( muttering ) toby, shhh! well, charlie, looks like we'll get back in camp just about in time to get started again. poor toby. it's a good thing you've got me to take care of you.
10:02 am
mornin'. good morning, toby. ohh... where are we? don't you remember last night, toby? yeah. i know. you hungry? a little. i think i can fix that. do some eating, midge. hey find us here? well... we're stowaways, you know. but i don't think they'll make us walk the plank. they might cook us and feed us to the horses. oh, toby. horses don't eat people. ( chuckles ) you're funny. you know, midge, we're a long way from california. i do hope they can find a nice place for you with some nice people.
10:03 am
10:04 am
what's the matter? wagon broke down. well, midge, now's as good time as any. you mean we should-- got to sometime. we just can't stay in this wagon. now, honey, you leave everything up to me. it just let go. wasn't my fault. those things happen, alf. can't be helped. get your wagon unloaded so we can work on it. bill, go get charlie, tell him to come back and give us a hand. we'll have to camp here the night. we'll have it fixed by morning, all right. it's a darn shame. and old, broken-down outfit like this holding everybody up. folsom, will you shut up?! you've done nothing but complain ever since we started out. and with good reason! you got no right in this train in the first place with an old rickety outfit like-- that's enough. no use in gettin' all riled up. come on, alf, get unloaded. all right, major. but he better learn to keep his mouth shut, or one day somebody's gonna shut it for him. you lunkhead, i-- come on, come on.
10:05 am
well, mr. folsom seems a man of high temper and very little patience, major. treats that poor woman more like a servant than a wife. yeah, but i guess that's their business. is there anything i can do to help out here? no, thanks, mr. ferguson. we'll manage. charlie, give 'em a hand unloading this wagon, will ya? bill, get a pole so we can jack this thing up. and bring an axle, too. right. say, my young friend here and i would like to help if we can. i don't think i've seen you before. where'd you come from? coopertown. coopertown? coopertown. charlie: major, suppose we could-- hey, how'd he get here? ain't you the fella works at the livery stable in coopertown? now, gentlemen, i think i can clear the whole thing up for you if you let me. we've been passengers in your supply wagon since coopertown. wooster... honest, major. i don't know any more about this than you do. honest. toby: he's telling the truth.
10:06 am
and i overheard some of your men give orders to have the horses hitched so they could get going this morning. we're on our way out west, and we thought it would be a good way to get there. well, i'll be. stowaways, huh? well, major, we're willing to work. we're pretty handy. uh-uh. well, missy, what's your name? midge. but i can work as hard as a boy. hmm. and yours? tobias. tobias jones. well, mr. jones... i think i'd like to have a few words with you. this young girl here, is she your daughter? no. no relation at all. just good friends. she was all alone, and so was i. but she's a good kid, major, a wonderful kid. she's had a bad time of it. believe me, i wish she was mine. yeah. mr. jones, you been drinkin'? oh, no. no. i'm not a drinkin' man. i-i do use a little medicine. 10:10 am
( coughing ) oh, major adams. i didn't think-- i know you didn't think. tobias, i'm gonna talk straight to you, and you better listen. already several people on this train have complained about you drinking in front of that little girl. it's not right, and you know it's not. ordinarily a man's drinking is his own business, but the responsibility for running this wagon train is my business. a man that drinks too much is liable to cause trouble, and i'm not gonna have trouble. do you understand that? you needn't worry about me, major adams. you're half-drunk already and you're going for more. i know my limit, major adams. . i give you my word. ( sighs ) all right, tobias. but you better take it easy on that...cough medicine of yours. not another drop tonight. i gotta get back to my whittlin'. yeah, you do that. did you get him straightened out, major? i don't really know, charlie.
10:11 am
me his word, and i'll take any man's word until he lies to me. want me to kind of keep an eye on him? no, charlie. i don't want you to develop a cough. major adams. good evening, mrs. folsom, mr. ferguson. i was talking to mr. folsom about the stowaways, and she has a very good suggestion. oh? yes, about the little girl-- poor little thing. it must be very crowded and uncomfortable for the two of them in that supply wagon. yes, i've been thinking about that some. mr. folsom has been kind enough to say le girl in with them. are you sure it's... it'll be all right, major. i told her that i'd be glad to pay any expense involved. mr. folsom: martha! martha! over here, michael. what about mike? it'll be all right, major. where the devil you been?! mike. we couldn't find you. we've been discussing the stowaways, and mrs. folsom was good enough to offer to take the little girl in with you.
