win the military community over to the hillary clinton camp. local election officials are scrambling to decide what to do about early voting now that a federal appeals court struck down the state's election issues. we'll have 17 days of early voting in november. today o.k.'s board will meet to approve a voting schedule. wake county approved a plan to add seven days. the county board of elections office in downtown raleigh. governor mcroy is asking the u.s. supreme court to issue a state of overturning the state's voter i.d. law. the governor is asking for the law to stay in place for november's election. he said change election laws this close to the election would only create problems and confusion. a few weeks ago a federal

july yeah jim is lives in orange county where the judge heard several motions this morning. >> reporter: his attorneys are raising questions about how some of the evidence in this case was collected calling it illegal and improper. chandler kena on house arrest and on bond is no longer using a wheelchair or crutches. he was in court today with parents. defense attorneys don't want jurors to hear about his cell phone records. they claim the cell phone was seized illegally pointing out the warrant was improperly filled out. two troopers took the stand this morning to explain the significance of that cell phone. >> he had the phone the night prior. we have all his text messages on that involved drinking or anything of that nature back

>> reporter: prosecutors say he was 20 at the time had been drinking at several chapel hill bars that night before getting behind the wheel drunk and driving the wrong way down i-85. he plowed into this car killing three people inside. including a 6-year-old little girl. two more troopers are expected to testify. the defense will also argue that jurors should hear about the blood alcohol report. his blood alcohol was reported to be.17. that's twice the legal driving limit. they want to limit the number of photos in the dash cam video the jurors can see calling him inflammatory. this trial is expected to start october 3rd. we'll go back in the courtroom and we'll bring you all the information on what happens

charges are pending following an overnight chase that started in wayne county. and ended with a crash in johnston county. the call came in before 2:00 a.m. that a woman had stolen a car from a gas station. a number of law enforcement agencies joined the pursuit. the car crashed on highway 70 in a construction zone near selma. deputies say no one was hurt. authorities arrested the woman. navajo nation is suing the epa over the gold king mine disaster in last august 300 million gallons of wine waste water spilled into a tributary in new mexico. the navajo nation contends the epa failed to compensate thousands of farmers. epa has taken responsibilities of the incident and dedicated $29 million to the disaster response. the world's largest nining company posted a record loss today in part to the fallout from that deadly brazil dam

neighbors seriously injured. a neighbor called 9-1-1 saying he was stabbed trying to break up a fight. when the first deputy adrived they found austin moore on top of a victim in the debating his face. the deputy tried to remove the suspect using a stun gun the k-9. deputies eventually pried the suspect off of the man. there is a funeral held today accidentally shot and killed by a police officer during a demonstration. 73-year-old mary noleton was participating in a seminar last week when civilians learned how police officers do their jobs. that's when officers shot her during a demonstration. authorities say the gun was not supposed to be loaded.

and radar. we are talking about this bermuda high pressure system. it is a semipermanent feature that hangs out near the island of bermuda. during the summer it backs in the southeast. when it is here that particular weather pattern is hot and fairly dry. we don't see a lot of thunderstorms with this. it can get really, really hot. this high pressure system has sinking air. it is not conducive to thunderstorms which need rising air to form. this high also will keep any fronts and precipitation that may be to our west it is keeping any storms from popping up here. it is keeping any rain from approaching from the west. it is not going to be with us that much longer. by tomorrow it begins to ease back out toward bermuda. we start to see more of this rain to the west entering our area this particular weather pattern is what caused so much trouble in louisiana. we were talking about the fact they may see a pop up shower today. not a lot of rain in louisiana.

mississippi river valley we have plenty of it. once the high moves out. this band will shift into our area. we'll start to notice it on thursday. especially late thursday, thursday night into friday. instead of it stalling here and producing inches upon inches of rain, it will actually move on through. it will weaken and wash out. we are not going to see the same flooding they have seen across the lower mississippi river valley. we'll see that later in the week. today our story is the heated. this is future cast this heat index. 101 rocky mount. 101 south hill. we'll take it through the afternoon and put it on a loop mid afternoon. still looking at 101-102. we don't make it up to 105. that's the criteria for a heat advisory. you can see why we are not in it. however it will feel plenty hot. it will feel as hot as it did yesterday. 15% chance of rain today.

roll out to 7:00 a.m. we wake up to partly cloudy skies. in the afternoon and evening a few scattered showers pop up. we have a much better chance of that on thursday. it may be late in the day. it may be around the time of our evening commute or around dinner time. then we'll have that chance overnight into the day on friday. we are watching the tropics now. we are getting close to the peek of the hurricane season. it is the last week of august and first two weeks of september. it is around the corner. we have a wave coming off the look at the latest update from the national hurricane center. they bumped this up to an 80% chance it will get a name in the next two to five days. currently the forecast model really just bringing out here in the atlantic where it will be no real threat to anyone. we'll keep our eye on it this time of year. the front coming for thursday does look like, even by thursday night could produce half an inch to an inch of rain.
