misfired in a freak accident. he had been deported five times and was wanted for a sixth deportation at the time of the incident. immigration officials announced they will deport the mexican national again. >> the president weighed in, tweeting that verdict is disgraceful adding no wonder the people of our country are so angry with illegal immigration. >> reporter: after more than two painful years for kate steinle's family, a verdict many did not expect. jose zarate found not guilty of murder and involuntary man slautder in the shooting death of this 32-year-old on the san francisco pier in july of 2015. >> we believe the verdict is a correct and accurate reflection of the law. >> reporter: he said he found the gun under a chair on the pier and when he examined it, it sently fired. the bullet ricocheted, hitting steinle as she walked with her

father about 90 feet away. >> our greatest fear is that mr. zarate would not be able to get a fair trial. >> reporter: he weighs as in th country illegally after being deported several times and had multiple convictions. it became part of the national immigration debate. >> from day one, this case was used as a means to foment hate. >> reporter: attorney general jeff sessions reacted, writing in a statement that he would not have been on the streets of san francisco if the city simply honored an ice detainer. the six men and six women on the jury were ordered not to factor garcia zarate's immigration status into their decision. after nearly five weeks of testimony and arguments, it took them six days of deliberating to reach their verdict. >> we will respect that decision. >> reporter: he was found guilty on a firearms possession charge and is now awaiting sentencing on that conviction. kenneth and diane? >> marcy, thank you.

we're looking at a scene from suburban chicago, those flames are coming from a burning car, but get this. you see crews rush in to pull the driver to safety, but that driver apparently didn't want to get out. they eventually did manage to rescue him. police say 71-year-old had just left the scene of a hit and run. he's now in critical condition. two officers were also treated for burns and smoke inhalation. music and movie mogul russell simmons is stepping down as head all his companies after a claim of sexual assault. a screenwriter says in 1991, simmons offered her a ride home, locked the car door and ordered his driver to take them to his house. that's where she says simmons

crucial support from senators worried about adding to the deficit. they're also working on a major new rewrite but holding out hope of passing it today. >> reporter: this is not how republicans were hoping to kick off their tax reform votes. they have to make changes to this bill that are so big and so significant that they called off votes all together last night they say votes will start again today, but we don't know exactly what they'll be voting on or how much the bill changed overnight. the big sticking point is from senator bob corker who doesn't like that this bill increases the deficit by so much, $1.5 trillion to be exact. senators have been working towards a deal to get him on board. they wanted to include an option to raise tax down the road if the cuts don't lead to the sort of economic growth republicans are hoping for. this option had been known as the trigger. but when senators brought the trigger proposal to the senate parliamentarian who is basically the referee, she said it violated the chamber's rules. so they went back to the drawing

into russian election meddling are growing increasingly frustrated with attorney general jeff sessions. after a closed door meeting with sessions, they said he refused to answer when asked if president trump ever instructed him to block probes. but congressman adam schiff acknowledged that three can't force sessions to speak without the help of the republicans. meanwhile, the "new york times" is reporting that the president had repeatedly urged top republican senators to end the investigation. richard bird told the times that the president told him he hoped he could conclude the probe as quickly as possible but bird said he did not feel pressure. sources say the president expressed similar concerns to others over the summer but they down-played it as actions of a political newcomer. rex tillerson said he didn't initially want the job. he may not have it much longer. the white house is working on what could be a rexit strategy. cecelia vega has more.