10:12 am
you and your addle-headed ideas. now, listen, major, we're not gonna take anybody in our wagon. we're crowded enough as it is. you come with me, martha. ( sighs ) michael, wait a minute. can't you see that it's just plain foolish to just up and take that kid in with us? look at 'em-- a couple of tramps. thieves, for all we know. what if anybody knew how much cash we're carrying in our wagon? every last cent we got in the world! lower your voice. someone will hear you. you mean him? he didn't hear anything. no, martha, you just forget about the kid. i want to do this, michael. and i'm going to do it. all right. all right, but if anything happens, i'll hold you responsible. haven't you always, michael? i'll go tell the major. major, we'll take the child in with us.
10:13 am
that takes quite a load off my mind. would you like to tell her now? yes. you like it, midge? i think it's just wonderful, toby. you sure are a good whittler. i can do better. knife needs sharpening. i haven't whittled in-- good evenin', midge, tobias. midge, we found a real nice place for you with mrs. folsom here. but we've already got a place. they have a very nice wagon, midge, and mrs. folsom would very much like to have you with them for the trip. toby too? no, honey, we haven't room for you both. midge, you can't do that. we've already made arrangements. well, why can't i? we have to be together. toby, i don't want to go in their wagon. it'll be all right, honey. you'd be more comfortable in a nice, roomy wagon. i don't care. i want to stay with you. now, just a minute. i've got something to say about this.
10:14 am
you want me to go with her? i don't much care. there'll be more room in the wagon for me. all right, i'll go. all right, dear, come on. midge, don't you want the horse? no. i don't want it. midge, i'll-- i'll finish it and bring it over to you. all right, toby, you bring it. thanks, tobias. forget it. that's what you wanted, wasn't it? the kid'll be better off. i'm not fit company for her. i'm not fit company for anybody. feel kinda sorry for that little fella. yes, it is too bad, major. he's a good-hearted soul. devoted to that child. i'd like to help them if i could.
10:15 am
10:16 am
10:17 am
michael, stop! why, you-- toby! tobias! what the devil are you-- you're drunk! toby! don't cry, honey, it's all right. i caught that man trying to sneak into my wagon. i warned you about this, tobias, your drinking. i'm not gonna stand for it. it's not his fault. it's your fault. it's all your fault. you shouldn't have taken me away from him. you just calm down, honey. you come on with me, tobias. what are you gonna do about this, major? go on to bed, folks. everything's all right. come on, tobias. toby, i'm going with you. no, honey. you stay with mrs. folsom. everything will be all right. but what are they gonna do to you? i don't know. i don't care. it doesn't matter. what are you gonna do to him? midge, honey, i'm not gonna do a thing to him.
10:18 am
you mean you ain't gonna do anything to him?! this man tried to rob me! that's a lie. folsom... i know i'm drunk. but i'm not so drunk that i can't remember what you did to her. if you ever lay a hand on her again, you'll answer to me. and don't you forget it. come on, tobias. come on. what if you had a medical emergency away from home? my chest hurts. i can't breathe. what you need is mobile help. america's premier mobile medical alert system.

10:23 am
good morning, major. well, good morning, young lady. did mr. ferguson tell you what i wanted to talk to you about? he said you were gonna keep toby tied up in the wagon. please, major, don't. well, honey, it isn't that i want to keep him tied up, but, well, after last night some of the folks are kind of afraid of your friend, they don't trust him. afraid of him? but toby wouldn't do anything wrong, major. honest he wouldn't. well, i don't know, after his drinking last night, i'm not so sure. i want to talk to you. honey... i realize that you love tobias very much and that you'd like to help him, but tell me something-- how long have you known him? not very long. how'd you happen to meet up with him? do i have to tell you? well, i'd like to know. i was running away. you--why?
