mini heating system. and good tuesday morning, everyone. i'm kendis gibson. >> and i'm maggie rulli in for diane macedo. we begin with the government shutdown officially over after the democrats blinked. >> overnight president trump signed the bill to keep the government running albeit just for another 17 days. that could mean yet another shutdown. the democrats caved in an exchange for a republican promise to address the future of the d.r.e.a.m.ers. abc's arlette saenz joins us from washington. good morning, arlette. >> reporter: good morning, kendis and maggie. after days of negotiating and finger-pointing the government shutdown is officially over but lawmakers could be back in this exact same situation in less than three weeks. with little fanfare, president trump signed a bill ending the government shutdown. for now. >> by opening up the government we stop losing. >> reporter: leaders on both sides of the aisle were jubilant. the president tweeted big win for republicans as democrats

cave on shutdown. congress passed a temporary fix funding the government through february 8th when another shutdown looms. democrats had insisted any deal include protections for the nearly 800,000 undocumented immigrants brought to the u.s. as children. >> to all the d.r.e.a.m.ers who are watching today, don't give up. >> reporter: ultimately, they received a promise. senate republicans agreed to work towards a solution for the d.r.e.a.m.ers. >> it would be my intention to take up legislation here in the senate that would address daca, border security and related issues. >> are you confident mitch mcconnell will keep his word? >> mcconnell made a pledge in front of the world so we're counting on him and i think he will. i hope he will. >> reporter: while the senate has vowed to act house republicans haven't made the same commitment. the next move could depend on the president. >> we want to negotiate and get to a place and we're hopeful we can do that over the next couple of weeks.

>> reporter: the daca program is set to end march 5th. without a solution, some d.r.e.a.m.ers could start to face deportation at that time. the president said he's willing to make a long-term deal on immigration if and only if it's good for our country. maggie and kendis. >> arlette saenz in washington, d.c., thank you. in the meantime, the u.s. embassy in haiti is expected to re-open after more than a thousand demonstrates marched outside to protest president trump's comments about that country. officers fired tear gas when protesters started throwing rocks. china and south korea are protesting new tariffs that president trump is announcing on imported washing machines and solar panels. lg and samsung are among those that will be slapped with 20% tariffs that leapt u.will help manufacturers like whirlpool. the tariff could hurt american workers because most u.s. jobs? the solar industry are in installation and not

manufacturing. there appears to be more turmoil inside the justice department and fbi after word that the director of the fbi christopher wray threatened to resign amid pressure from attorney general jeff sessions. now, the website axios reports that they tried to get wray to fire andrew mccabe. wray threatened to step down if mccabe was removed and sessions backed off. tougher rules now in place to keep terrorists from getting a bomb on board a plane bound for the u.s. it requires data to be submitted for cargo packed on to flights from saudi arabia, egypt, jordan, qatar and the united arab emirates. no specific threat but a failed plot to bring a bomb onto a jetliner last year reminded them that cargo is a target. a man from michigan is under arrest. court documents accuse him of

planning a mass shooting at cnn headquarters in atlanta. the man made repeated calls to the network complaining about fake news and threatening violence. five workers missing after a powerful explosion ripped through a gas drilling rig in oklahoma. at one point authorities say everything at the site was on fire. at least 20 workers were at the rig when the explosion started. most were rescued. investigators holding out hope that some of the missing workers escaped into the surrounding woods. the family of a kansas man fatally shot at the door of his home after a prank call is now suing the city of wichita and the officers involved. fin andrew finch was the target. they called police with a fake story. when finch answered his door he was unarmed but an officer said he feared for his life when finch moved toward his waistband. finch's wife and attorney says that's no excuse. >> the wichita pd is trying to

make him the scapegoat and that's not going to happen. >> swatting is not a new phenomenon and police have to be trained. >> tyler barriss was charged for making that call. at least one person killed after a volcano erupted near a ski resort in japan. several people hurt by flying rocks. the japanese soldier on a training exercise died after being caught in that avalanche. dozens of flights canceled in minneapolis and other parts of the upper midwest as well as planes after blizzard conditions. parts of kansas and nebraska got up to 14 inches of snow with winds topping 60 miles an hour. heavy rain is the big concern, however, today in the northeast. and you have these ice jams clogging waterways and melting and they could cause some serious flooding today. well, farther north in canada no

in their school cafeteria. the victim is a 15-year-old girl but authorities have not released details yet on her condition. the suspect is a 16-year-old male student who reportedly has a past of violent history. he's in custody now but no word on a motive. a 2-year-old girl from mississippi is among the latest children to die from the flu. in north carolina 6-year-old emily muth died three days after being diagnosed. her mother says she was given tamiflu and was told to keep emily hydrated but a couple of days later she had trouble breathing and soon passed away. hospitals nationwide are asking staffs to work overtime and cancel elective surgeries to make more room tore beds. some ers report standing room only and more hospitals have set up tents in parking lots. as for telling the difference between a common cold and the flu in young children, one doctor told us very young children tend to have more stomach-related issues with the flu. a nurse serving a life sentence for murdering two patients in germany is now

in santa rose have, california. >> 15 weeks after the deadliest wildfires in california history, students were given a superstar's welcome back to class. amy holyfield shows us. >> reporter: going to 00 school isn't usually a red carpet affair. they headed back to school for the first time since the deadly october wildfires. >> i think it's great. i think it's nice for the kids to see that everyone in the community is really rooting for them to get back to normal and they're here for them. >> reporter: first responders who are always there during the bad times were part of the welcoming committee showing that they are here for us during the good times too. >> just to see all the kids, the smiles on their faces was very heartwarming. >> reporter: the buildings at st. rose school are still standing but had significant water damage. it took the last three months to get it all restored and ready for kids. while the mood was celebratory, they also had comfort animals on hand knowing many of these kids

have been through more than just missing school. >> we lost our house so losing the school was extra hard but being able to come back and be in the same place and have the same people it's been good. >> reporter: at the neighboring cardinal newman high school campus the first day back started with an assembly so the whole school could be together. >> we've been away for so long and been separate. now we get to come together with this great assembly. it's so exciting and it's going to be a great last semester. >> reporter: this school did suffer a huge loss in the fire, 27 classrooms, the library and administration building all burned. the burned debris can still here next to the temporary portables where students will be in class. >> that's sad. it's a reminder of the past but this is our future so we're building a future better than ever. >> reporter: they estimate it'll be another two to three years before the campus is completely rebuild. in santa rosa, amy holyfield, abc news.
