hopefully you kind of listened to the lifeguards this weekend and you continued to do so this week. i would avoid the water whatsoever. even though on sky6 live here it looks great, it looks great the next few days. if you're going to head down the shore. but i want to point your attention to a danger that's still lurking in the waters and that continued threat of rough surf is going to continue through the day thursday at least. we have that high risk of rip currents continuing. you'll want to stay out of the water and it's all because of hurricane maria just off of the carolinas that's heading out to sea its not a threat to us but again bringing some very rough surf. we've had eight deaths this year in the united states due to rip current risks and we had one death this weekend in north jersey as well. so, again, just be very cautious of that the next few days. in philadelphia, if you're inland you felt the heat and

humidity. it was 91 degrees today, just after 3 o'clock this afternoon. a degree shy of the record of 92 set back in 1970. even the low way above the normal. 68 this morning. our normal is 57 degrees. the record 35 degrees. speaking of records, we had one record tying high today in the lehigh valley. 92 degrees there. not a record but still very hot for this time of year, reading 90 degrees t-90 in trenton, 91 in wilmington and atlantic city a little bit better down there because of a wind coming in off the water, 84 degrees. right now it feels like it's in the low to the mid 90's anywhere between trenton, philadelphia, to the north and west, 95 reading, 93 in lancaster and cape may beach haven, 71 down there. even though that heat index is in the mid 70's, it's still feeling pretty muggy out there as we kind of have that summer soup in play and partly it's because of hurricane maria. which you can see here spinning just off of the

carolinas. may bring high clouds during the day tomorrow but it's bringing that bubble of heat and humidity with it, cold front to the west and that cold front comes through at the end of the week to kick maria out and usher in much cooler air. 65, 69 tonight under a mostly clear sky, very humid as well. as we take a look at the map here, maria will be drifting over that general same location tomorrow, again just high clouds here. hazy, hot, 86 degrees. it does come down from the last couple of days but still well above normal. and on wednesday, one last day of the heat and humidity, 88 degrees. but we can thank this cold front for two things. it will kick maria out to sea and it ushers in strong highs to the north and west with a blast of fall coming in by late week. your exclusive accuweather 7-day forecast, that summer stickiness still here tuesday and wednesday with highs in the upper 80's. 82 it's breezy thursday but that breeze will drop the humidity on thursday and it's much cooler come friday, only 75, a beautiful day here to round out the week.

hit 90 as philadelphians seem to enjoy basking in the early autumn sun in rittenhouse square and it appears this unusual weather will hang around for the first half of the week. let's go to live to meteorologist cecily tynan. cecily, what do the facts and figures say from accuweather. >> jim, we've had two days in a row of near record warmth, not feeling like late september at all. yesterday's high 92, 3 degrees shy of the record high of 95 and today our high 91 degrees, just 1 degree shy of the record high of 92. those records both set back in 1970. so, not a record in philadelphia, although allentown tied a record high of 92. that's the only area with the records but trenton 90, wilmington it was hot, 91, reading 90 and a little bit cooler along the shore, atlantic city airport 84 degrees. but if you look at the high temperatures across the eastern half of the country, you can see it's going to be awhile before we cool down. chicago 92, saint louis 91 but there's a cold front and west