10:24 am
so i ran away. well, where are your parents? my father was in the war, he...didn't come back. it made my mother sick, and she died. weren't there any other relatives, nobody else for you to go to? i have an uncle. he's somewhere west-- sacramento, i think. i have to find him. so that's why you ran away, huh? then you met tobias. yes. anything about where he came from, his past? not much. but i know he wouldn't do anything wrong. toby's good and kind. he's the only one who even cares about me. well, what about when he's drinking? i know he shouldn't, major, but toby can't help it. i think something happened to him sometime, and it makes him sad, and...
10:25 am
that's why i wanted to talk to you. tobias has told me that he hasn't got any more of that medicine of his. he has. i've had his wagon searched. he's hid it. he's very good at that. major, if i can get toby to give it to me, you won't have to tie him up, will you? well, no, i... i suppose not. i'll get it. you know, i feel kind of sorry for that little kid. for one her age, she's picked herself quite a load to carry. major, my father was a very wise and a very good man, he was a man of god. and he always held that a girl child was a woman--a mother-- from the day she was born. he was right. toby.
10:26 am
toby... well... morning, midge. i bet i know what you're after. now, you wait a minute and i'll-- i'm sorry, honey, but i lost your horse someplace. i found it down by our wagon. it was all broken. oh, well. i'm gonna whittle you a better one anyway. midge, i'm sorry about last night. i shouldn't have done it. no, you shouldn't. toby, where's the rest of your medicine? my medicine? why? i want you to give it to me. i, uh, i--it's gone. honest, midge, it's gone. and i told 'em. you told me it's wrong to lie, didn't you? it is. but midge, are you gonna let poor old toby go without his medicine?
10:28 am
t to mrs. folsom. she'll put it away. but suppose i need it. you ask major adams. if you really need it, he'll give you some. toby, i have to. i don't want you to get in any more trouble. it's all right, honey. it's all right. ( music continues ) well, major, they seem to be enjoying it. yeah, they usually do. glad you got 'em started. well, there's nothing like a little music and dancing to make people forget unpleasantries and get rid of tension.
10:29 am
she told me that he used to own a carnival or something, he knows all kinds of magic and tricks and that kind of stuff. major, that'll be fine for you-- and for tobias. i think i'll go spread the word around a little, sort of set the stage for him. do that. you told me a lie. me alone. if they find you here like this, i don't know what they'll do. you stay here, toby, you hear? don't you leave this wagon. midge... where's my medicine? i gotta have my medicine, midge.
10:30 am
major adams. well, midge. where's tobias? uh, he's not feeling very well. he said maybe he'd feel better in a little while. do you think i oughta go talk to him? no. i mean, he probably just wants to think a little. tell him i'd like to have him join us when he feels like it. yes, i will. all right, honey.
10:31 am
i was, a little. i'm afraid i'm getting too old for that sort of thing. oh, not you. thank you. have you seen michael? no, i haven't. doesn't mike like to dance? we used to. michael really ought to mix more with people, but-- i'm afraid i'd better go find him. excuse me, major. surely. ( music continues ) oh, midge, honey, where have you-- whatever in the world-- major, i don't think these people are ever going to bed, do you? it's gettin' kind of late. maybe i better go see about tobias. oh, here comes midge now. midge, honey, i was just coming to look for you.
10:32 am
( concerned chatter ) man: what happened? i'm sorry, mrs. folsom... he's gone. ( onlookers gasp ) have you got any idea who might have done this? that money box in there... ten thousand dollars. man: ten thousand dollars! oh, michael. it wasn't worth his life! ( sobbing) some of you ladies-- please... take care of her, will you? ( sobbing ) folks, there's nothing you can see or do here. someone has killed mike folsom. i knew it. it was bound to happen. was it, alf? sure it was. mike was always just itchin' for trouble. if i was you, i'd keep my mouth shut. everybody knows that you had no love for mike folsom.
10:33 am
now, hold on, major. you ain't sayin' you think i-- i'm not sayin' anything except that you better mind your own business! i might as well tell you now, folks, it'll come out sooner or later... that knife that's sticking out of mike folsom's back belongs to tobias jones. no! no, major! toby didn't do it! midge, no. let me go! major adams, toby didn't do it! he couldn't! now, come on, darling. take care of her, will you, ferguson? you heard what the major said-- tobias killed mike. well, sure he did! he said he would last night when mike hit that kid! come on, let's get him. hold it! now just stay back over here! stay back, all of you. i'm running this outfit, and i'll run it the way i see fit. so stay back, every one of you.
10:34 am
10:38 am
there he goes! ( gun fires ) go get him. you try that again and i'll bend this gun barrel over your head. now, listen, you people, i told you once, i'm gonna tell you again-- i don't want any trouble, i'm not gonna have any trouble. now, if i have to, i can make it clear to you! alf, you get back. you won't be needing that. turn him loose, boys. tobias, looks to me like you're in real trouble. i didndn'to it. you didn't do what? i didn't kill him. then how'd he know mike was dead? he knows all about it! ike, bring that rope.
10:39 am
you're gonna hang this man, you're wrong, 'cause i'll stop ya. it might cause more bloodshed. i don't want that. i don't think anybody else does. major, we haven't got nothing against you, but why are you protecting this man? he killed mike-- he much as admitted it. now, a man kills, hehe got to be punished-- hung by the neck until he's dead. ain't that what the law says? all right, then. weweure ain't doing nothin' wrong, are we? yes, you are. you're trying to hang a man without a fair trial. the law says every man's got a right to a hearing. you're talking like we were dealing with a nice, decent, respectable man, major. but him--look at him! what is he? a tramp, a nobody! there's been nothing but trouble ever since he and that kid came. and now he's killed a man. what more do you want? i don't care what you think of this man. whoever he is or whatever he's done, i say he's gonna have a chance to defend himself. and if you boys don't want to go along with me on that, me and my men'll stop ya-- with guns if we have to. now, i'll take charge e him. first thing in the morning, he'll get a fair trial.
10:40 am
a he'll hang. major adams is right! you people, most of you, are good, god-fearing people. you know he's right. keep an eye on those two. tobias, come on over here. i want to talk to you. sit down. i'm all right. did you kill mike folsom? did you? it makes no didierence. toby, listen to me, will ya? i know you been drinkin', but you've got to think, and you better think straight. those people over there want to hang you, and there's not a thing in the world i can do about it if you won't defend yourself. i don't think you killed mike folsom. i don't think you could kill anybody.
10:41 am
don't you understand that?! i'm no good. i'm grateful for what you're trying to do, but give it up.. it'll be better for everybody. if you won't think of f urself, will you think of midge? i am thinking of midge. believe me, i am thinking of her. but i'm no good, major. look at me. i'm just a worthless nobody. oh, toby-- yes, i am. i've been this way all of my life. i've never had a good thought for anybody but myself. i've never had anybody to give a thought to. yes, i've got midge. and look what i've done to her. no, major, midge'll be bettererff without me. ( sighs ) i hope you know what you're doing. you're deliberately putting a noose around your own neck. toby, i know you didn't kill folsom, you couldn't, but those people are gonna hang you, only because you won't speak out in our own defense. and i'm gonna have to live the rest of my life knowing that i've e t an innocent man get hung.
10:42 am
d it. i killed mike folsom. i don't believe you. you're lying to me. all right, tobias. you go o oand go to bed and get some sleep. but tomorrow morning, you better come up with some answers-- the right answers. major, aren't you gonna tie me up? i could escape. that wants to die as much as you apparently do is not gonna try to get away. good night, tobias. and so, with tobias refusing to say anything in h h own behalf and none of the rest of you coming up with anything
10:43 am
right, major. toby... are you sure you've got nothing to say? well, there's one thing that bototrs me, and it bothers me a great deal. mrs. folsom herere told me that... at the time her husband was killed, there was some money taken-- a lot of money. so far, we haven't found that money. tobias didn't have it on him-- we searched his wagon, it wasn't there. still looking for it. toby, did you take it? you know, that money could mean an awful lot to mrs. folsom. what did you do with it? i-i i s drunk. i don't remember. yeah, that's what you said. well, you don't leave us much of a choice.
10:44 am
and the other was a lot t money was taken. his knife? i remember now-- toby didn't have his knife when--- major adams. toby didn't have his knife. he lost it. toby, tell him you lost it. why didn't he say something about it himself? ( crowd murmuring ) now, now, now, just keep quiet. midge, honey-- she doesn'n'know anything about this! she's trying to help me. you keep quiet too. midge, now you're trying to tell me i don't know, but it was yesterday afternoon. i wanted toby tohittle something for me, but he couldn't, because he didn't have his knife. he said he lost it back at the springs. what about that, tobias? can't you see the kid is lying? she's lying to help p . toby, i wouldn't lie. i'm not lying. toby, what's the matter? why don't you tell them? wait a minute, folks. wooster here says he knows something about that knife. go ahead, charlie, tell 'em.
10:45 am
to ask me to borrow the grindstone to sharpen his knife. when i took my team down to the water, he was using it. and as i recall, someone hollered out help with a water keg. tobias went to give him a hand. and i remember he left his knife lying right there by the stone. now, that don't mean nototn'. ( all murmuring ) just give him a chance to finish, will ya? go ahead, charlie. when i came back with the team, tobias was gone. the knife was lying there where he left it. i didn't think anything about it, i thought he'd come back and pick it up later. but i never did see him come back. when i went to load the stone, the knife was gonene well, this could make a great deal of difference. from what midge here has told us and now what charlie says, it appears to me that it's pretty plain that somebody else could have got their hands on that knife. what about it, toby? did you go back and pick up your knife? toby, tell him! why don't you tell him? midge, do you remember last night
10:46 am
what was it, midge? midge, i think you know something more than what you're telling us. no, i-i don't know anything. you do know something, midge, and you'll have to tell them. honey, remember, she saw me last night. i've always told you to tell the truth. but if i tell him-- it doesn't'tatter. you do this for me, midge, and you'll be helping me. helping you? yes. now, you tell them. all right, toby. all right. i saw toby last night. he was goingngo mrs. folsom's wagon. he'd had too much to drink, and he was going after more. i tried to stop him... but he made me go away. so i hid, and i watched him. i didn't know what to do. then i saw him go in the wagon. he was only in there a little while.
10:47 am
and then he ran. i went to tell major adams, but mrs. folsom went to the wagon and-- but toby didn't do it! i know he didn't! he just couldn't! just what more do you need to know, major? trial's over. thank you very mucuc gentlemen. you know what this means, toby. yes. oh, toby! toby, you didn't do it! i know you didn't! tell them! tell them!!!
10:50 am
10:51 am
well, i've got something to say to you people. you may not like it, but i'm gonna say it. i still don't think that tobias jones killed mike folsom. but i do believe that one of us here-- at least one of us-- knows that he didn't kill him. i've had a lot to do with men in my life... a lot. i think i know something about 'em. and i say this man couldn't kill. look at him. does he look like a killer to you? i say no. he tells us he's had a fair trial and was found guilty. i know that wasn't a fair trial the same as you do. it wasn't a fair trial because he wouldn't leleit be. i tell you that there's more to this then we've found out. if he killed mike folsom, where's the money? and what about that knife? midge tell us he lost it,
10:52 am
well, at least there's a mighty good chance that somebody else could have gototn their hands on that knife. and another thing-- why did this man make that little girl tell about seeing him go into folsom's wagon? he did it deliberately. why, i don't know, but he did it. why did he make her say the one thing that would put that noose around his neck? i told you people last night that i'd see this man got a trial, and if he was found guilty,, he'd get hung. he was found guilty becausushe wanted it that way. and he's gonna hang-- but not by my hand. i don't want it on my conscience that i've taken the life of an innocent man. i don't think any man can live with that on his mind. so mr. alf meadows... you've been so sure all along that toby was guilty, right from the start you have. so i'm gonna give you this honor.
10:53 am
you just step right over here and kick that horse out from under him. go ahead. all right... i ain't finicky about it. you don't think he done it. well, he was tried and found guilty, and i think he is. he's gotta hang. and if you ain't got the nerve to do it, major, then i will. no. meadows, wait. nocent. i killed mike folsom. i'm a thief, lived most of my life a thief. i knew folsom had that money, and i needed it. i followed him totohis train to get it. when i saw tobias's knife by the grindstone i took it to throw suspicion for the theft ononim, leave the knife in the wagon. i had no intention of killing folsom. i'm a thief, major, not a murderer.
10:54 am
and i killed him. but... i can't let an innocent man die for my crime. you were right... a man couldn't live with that on his mind. pete, joe, take charge of him. we'll take him to the proper authorities at gainesville. slack off that rope. well, tobias? i don't understand, major. why did you do this for me?
